2323 This Act may be cited as the ‘‘Strategic Withdrawal 4
2424 of Agencies for Meaningful Placement Act’’ or the 5
2525 ‘‘SWAMP Act’’. 6

3232 EFINITIONS.—In this section: 3

3434 XECUTIVE AGENCY.—The term ‘‘Executive 4
3535 agency’’— 5
3636 (A) has the meaning given the term in sec-6
3737 tion 105 of title 5, United States Code; and 7
3838 (B) does not include— 8
3939 (i) the Executive Office of the Presi-9

4141 (ii) the Department of Defense, in-11

4343 (I) the Defense Intelligence 13

4545 (II) the National Security Agen-15

4949 (iii) the Department of Energy; 19

5959 (2) HEADQUARTERS.—The term ‘‘head-1
6060 quarters’’— 2
6161 (A) means the place or building serving as 3
6262 the managerial and administrative center of an 4
6363 Executive agency; and 5
6464 (B) does not include an office that the 6
6565 head of an Executive agency may maintain sep-7
6666 arately from a place or building in the Wash-8
6767 ington metropolitan area. 9

6969 TATE.—The term ‘‘State’’ means each of 10
7070 the 50 States. 11

7272 ASHINGTON METROPOLITAN AREA .—The 12
7373 term ‘‘Washington metropolitan area’’ means the ge-13
7474 ographic area located within the boundaries of— 14
7575 (A) the District of Columbia; 15
7676 (B) Montgomery and Prince George’s 16
7777 Counties in the State of Maryland; and 17
7878 (C) Arlington, Fairfax, Loudoun, and 18
7979 Prince William Counties and the City of Alex-19
8080 andria in the Commonwealth of Virginia. 20

8282 ROHIBITION ONLOCATION OFHEADQUARTERS 21
8383 INWASHINGTONMETROPOLITANAREA.— 22

8585 N GENERAL.—Subject to paragraph (2), 23
8686 the headquarters of an Executive agency may not be 24
8787 located in the Washington metropolitan area. 25

9191 (2) EXCEPTION.—Subject to paragraph (3), the 1
9292 headquarters of an Executive agency located in the 2
9393 Washington metropolitan area on the date of enact-3
9494 ment of this Act may remain in the Washington 4
9595 metropolitan area. 5

9797 ONDITION.—With respect to the head-6
9898 quarters of an Executive agency that remains in the 7
9999 Washington metropolitan area under paragraph (2), 8
100100 after the date of enactment of this Act and except 9
101101 as otherwise expressly provided by law— 10
102102 (A) no new construction or major renova-11
103103 tion may be undertaken on the headquarters; 12
104104 (B) a lease agreement for the headquarters 13
105105 may not be renewed; and 14
106106 (C) a new lease agreement for the head-15
107107 quarters may not be entered into. 16

109109 OMPETITIVEBIDDINGPROCESS FORRELOCA-17
110110 TION OFHEADQUARTERS.— 18
111111 (1) I
112112 N GENERAL.—Not later than 1 year after 19
113113 the date of enactment of this Act, the Administrator 20
114114 of General Services shall establish a process, in ac-21
115115 cordance with the requirements under paragraph 22
116116 (2), through which— 23
117117 (A) the head of an Executive agency may 24
118118 submit a request for the Administrator of Gen-25

122122 eral Services to issue a solicitation for the relo-1
123123 cation of the headquarters of the Executive 2
124124 agency; or 3
125125 (B) if determined necessary, the Adminis-4
126126 trator of General Services may issue a solicita-5
127127 tion for the relocation of the headquarters of an 6
128128 Executive agency. 7

130130 EQUIREMENTS.—With respect to any so-8
131131 licitation issued for the relocation of the head-9
132132 quarters of an Executive agency under paragraph 10
133133 (1), the Administrator of General Services shall— 11
134134 (A) allow any State and any political sub-12
135135 division of a State to submit a proposal for the 13
136136 relocation of the headquarters of the Executive 14
137137 agency; 15
138138 (B) provide the public with notice and an 16
139139 opportunity to comment on any proposal sub-17
140140 mitted under subparagraph (A); and 18
141141 (C) in consultation with the head of the 19
142142 Executive agency, select a State, or a political 20
143143 subdivision of a State, for the relocation of the 21
144144 headquarters using a competitive bidding proce-22
145145 dure that considers— 23
146146 (i) the extent to which the relocation 24
147147 of the headquarters would impact the econ-25

151151 omy and workforce development of a State 1
152152 or political subdivision of a State; 2
153153 (ii) whether a State, or a political sub-3
154154 division of a State, has expertise in car-4
155155 rying out activities substantially similar to 5
156156 the mission and goals of the Executive 6
157157 agency; and 7
158158 (iii) the extent to which the relocation 8
159159 of the headquarters to a State, or a polit-9
160160 ical subdivision of a State, would implicate 10
161161 national security interests. 11

163163 ULE OFCONSTRUCTION.—Nothing in this Act 12
164164 shall be construed to prohibit a political subdivision of the 13
165165 State of Maryland or the Commonwealth of Virginia that 14
166166 is located outside the Washington metropolitan area from 15
167167 submitting a proposal under subsection (c)(2)(A). 16

169169 FFSETALLOWED.—The Administrator of Gen-17
170170 eral Services may use the proceeds from the sale of any 18
171171 Federal building or land to offset the cost of relocating 19
172172 the headquarters of an Executive agency. 20

174174 OADDITIONALFUNDSAUTHORIZED.—The Ad-21
175175 ministrator of General Services shall carry out this Act 22
176176 using amounts otherwise made available to the Adminis-23
