1818 This Act may be cited as the ‘‘Ensuring Military 4
1919 Readiness Not Discrimination Act’’. 5
2020 SEC. 2. NONDISCRIMINATION WITH RESPECT TO SERVICE 6

2323 NGENERAL.—Chapter 37 of title 10, United 8
2424 States Code, is amended by inserting after section 651 the 9
2525 following new section: 10

3232 TANDARDS FOR ELIGIBILITY FORSERVICE.— 3
3333 Any qualifications established or applied for eligibility for 4
3434 service in an Armed Force shall take into account only 5
3535 the ability of an individual to meet occupational standards 6
3636 for military service generally and the military occupational 7
3737 specialty concerned in particular, and may not include any 8
3838 criteria relating to the race, color, national origin, religion, 9
3939 or sex (including gender identity, sexual orientation, or sex 10
4040 characteristics (including intersex traits)) of an individual. 11
4141 ‘‘(b) E
4242 QUALITY OFTREATMENT AND OPPORTUNITY 12
4343 INSERVICE.—Any personnel policy developed or imple-13
4444 mented by the Secretary concerned with respect to mem-14
4545 bers of the Armed Forces shall ensure equality of treat-15
4646 ment and opportunity for all persons in the Armed Forces, 16
4747 without regard to race, color, national origin, religion, and 17
4848 sex (including gender identity, sexual orientation, or sex 18
4949 characteristics (including intersex traits)).’’. 19

5151 LERICALAMENDMENT.—The table of sections 20
5252 at the beginning of such chapter is amended by inserting 21
5353 after the item relating to section 651 the following new 22
5454 item: 23
