Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Secret Service 4 Prioritization Act of 2025’’. 5 SEC. 2. FUNCTIONS TRANSFERRED. 6 (a) I NGENERAL.—In accordance with this Act, there 7 shall be transferred to the Director of the Federal Bureau 8 of Investigation the assets, functions, and obligations of 9 VerDate Sep 11 2014 06:48 Mar 06, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H56.IH H56 kjohnson on DSK7ZCZBW3PROD with $$_JOB 2 •HR 56 IH the United States Secret Service to detect and arrest any 1 person who violates— 2 (1) section 508, 509, or 510 of title 18, United 3 States Code, or, with respect to the Federal Deposit 4 Insurance Corporation, Federal land banks, and 5 Federal land bank associations, section 213, 433, 6 493, 657, 709, 1006, 1007, 1011, 1013, 1014, 7 1907, or 1909 of such title; 8 (2) any of the laws of the United States relat-9 ing to coins, obligations, and securities of the United 10 States and of foreign governments; or 11 (3) any of the laws of the United States relat-12 ing to electronic fund transfer frauds, access device 13 frauds, false identification documents or devices, and 14 any fraud or other criminal or unlawful activity in 15 or against any federally insured financial institution, 16 except that the authority conferred by this para-17 graph shall be exercised subject to the agreement of 18 the Attorney General and the Director of the Fed-19 eral Bureau of Investigation and shall not affect the 20 authority of any other Federal law enforcement 21 agency with respect to those laws. 22 (b) C ONFORMINGAMENDMENT.—Subsection (b) of 23 section 3056 of title 18, United States Code, is amended 24 to read as follows: 25 VerDate Sep 11 2014 06:48 Mar 06, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H56.IH H56 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 56 IH ‘‘(b) Under the direction of the Secretary of Home-1 land Security, the Secret Service is authorized to detect 2 and arrest any person who violates section 871 and 879 3 of this title.’’. 4 SEC. 3. TRANSITIONAL AUTHORITIES. 5 (a) P ROVISION OFASSISTANCE BY OFFICIALS.— 6 Until functions and obligations of the United States Se-7 cret Service are transferred to the Federal Bureau of In-8 vestigation under section 2, any official who, immediately 9 before the effective date of this Act, has authority over 10 or is responsible for functions relating to the United 11 States Secret Service shall provide to the Director of the 12 Federal Bureau of Investigation such assistance, including 13 the use of personnel and assets, as the Director of the 14 Federal Bureau of Investigation may request in preparing 15 for the transfer and integration of the functions and obli-16 gations of the United States Secret Service transferred 17 under section 2 into the Federal Bureau of Investigation. 18 (b) S ERVICES ANDPERSONNEL.—During the period 19 beginning on the date of enactment of this Act and ending 20 on the effective date of this Act, upon the request of the 21 Director of the Federal Bureau of Investigation, the head 22 of any executive agency may, on a reimbursable basis, pro-23 vide services or detail personnel to assist with the transi-24 tion. 25 VerDate Sep 11 2014 06:48 Mar 06, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H56.IH H56 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 56 IH (c) TRANSFER OFOBLIGATIONS ANDFUNCTIONS.— 1 Upon the transfer of the functions and obligations of the 2 United States Secret Service under section 2 to the Fed-3 eral Bureau of Investigation— 4 (1) the assets held by or available in connection 5 with the United States Secret Service shall be trans-6 ferred to the Director of the Federal Bureau of In-7 vestigation for appropriate allocation, subject to the 8 approval of the Director of the Office of Manage-9 ment and Budget and in accordance with section 10 1531(a)(2) of title 31, United States Code; and 11 (2) the Director of the Federal Bureau of In-12 vestigation shall have all functions and obligations 13 relating to the United States Secret Service that any 14 other official could by law exercise in relation to the 15 United States Secret Service immediately before 16 such transfer, including all such functions vested in 17 the Secretary of Homeland Security by the Home-18 land Security Act of 2002 (6 U.S.C. 101 et seq.) or 19 any other law. 20 SEC. 4. SAVINGS PROVISIONS. 21 (a) C OMPLETEDADMINISTRATIVEACTIONS.— 22 (1) I N GENERAL.—Any completed administra-23 tive action of the United States Secret Service shall 24 not be affected by the enactment States Secret Service functions 1 and obligations to the Federal Bureau of Investiga-2 tion under section 2, but shall continue in effect ac-3 cording to the terms of the completed administrative 4 action until the completed administrative action is 5 amended, modified, superseded, terminated, set 6 aside, or revoked in accordance with law by an office 7 of the United States or a court of competent juris-8 diction, or by operation of law. 9 (2) C OMPLETED ADMINISTRATIVE ACTION DE -10 FINED.