2525 This Act may be cited as the ‘‘Unfunded Mandates 4

3232 The Unfunded Mandates Reform Act of 1995 (2 3
3333 U.S.C. 1501 et seq.) is amended— 4
3434 (1) by striking ‘‘tribal’’ each place that term 5
3535 appears and inserting ‘‘Tribal’’; 6
3636 (2) in section 3 (2 U.S.C. 1502)— 7
3737 (A) in paragraph (1), by striking ‘‘and’’ at 8
3838 the end; 9
3939 (B) in paragraph (2), by striking the pe-10
4040 riod at the end and inserting ‘‘and’’; and 11
4141 (C) by adding at the end the following: 12
4242 ‘‘(3) the term ‘major rule’ means a rule, as de-13

9393 NITIAL REGULATORY IMPACT ANALYSIS .— 4
9494 An initial regulatory impact analysis required under 5
9595 paragraph (1) shall— 6
9696 ‘‘(A) accompany the notice of proposed 7
9797 rulemaking with respect to the major rule that 8
9898 is the subject of the analysis; and 9
9999 ‘‘(B) be open to public comment. 10

101101 INAL REGULATORY IMPACT ANALYSIS .— 11
102102 A final regulatory impact analysis required under 12
103103 paragraph (1) shall accompany the final major rule 13
104104 that is the subject of the analysis. 14

106106 ONTENT.—Each initial and final regulatory im-15
107107 pact analysis prepared and published under subsection (b) 16
108108 shall include, with respect to the major rule that is the 17
109109 subject of the analysis— 18
110110 ‘‘(1)(A) an analysis of the anticipated benefits 19
111111 and costs of the major rule, which shall be quan-20
112112 tified to the extent feasible; 21
113113 ‘‘(B) an analysis of the benefits and costs of a 22
114114 reasonable number of regulatory alternatives within 23
115115 the range of the discretion of the agency under the 24

121121 ‘‘(i) require no action by the Federal Gov-3

123123 ‘‘(ii)(I) use incentives and market-based 5
124124 means to encourage the desired behavior; 6
125125 ‘‘(II) provide information based upon 7
126126 which the public can make choices; or 8
127127 ‘‘(III) employ other flexible regulatory op-9
128128 tions that permit the greatest flexibility in 10
129129 achieving the objectives of the statute author-11
130130 izing the major rule; and 12
131131 ‘‘(C) an explanation of how the major rule com-13
132132 plies with the requirements of section 205; 14
133133 ‘‘(2) an assessment of the extent to which— 15
134134 ‘‘(A) the costs to State, local, and Tribal 16
135135 governments may be paid with Federal financial 17
136136 assistance (or otherwise paid for by the Federal 18
137137 Government); and 19
138138 ‘‘(B) Federal resources are available to 20
139139 carry out the major rule; 21
140140 ‘‘(3) estimates of— 22
141141 ‘‘(A) any disproportionate budgetary ef-23
142142 fects of the major rule upon any particular— 24
143143 ‘‘(i) regions of the United States; 25

153153 ‘‘(B) the effect of the major rule on job 7
154154 creation or job loss, which shall be quantified to 8
155155 the extent feasible; and 9
156156 ‘‘(4)(A) a description of the extent of the prior 10
157157 consultation of the agency under section 204 with 11
158158 elected representatives of each affected State, local, 12
159159 or Tribal government; 13
160160 ‘‘(B) a summary of the comments and concerns 14
161161 that were presented to the agency orally or in writ-15
162162 ing by State, local, or Tribal governments; and 16
163163 ‘‘(C) a summary of the evaluation by the agen-17
164164 cy of the comments and concerns described in sub-18
165165 paragraph (B).’’; 19
166166 (D) in subsection (d), as so redesignated, 20
167167 by striking ‘‘a statement under subsection (a) is 21
168168 required, the agency shall include in the pro-22
169169 mulgation a summary of the information con-23
170170 tained in the statement’’ and inserting ‘‘an 24
171171 analysis under subsection (b) is required, the 25

176176 clude in the promulgation a summary of the in-2
177177 formation contained in the analysis’’; and 3
178178 (E) in subsection (e), as so redesignated, 4
179179 by striking ‘‘any statement required under sub-5
180180 section (a) in conjunction with or as a part of 6
181181 any other statement or analysis, provided that 7
182182 the statement or analysis satisfies the provi-8
183183 sions of subsection (a)’’ and inserting ‘‘any 9
184184 analysis required under subsection (b) in con-10
185185 junction with, or as a part of, any other state-11
186186 ment or analysis if the other statement or anal-12
187187 ysis satisfies the requirements of subsections 13
188188 (b) and (c)’’. 14
189189 SEC. 3. ENHANCED STAKEHOLDER CONSULTATION. 15
190190 Section 204 of the Unfunded Mandates Reform Act 16
191191 of 1995 (2 U.S.C. 1534) is amended— 17
192192 (1) in the section heading, by inserting ‘‘
193193 AND 18
194194 PRIVATE SECTOR ’’ before ‘‘INPUT’’; 19
195195 (2) in subsection (a)— 20
196196 (A) by inserting ‘‘, and impacted parties 21
197197 within the private sector (including small busi-22
198198 nesses),’’ after ‘‘on their behalf)’’; and 23

