16	16	of 2002 by requiring preclearance quarantine inspections
17	17	for all movement to or from the State of Hawaii by
18	18	either domestic or international travel, and for other
19	19	purposes.
20	20	Be it enacted by the Senate and House of Representa-1
21	21	tives of the United States of America in Congress assembled, 2
22	22	SECTION 1. SHORT TITLE. 3
23	23	This Act may be cited as the ‘‘Hawaii Invasive Spe-4
24	24	cies Protection Act’’. 5

31	31	Section 10811 of the Farm Security and Rural In-4
32	32	vestment Act of 2002 (7 U.S.C. 8307 note) is amended 5
33	33	to read as follows: 6
34	34	‘‘SEC. 10811. PRECLEARANCE QUARANTINE INSPECTIONS. 7
35	35	‘‘(a) P
36	36	RECLEARANCEINSPECTIONSREQUIRED.—The 8
37	37	Secretary of Agriculture, acting through the Adminis-9
38	38	trator of the Animal and Plant Health Inspection Service, 10
39	39	in cooperation with the Secretary of the Interior, the Sec-11
40	40	retary of Homeland Security, the Secretary of Commerce, 12
41	41	the Secretary of the Treasury, the government of Hawaii, 13
42	42	and each of their respective quarantine, natural resource, 14
43	43	conservation, and law enforcement agencies and officers, 15
44	44	as appropriate, shall conduct visual, x-ray, and canine 16
45	45	preclearance quarantine inspections of persons, baggage, 17
46	46	cargo, and any other articles destined for direct movement 18
47	47	to or from the State of Hawaii by either domestic or inter-19
48	48	national travel for high-risk invasive species and agricul-20
49	49	tural materials. 21
50	50	‘‘(b) I
51	51	NSPECTION LOCATIONS.—The domestic 22
52	52	preclearance quarantine inspections required by sub-23
53	53	section (a) shall be conducted prior to direct travel to or 24
54	54	from the State of Hawaii at all— 25
55	55	‘‘(1) departure and interline airports; 26

60	60	‘‘(3) destination sectional center facilities of the 2
61	61	United States Postal Service. 3
62	62	‘‘(c) I
63	63	NVASIVESPECIES ANDAGRICULTURALMATE-4
64	64	RIALS.—The Secretary of Agriculture, acting through the 5
65	65	Administrator of the Animal and Plant Health Inspection 6
66	66	Service and in consultation with the government of Ha-7
67	67	waii, shall develop a list of items subject to inspection for 8
68	68	purposes of screening pursuant to subsection (a). 9
69	69	‘‘(d) P
70	70	UBLICATION IN FEDERALREGISTER.—Not 10
71	71	later than 180 days after the date of the enactment of 11
72	72	the Hawaii Invasive Species Protection Act, the Secretary 12
73	73	of Agriculture, acting through the Administrator of the 13
74	74	Animal and Plant Health Inspection Service and in co-14
75	75	operation with the government of Hawaii, shall publish in 15
76	76	the Federal Register the list developed pursuant to sub-16
77	77	section (c). 17
78	78	‘‘(e) S
79	79	EIZURE AND DISPOSAL.—High-risk invasive 18
80	80	species and agricultural material discovered under sub-19
81	81	section (a) may be seized and disposed of in accordance 20
82	82	with section 10407.’’. 21
83	83	SEC. 3. PRECLEARANCE QUARANTINE INSPECTIONS FOR 22
84	84	PLANTS. 23
85	85	Section 421(b) of the Plant Protection Act (7 U.S.C. 24
86	86	7731(b)) is amended— 25

107	107	2002 (7 U.S.C. 8307(c) note)’’. 18
108	108	SEC. 4. COLLECTION OF FEES FOR INSPECTION SERVICES. 19
109	109	Section 2509 of the Food, Agriculture, Conservation, 20
110	110	and Trade Act of 1990 (21 U.S.C. 136a) is amended— 21
111	111	(1) in subsection (a)(1)(A), by inserting ‘‘in-22
112	112	cluding the cost of such services provided in connec-23
113	113	tion with the arrival in Hawaii, with respect to 24
114	114	screening for high-risk invasive species under section 25

130	130	Section 102(f) of the Department of Agriculture Or-13
131	131	ganic Act of 1944 (7 U.S.C. 7759(f)) is amended by add-14
132	132	ing at the end the following new paragraph: 15
133	133	‘‘(3) The Secretary of Agriculture shall pre-16
134	134	scribe and collect user fees sufficient to cover the 17
135	135	full cost of preclearance quarantine inspections con-18
136	136	ducted under section 10811 of the Farm Security 19
137	137	and Rural Investment Act of 2002 (7 U.S.C. 8307 20
138	138	note).’’. 21