—In this subsection, the term ‘‘completed ad-11 ministrative action’’ includes an order, a determina-12 tion, a rule, a regulation, a personnel action, a per-13 mit, an agreement, a grant, a contract, a certificate, 14 a license, a registration, and a privilege. 15 (3) P ENDING PROCEEDINGS .— 16 (A) I N GENERAL.—Any pending pro-17 ceeding in the United States Secret Service re-18 lating to functions or obligations transferred 19 under this Act, including a notice of proposed 20 rulemaking and an application for a license, 21 permit, certificate, grant, or financial assist-22 ance, shall continue notwithstanding the enact-23 ment of this Act or the transfer of United 24 •HR 56 IH to the Federal Bureau of Investigation under 1 section 2, unless the pending proceeding is dis-2 continued or modified under the same terms 3 and conditions and to the same extent that 4 such discontinuance could have occurred if such 5 enactment or transfer had not occurred. 6 (B) O RDERS.—Any orders issued in a pro-7 ceeding described in subparagraph (A), or an 8 appeal therefrom and any payment made pursu-9 ant to such an order, shall issue in the same 10 manner and on the same terms if this Act had 11 not been enacted or the United States Secret 12 Service functions and obligations transferred 13 under section 2 of this Act had not been trans-14 ferred, and the order shall continue in effect 15 until amended, modified, superseded, termi-16 nated, set aside, or revoked by an office of the 17 United States or a court of competent jurisdic-18 tion, or by operation of law. 19 (4) P ENDING CIVIL ACTIONS .—Any pending 20 civil actions shall continue notwithstanding the en-21 actment of this Act or the transfer of United States 22 Secret Service functions and obligations to the Fed-23 eral Bureau of Investigation under section 2, and in 24 the •HR 56 IH appeals taken, and judgments rendered and enforced 1 in the same manner and with the same effect as if 2 such enactment or transfer had not occurred. 3 (5) R EFERENCES.—Any reference relating to 4 United States Secret Service functions and obliga-5 tions transferred to the Federal Bureau of Investiga-6 tion under section 2, in a statute, an Executive 7 order, a rule, a regulation, a directive, or a delega-8 tion of authority that proceeds such transfer or the 9 effective date of this Act shall be deemed to refer, 10 as appropriate, to the Federal Bureau of Investiga-11 tion and the United States Secret Service, to its offi-12 cers, employees, or agents, or to its corresponding 13 organizational units or functions. 14 (b) E MPLOYMENTPROVISIONS.— 15 (1) R EGULATIONS.—The Director of the Fed-16 eral Bureau of Investigation may, in regulations pre-17 scribed jointly with the Director of the Office of Per-18 sonnel Management, adopt the rule, procedures, 19 terms, and conditions established by statute, rule, or 20 regulation before the effective date of this Act relat-21 ing to employment in the United States Secret Serv-22 ice to perform functions and obligations DSK7ZCZBW3PROD with $$_JOB 8 •HR 56 IH (2) DIRECT HIRE AUTHORITY.—The Director of 1 the Federal Bureau of Investigation may appoint, 2 without regard to the provisions of subchapter I of 3 chapter 33 (other than sections 3303 and 3328 of 4 such chapter) of title 5, United States Code, quali-5 fied candidates to any positions in the competitive 6 service to fulfill the functions and obligations trans-7 ferred under section 2. 8 (3) S TATUTORY REPORTING REQUIREMENTS .— 9 Any statutory reporting requirement that applied to 10 the United States Secret Service with respect to any 11 functions and obligations transferred to the Federal 12 Bureau of Investigation under section 2 shall con-13 tinue to apply following that transfer if the statutory 14 requirement includes an explicit reference to the 15 United States Secret Service and the functions and 16 obligations transferred under section 2. 17 SEC. 5. INCIDENTAL TRANSFERS. 18 The Director of the Office of Management and Budg-19 et, in consultation with the Director of the Federal Bureau 20 of Investigation, is authorized and directed to make such 21 additional incidental disposition of personnel, assets, and 22 liabilities held, used, arising from, available, or to be made 23 available, in connection with the functions transferred by 24 VerDate Sep 11 2014 06:48 Mar 06, 2025 Jkt 059200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H56.IH H56 kjohnson on DSK7ZCZBW3PROD with $$_JOB 9 •HR 56 IH this Act, as the Director determines necessary to accom-1 plish the purposes of this Act. 2 SEC. 6. REFERENCES. 3 With respect to any function transferred by this Act 4 and exercised on or after the effective date of this Act, 5 any reference in any other Federal law to United States 6 Secret Service with respect to functions and obligations 7 transferred under section 2 shall be deemed to refer to 8 the Director of the Federal Bureau of Investigation or the 9 official or component of the Federal Bureau of Investiga-10 tion to which such function or obligation is so transferred. 11 SEC. 7.