208208 UIDELINES.—For appropriate implementation 6
209209 of subsections (a) and (b) consistent with applicable laws 7
210210 and regulations, the following guidelines shall be followed: 8
211211 ‘‘(1) Consultations shall take place as early as 9
212212 possible, before issuance of a notice of proposed rule-10
213213 making, continue through the final rule stage, and 11
214214 be integrated explicitly into the rulemaking process. 12
215215 ‘‘(2) Agencies shall consult with a wide variety 13
216216 of State, local, and Tribal officials and impacted 14
217217 parties within the private sector (including small 15
218218 businesses). Geographic, political, and other factors 16
219219 that may differentiate varying points of view should 17
220220 be considered. 18
221221 ‘‘(3) Agencies should estimate benefits and 19
222222 costs to assist with these consultations. The scope of 20
223223 the consultation should reflect the cost and signifi-21
224224 cance of the Federal mandate being considered. 22
225225 ‘‘(4) Agencies shall, to the extent practicable— 23
226226 ‘‘(A) seek out the views of State, local, and 24
227227 Tribal governments, and impacted parties with-25

232232 nesses), on costs, benefits, and risks; and 2
233233 ‘‘(B) solicit ideas about alternative meth-3
234234 ods of compliance and potential flexibilities, and 4
235235 input on whether the Federal regulation will 5
236236 harmonize with and not duplicate similar laws 6
237237 in other levels of government. 7
238238 ‘‘(5) Consultations shall address the cumulative 8
239239 impact of regulations on the affected entities. 9
240240 ‘‘(6) Agencies may accept electronic submis-10
241241 sions of comments by relevant parties but may not 11
242242 use those comments as the sole method of satisfying 12
243243 the guidelines in this subsection.’’. 13
244244 SEC. 4. MAXIMIZE NET BENEFITS OR PROVIDE EXPLA-14
245245 NATION. 15
246246 Title II of the Unfunded Mandates Reform Act of 16
247247 1995 (2 U.S.C. 1531 et seq.) is amended by striking sec-17
248248 tion 205 (2 U.S.C. 1535) and inserting the following: 18
249249 ‘‘SEC. 205. MAXIMIZE NET BENEFITS. 19
250250 ‘‘(a) D
251251 EFINITION OFCOST.—In this section, the term 20
252252 ‘cost’ has the meaning given the term in section 202(a). 21
253253 ‘‘(b) R

262262 net benefits, taking into consideration only the costs and 2
263263 benefits that arise within the scope of the statutory provi-3
264264 sion that authorizes the rulemaking. 4
265265 ‘‘(c) E
266266 XCEPTIONS.—An agency may adopt an alter-5
267267 native other than as required under subsection (b) only 6
268268 if— 7
269269 ‘‘(1) the Administrator of the Office of Infor-8
270270 mation and Regulatory Affairs approves the adop-9
271271 tion by the agency of the alternative; and 10
272272 ‘‘(2) the alternative is adopted to— 11
273273 ‘‘(A) account for costs or benefits that can-12
274274 not be quantified, including costs or benefits re-13
275275 lated to constitutional or civil rights, provided 14
276276 that the agency identifies all such costs and 15
277277 benefits and explains why those costs and bene-16
278278 fits justify the adoption of the alternative; or 17
279279 ‘‘(B) achieve additional benefits or cost re-18
280280 ductions, provided that the agency— 19
281281 ‘‘(i) identifies— 20
282282 ‘‘(I) all such additional benefits 21
283283 and the associated costs of those ben-22
284284 efits; and 23

294294 ‘‘(II) the additional cost reduc-7
295295 tions justify any benefits foregone.’’. 8
296296 SEC. 5. NEW AUTHORITIES AND RESPONSIBILITIES FOR OF-9
297297 FICE OF INFORMATION AND REGULATORY 10

299299 Section 208 of the Unfunded Mandates Reform Act 12
300300 of 1995 (2 U.S.C. 1538) is amended to read as follows: 13
301301 ‘‘SEC. 208. OFFICE OF INFORMATION AND REGULATORY AF-14
302302 FAIRS RESPONSIBILITIES. 15
303303 ‘‘(a) I
304304 NGENERAL.—The Administrator of the Office 16
305305 of Information and Regulatory Affairs (in this section re-17
306306 ferred to as the ‘Administrator’) shall provide meaningful 18
307307 guidance and oversight so that the major rules of an agen-19
308308 cy for which a regulatory impact analysis is required under 20
309309 section 202— 21
310310 ‘‘(1) are consistent with the principles and re-22
311311 quirements of this title, as well as other applicable 23
312312 laws; and 24

