A BILL
To remove the lesser prairie-chicken from the lists of threat-
ened species and endangered species published pursuant
to the Endangered Species Act of 1973 and to amend
that Act to exclude the lesser prairie-chicken from the
authority of that Act.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. DELISTING OF LESSER PRAIRIE-CHICKEN. 3
(a) I
NGENERAL.—Notwithstanding any other provi-4
sion of law, the lesser prairie-chicken (Tympanuchus 5
pallidicinctus), including each distinct population segment 6

of the lesser prairie-chicken, is removed from the lists of 1
threatened species and endangered species that are pub-2
lished pursuant to the Endangered Species Act of 1973 3
(16 U.S.C. 1531 et seq.). 4

XCLUSION OFLESSERPRAIRIE-CHICKENFROM 5

ISTING.—Section 4(a) of the Endangered Species Act of 6
1973 (16 U.S.C. 1533(a)) is amended— 7
(1) in paragraph (1), by striking ‘‘The Sec-8
retary shall by regulation’’ and inserting ‘‘Except as 9
provided in paragraph (4), the Secretary shall by 10
regulation’’; and 11
(2) by adding at the end the following: 12
‘‘(4) A
PPLICABILITY TO LESSERPRAIRIE-CHICK-13
EN.—The Secretary may not make a determination under 14
this subsection that the lesser prairie-chicken 15
(Tympanuchus pallidicinctus) is threatened or endan-16
gered.’’. 17
