17	17	To establish a competitive bidding process for the relocation
18	18	of the headquarters of Executive agencies, and for other
19	19	purposes.
20	20	Be it enacted by the Senate and House of Representa-1
21	21	tives of the United States of America in Congress assembled, 2
22	22	SECTION 1. SHORT TITLE. 3
23	23	This Act may be cited as the ‘‘Strategic Withdrawal 4
24	24	of Agencies for Meaningful Placement Act’’ or the 5
25	25	‘‘SWAMP Act’’. 6

32	32	EFINITIONS.—In this section: 3
33	33	(1) E
34	34	XECUTIVE AGENCY.—The term ‘‘Executive 4
35	35	agency’’— 5
36	36	(A) has the meaning given the term in sec-6
37	37	tion 105 of title 5, United States Code; and 7
38	38	(B) does not include— 8
39	39	(i) the Executive Office of the Presi-9
40	40	dent; 10
41	41	(ii) the Department of Defense, in-11
42	42	cluding— 12
43	43	(I) the Defense Intelligence 13
44	44	Agency; 14
45	45	(II) the National Security Agen-15
46	46	cy; and 16
47	47	(III) the National Geospatial-In-17
48	48	telligence Agency; 18
49	49	(iii) the Department of Energy; 19
50	50	(iv) the Department of Homeland Se-20
51	51	curity; 21
52	52	(v) the Department of State; 22
53	53	(vi) the Office of the Director of Na-23
54	54	tional Intelligence; or 24
55	55	(vii) the Central Intelligence Agency. 25

59	59	(2) HEADQUARTERS.—The term ‘‘head-1
60	60	quarters’’— 2
61	61	(A) means the place or building serving as 3
62	62	the managerial and administrative center of an 4
63	63	Executive agency; and 5
64	64	(B) does not include an office that the 6
65	65	head of an Executive agency may maintain sep-7
66	66	arately from a place or building in the Wash-8
67	67	ington metropolitan area. 9

69	69	TATE.—The term ‘‘State’’ means each of 10
70	70	the 50 States. 11
71	71	(4) W
72	72	ASHINGTON METROPOLITAN AREA .—The 12
73	73	term ‘‘Washington metropolitan area’’ means the ge-13
74	74	ographic area located within the boundaries of— 14
75	75	(A) the District of Columbia; 15
76	76	(B) Montgomery and Prince George’s 16
77	77	Counties in the State of Maryland; and 17
78	78	(C) Arlington, Fairfax, Loudoun, and 18
79	79	Prince William Counties and the City of Alex-19
80	80	andria in the Commonwealth of Virginia. 20

82	82	ROHIBITION ONLOCATION OFHEADQUARTERS 21
83	83	INWASHINGTONMETROPOLITANAREA.— 22
84	84	(1) I
85	85	N GENERAL.—Subject to paragraph (2), 23
86	86	the headquarters of an Executive agency may not be 24
87	87	located in the Washington metropolitan area. 25

91	91	(2) EXCEPTION.—Subject to paragraph (3), the 1
92	92	headquarters of an Executive agency located in the 2
93	93	Washington metropolitan area on the date of enact-3
94	94	ment of this Act may remain in the Washington 4
95	95	metropolitan area. 5

97	97	ONDITION.—With respect to the head-6
98	98	quarters of an Executive agency that remains in the 7
99	99	Washington metropolitan area under paragraph (2), 8
100	100	after the date of enactment of this Act and except 9
101	101	as otherwise expressly provided by law— 10
102	102	(A) no new construction or major renova-11
103	103	tion may be undertaken on the headquarters; 12
104	104	(B) a lease agreement for the headquarters 13
105	105	may not be renewed; and 14
106	106	(C) a new lease agreement for the head-15
107	107	quarters may not be entered into. 16

109	109	OMPETITIVEBIDDINGPROCESS FORRELOCA-17
110	110	TION OFHEADQUARTERS.— 18
111	111	(1) I
112	112	N GENERAL.—Not later than 1 year after 19
113	113	the date of enactment of this Act, the Administrator 20
114	114	of General Services shall establish a process, in ac-21
115	115	cordance with the requirements under paragraph 22
116	116	(2), through which— 23
117	117	(A) the head of an Executive agency may 24
118	118	submit a request for the Administrator of Gen-25

122	122	eral Services to issue a solicitation for the relo-1
123	123	cation of the headquarters of the Executive 2
124	124	agency; or 3
125	125	(B) if determined necessary, the Adminis-4
126	126	trator of General Services may issue a solicita-5
127	127	tion for the relocation of the headquarters of an 6
128	128	Executive agency. 7

130	130	EQUIREMENTS.—With respect to any so-8
131	131	licitation issued for the relocation of the head-9
132	132	quarters of an Executive agency under paragraph 10
133	133	(1), the Administrator of General Services shall— 11
134	134	(A) allow any State and any political sub-12
135	135	division of a State to submit a proposal for the 13
136	136	relocation of the headquarters of the Executive 14
137	137	agency; 15
138	138	(B) provide the public with notice and an 16
139	139	opportunity to comment on any proposal sub-17
140	140	mitted under subparagraph (A); and 18
141	141	(C) in consultation with the head of the 19
142	142	Executive agency, select a State, or a political 20
143	143	subdivision of a State, for the relocation of the 21
144	144	headquarters using a competitive bidding proce-22
145	145	dure that considers— 23
146	146	(i) the extent to which the relocation 24
147	147	of the headquarters would impact the econ-25

152	152	or political subdivision of a State; 2
153	153	(ii) whether a State, or a political sub-3
154	154	division of a State, has expertise in car-4
155	155	rying out activities substantially similar to 5
156	156	the mission and goals of the Executive 6
157	157	agency; and 7
158	158	(iii) the extent to which the relocation 8
159	159	of the headquarters to a State, or a polit-9
160	160	ical subdivision of a State, would implicate 10
161	161	national security interests. 11
162	162	(d) R
163	163	ULE OFCONSTRUCTION.—Nothing in this Act 12
164	164	shall be construed to prohibit a political subdivision of the 13
165	165	State of Maryland or the Commonwealth of Virginia that 14
166	166	is located outside the Washington metropolitan area from 15
167	167	submitting a proposal under subsection (c)(2)(A). 16

169	169	FFSETALLOWED.—The Administrator of Gen-17
170	170	eral Services may use the proceeds from the sale of any 18
171	171	Federal building or land to offset the cost of relocating 19
172	172	the headquarters of an Executive agency. 20

174	174	OADDITIONALFUNDSAUTHORIZED.—The Ad-21
175	175	ministrator of General Services shall carry out this Act 22
176	176	using amounts otherwise made available to the Adminis-23
