38 | 38 | | alent to, or otherwise permit no additional levels of 7 |

39 | 39 | | telework than, those which were in effect on December 31, 8 |

40 | 40 | | 2019, and may not expand any such policy, practice, or 9 |

41 | 41 | | level until the date that an agency plan is submitted to 10 |
---|
42 | 42 | | Congress with a certification by the Director of the Office 11 |

43 | 43 | | of Personnel Management under section 3. 12 |

44 | 44 | | SEC. 3. STUDY, PLAN, AND CERTIFICATION REGARDING EX-13 |

45 | 45 | | ECUTIVE AGENCY TELEWORK POLICIES, 14 |

46 | 46 | | PRACTICES, AND LEVELS FOR EXECUTIVE 15 |

49 | 49 | | NGENERAL.—Not later than 6 months after the 17 |
---|
50 | 50 | | date of enactment of this Act, the head of each agency, 18 |

51 | 51 | | in consultation with the Director, shall submit to Con-19 |

52 | 52 | | gress— 20 |
---|
53 | 53 | | (1) a study on the impacts on the agency and 21 |
---|
54 | 54 | | its mission of expanding telework by its employees 22 |
---|
55 | 55 | | during the SARS–CoV–2 pandemic that commenced 23 |
---|
56 | 56 | | in 2019 and maintaining such expanded telework 24 |
---|
57 | 57 | | thereafter, including an analysis of— 25 |
---|

72 | 72 | | teleworkers rather than remote workers; 12 |

73 | 73 | | (C) any degree to which the agency failed 13 |
---|
74 | 74 | | during that expansion to provide teleworking 14 |
---|
75 | 75 | | employees with secure network capacity, com-15 |
---|
76 | 76 | | munications tools, necessary and secure access 16 |
---|
77 | 77 | | to appropriate agency data assets and Federal 17 |
---|
78 | 78 | | records, and equipment sufficient to enable each 18 |
---|
79 | 79 | | such employee to be fully productive; 19 |
---|
80 | 80 | | (D) any degree to which that expansion fa-20 |
---|
81 | 81 | | cilitated dispersal of the agency workforce 21 |
---|
82 | 82 | | around the Nation; and 22 |
---|
83 | 83 | | (E) any other impacts of that expansion 23 |
---|
84 | 84 | | that the agency or the Director considers ap-24 |
---|
85 | 85 | | propriate; 25 |
