3232 ‘‘SEC. 201. ANNUAL REPORT ON NEPA’S IMPACT ON 5
3333 PROJECTS. 6
3434 ‘‘(a) R
3535 EPORTREQUIRED.—Beginning July 1, 2025, 7
3636 the Council on Environmental Quality shall annually pub-8
3737 lish on the website of the Council on Environmental Qual-9
3838 ity, and submit to the Committee on Natural Resources 10
3939 of the House of Representatives and the Committee on 11
4040 Energy and Natural Resources of the Senate, a report 12
4141 on— 13
4242 ‘‘(1) each cause of action based on alleged non- 14
4343 compliance with this Act that was active during the 15
4444 period beginning June 1 of the preceding year and 16
4545 ending June 1 of the current year, which shall iden-17
4646 tify— 18
4747 ‘‘(A) with respect to each such cause of ac-19
4848 tion— 20
4949 ‘‘(i) the defendant lead agency and 21
5050 the lead plaintiff; and 22
5151 ‘‘(ii) the court in which the cause of 23
5252 action was brought and any court to which 24
5353 a decision on the cause of action was ap-25
5454 pealed; 26

5959 disaggregated by the defendant lead agency; 2
6060 ‘‘(C) the alleged basis for each such cause 3
6161 of action, disaggregated by type; and 4
6262 ‘‘(D) the status and outcome, if applicable, 5
6363 of each cause of action based on alleged non- 6
6464 compliance with this Act that was active during 7
6565 the period beginning June 1 of the preceding 8
6666 year and ending June 1 of the current year, in-9
6767 cluding whether— 10
6868 ‘‘(i) the cause of action resulted in the 11
6969 major Federal action being reversed; 12
7070 ‘‘(ii) the defendant lead agency was 13
7171 allowed to move forward with the major 14
7272 Federal action; 15
7373 ‘‘(iii) the court issued a ruling direct-16
7474 ing the defendant lead agency to take addi-17
7575 tional measures to be in compliance; 18
7676 ‘‘(iv) the lead plaintiff and the defend-19
7777 ant lead agency settled amongst them-20
7878 selves; 21
7979 ‘‘(v) the cause of action is still active; 22
8080 and 23
8181 ‘‘(vi) the lead plaintiff received an 24
8282 award, including an award of costs pursu-25

8989 ments and environmental assessments prepared pur-4
9090 suant to section 102(2)(C) during the period of 5 5
9191 years that ends on June 1 of the current year, which 6
9292 shall include— 7
9393 ‘‘(A) the average and median page count of 8
9494 each draft and final environmental impact 9
9595 statement and environmental assessment (in-10
9696 cluding the appendix) published in the Federal 11
9797 Register during such period of 5 years, includ-12
9898 ing such page counts disaggregated by quar-13
9999 tiles; 14
100100 ‘‘(B) the number of draft and final envi-15
101101 ronmental impact statements and environ-16
102102 mental assessments published in the Federal 17
103103 Register during such period of 5 years, 18
104104 disaggregated by defendant lead agency and 19
105105 subagency as applicable; and 20
106106 ‘‘(C) a description of trends in average and 21
107107 median page count of draft and final environ-22
108108 mental impact statements and environmental 23
109109 assessments published in the Federal Register 24
110110 during such period of 5 years compared to prior 25

116116 ‘‘(3) the total cost to prepare the environmental 3
117117 impact statements and environmental assessments 4
118118 described in paragraph (2), including— 5
119119 ‘‘(A) the full-time equivalent personnel 6
120120 hour costs, contractor costs, and other direct 7
121121 costs of the lead agency that prepared the envi-8
122122 ronmental impact statement or environmental 9
123123 assessment; and 10
124124 ‘‘(B) if practicable, and noted where not 11
125125 practicable, the costs incurred by cooperating 12
126126 agencies, participating agencies, applicants, and 13
127127 contractors; and 14
128128 ‘‘(4) the timelines to complete environmental re-15
129129 views pursuant to section 102(2)(C) during the pe-16
130130 riod of 10 years that ends on June 1 of the current 17
131131 year, which shall include— 18
132132 ‘‘(A) with respect to each major Federal 19
133133 action commenced during such period of 10 20
134134 years, the date on which (as applicable)— 21
135135 ‘‘(i) the project sponsor submitted an 22
136136 application for any permit or other author-23
137137 ization for the project; 24

147147 statement was published in the Federal 7
148148 Register; 8
149149 ‘‘(v) the final environmental impact 9
150150 statement was published in the Federal 10
151151 Register; 11
152152 ‘‘(vi) the record of decision was pub-12
153153 lished in the Federal Register; and 13
154154 ‘‘(vii) the lead agency provided to the 14
155155 project sponsor notice to proceed on the 15
156156 project; 16
157157 ‘‘(B) the average and median publication 17
158158 timelines during such period of 10 years for 18
159159 each document described in subparagraph (A); 19
160160 and 20
161161 ‘‘(C) a description of trends in completion 21
162162 times during such period of 10 years for such 22
163163 documents compared to prior reports published 23
164164 by the Council on Environmental Quality. 24

175175 OVERED SECTORS.—In this subsection, 5
176176 the term ‘covered sector’ means any of the following 6
177177 sectors: 7
178178 ‘‘(A) Aviation and space. 8
179179 ‘‘(B) Broadband. 9
180180 ‘‘(C) Carbon capture and sequestration. 10
181181 ‘‘(D) Conventional energy production. 11
182182 ‘‘(E) Renewable energy production. 12
183183 ‘‘(F) Electricity transmission. 13
184184 ‘‘(G) Manufacturing. 14
185185 ‘‘(H) Mining. 15
186186 ‘‘(I) Pipelines. 16
187187 ‘‘(J) Ports and waterways. 17
188188 ‘‘(K) Surface transportation. 18
189189 ‘‘(L) Information technology infrastruc-19
190190 ture. 20
191191 ‘‘(M) Water resources. 21
192192 ‘‘(N) Forestry. 22
193193 ‘‘(O) Any other sector as determined by 23

203203 records related to the court proceedings for any cause of 6