319319 OTIFICATION.—If the Administrator deter-3
320320 mines that the major rules of an agency for which a regu-4
321321 latory impact analysis is required under section 202 do 5
322322 not comply with the principles and requirements of this 6
323323 title, are not consistent with other applicable laws, or con-7
324324 flict with the policies or actions of another agency, the 8
325325 Administrator shall— 9
326326 ‘‘(1) identify areas of noncompliance; 10
327327 ‘‘(2) notify the agency; and 11
328328 ‘‘(3) request that the agency comply before the 12
329329 agency finalizes the major rule concerned. 13
330330 ‘‘(c) A
331331 NNUALSTATEMENTS TOCONGRESS ONAGEN-14
332332 CYCOMPLIANCE.—The Administrator shall submit to 15
333333 Congress, including the Committee on Homeland Security 16
334334 and Governmental Affairs of the Senate and the Com-17
335335 mittee on Oversight and Government Reform of the House 18
336336 of Representatives, an annual written report that, for the 19
337337 1-year period preceding the report— 20
338338 ‘‘(1) details compliance by each agency with the 21
339339 requirements of this title that relate to major rules 22
340340 for which a regulatory impact analysis is required by 23
341341 section 202, including activities undertaken at the 24

349349 SEC. 6. INITIATION OF RULEMAKING. 5
350350 The Unfunded Mandates Reform Act of 1995 (2 6
351351 U.S.C. 1501 et seq.) is amended— 7
352352 (1) by redesignating section 209 (2 U.S.C. 8
353353 1531 note) as section 210; and 9
354354 (2) by inserting after section 208 (2 U.S.C. 10
355355 1548) the following: 11
356356 ‘‘SEC. 209. INITIATION OF RULEMAKING FOR MAJOR RULES. 12
357357 ‘‘When an agency determines to initiate a rulemaking 13
358358 that may result in a major rule, the agency shall— 14
359359 ‘‘(1) establish an electronic docket for that rule-15
360360 making, which may have a physical counterpart; and 16
361361 ‘‘(2) publish a notice of initiation of rulemaking 17
362362 in the Federal Register, which shall— 18
363363 ‘‘(A) briefly describe the subject and objec-19
364364 tives of, and the problem to be solved by, the 20
365365 major rule; 21
366366 ‘‘(B) refer to the legal authority under 22
367367 which the major rule would be proposed, includ-23
368368 ing the specific statutory provision that author-24
369369 izes the rulemaking; 25

379379 ‘‘(E) appear in the Federal Register not 7
380380 later than 90 days before the date on which the 8
381381 agency publishes a notice of proposed rule-9
382382 making for the major rule.’’. 10
383383 SEC. 7. INCLUSION OF APPLICATION TO INDEPENDENT 11
384384 REGULATORY AGENCIES. 12

386386 NGENERAL.—Section 421(1) of the Congres-13
387387 sional Budget Act of 1974 (2 U.S.C. 658(1)) is amended 14
388388 by striking ‘‘, but does not include independent regulatory 15
389389 agencies’’. 16

391391 XEMPTION FORMONETARYPOLICY.—The Un-17
392392 funded Mandates Reform Act of 1995 (2 U.S.C. 1501 et 18
393393 seq.) is amended by inserting after section 5 the following: 19
394394 ‘‘SEC. 6. EXEMPTION FOR MONETARY POLICY. 20
395395 ‘‘Nothing in title II, III, or IV shall apply to rules 21
396396 that concern monetary policy proposed or implemented by 22
397397 the Board of Governors of the Federal Reserve System 23
398398 or the Federal Open Market Committee.’’. 24

408408 NGENERAL.—A person that is aggrieved by 6
409409 final agency action in adopting a major rule that is subject 7
410410 to section 202 is entitled to judicial review of whether the 8
411411 agency complied with section 202(b), 202(c)(1), or 205 9
412412 with respect to the rule. 10

414414 COPE OFREVIEW.—Chapter 7 of title 5, 11
415415 United States Code, shall govern the scope of judicial re-12
416416 view under subsection (a). 13

418418 URISDICTION.—Each court that has jurisdic-14
419419 tion to review a rule for compliance with section 553 of 15
420420 title 5, United States Code, or under any other provision 16
421421 of law, shall have jurisdiction to review a claim brought 17
422422 under subsection (a). 18

424424 ELIEFAVAILABLE.—In granting relief in an 19
425425 action under this section, a court shall order the agency 20
426426 that promulgated the major rule that is under review to 21
427427 take remedial action consistent with chapter 7 of title 5, 22
