20	20	United States, and for other purposes.
21	21	Be it enacted by the Senate and House of Representa-1
22	22	tives of the United States of America in Congress assembled, 2
23	23	SECTION 1. SHORT TITLE. 3
24	24	This Act may be cited as the ‘‘Creating Obstructions 4
25	25	Necessary To Address Illegal and Nefarious Entry Rap-5
26	26	idly Act’’ or the ‘‘CONTAINER Act’’. 6

35	35	EFINITIONS.—In this section: 5
36	36	(1) B
37	37	ORDER STATE.—The term ‘‘Border State’’ 6
38	38	means a State that is adjacent to the northern bor-7
39	39	der or southern border. 8

41	41	EDERAL LAND.—The term ‘‘Federal land’’ 9
42	42	means land under the jurisdiction and management 10
43	43	of a Federal land management agency that is adja-11
44	44	cent to the northern border or southern border. 12

46	46	EDERAL LAND MANAGEMENT AGENCY .— 13
47	47	The term ‘‘Federal land management agency’’ 14
48	48	means— 15
49	49	(A) the Bureau of Indian Affairs; 16
50	50	(B) the Bureau of Land Management; 17
51	51	(C) the Bureau of Reclamation; 18
52	52	(D) the Forest Service; 19
53	53	(E) the United States Fish and Wildlife 20
54	54	Service; and 21
55	55	(F) the National Park Service. 22

57	57	ORTHERN BORDER .—The term ‘‘northern 23
58	58	border’’ means the international border between the 24
59	59	United States and Canada. 25

63	63	(5) OPERATIONAL CONTROL .—The term ‘‘oper-1
64	64	ational control’’ has the meaning given such term in 2
65	65	section 2(b) of the Secure Fence Act of 2006 (8 3
66	66	U.S.C. 1701 note; Public Law 109–367). 4

68	68	ECRETARY CONCERNED .—The term ‘‘Sec-5
69	69	retary concerned’’ means— 6
70	70	(A) the Secretary of the Interior, with re-7
71	71	spect to Federal land under the jurisdiction and 8
72	72	management of the Secretary of the Interior, 9
73	73	acting through, as applicable— 10
74	74	(i) the Director of the Bureau of In-11
75	75	dian Affairs; 12
76	76	(ii) the Director of the Bureau of 13
77	77	Land Management; 14
78	78	(iii) the Commissioner of Reclamation; 15
79	79	(iv) the Director of the United States 16
80	80	Fish and Wildlife Service; and 17
81	81	(v) the Director of the National Park 18
82	82	Service; and 19
83	83	(B) the Secretary of Agriculture, with re-20
84	84	spect to National Forest System land, acting 21
85	85	through the Chief of the Forest Service. 22

87	87	OUTHERN BORDER .—The term ‘‘southern 23
88	88	border’’ means the international border between the 24
89	89	United States and Mexico. 25

93	93	(b) SPECIALUSEAUTHORIZATION.—Subject to sub-1
94	94	section (c), the Secretary concerned shall not require a 2
95	95	Border State to obtain a special use authorization for the 3
96	96	temporary placement on Federal land within the Border 4
97	97	State of a movable, temporary structure for the purpose 5
98	98	of securing the northern border or southern border, if the 6
99	99	Border State submits to the Secretary concerned notice 7
100	100	of the proposed placement not later than 45 days before 8
101	101	the date of the proposed placement. 9

103	103	EMPORARYPLACEMENT.— 10
104	104	(1) I
105	105	N GENERAL.—A movable, temporary struc-11
106	106	ture described in subsection (b) may be placed by a 12
107	107	Border State on Federal land in accordance with 13
108	108	that subsection for a period of not more than 1 year, 14
109	109	subject to paragraph (2). 15

111	111	XTENSION.— 16
112	112	(A) I
113	113	N GENERAL.—The period described in 17
114	114	paragraph (1) may be extended in 90-day incre-18
115	115	ments, on approval by the Secretary concerned. 19
116	116	(B) C
117	117	ONSULTATION REQUIRED .—The Sec-20
118	118	retary concerned shall consult with the Commis-21
119	119	sioner of U.S. Customs and Border Protection 22
120	120	for purposes of determining whether to approve 23
121	121	an extension under subparagraph (A). 24

126	126	shall approve a request for an extension under 2
127	127	this paragraph if the Commissioner of U.S. 3
128	128	Customs and Border Protection determines that 4
129	129	operational control has not been achieved as of 5
130	130	the date of the consultation required under sub-6
131	131	paragraph (B). 7
