2323 SECTION 1. SHORT TITLE. 3
2424 This Act may be cited as the ‘‘Headwaters Protection 4
2525 Act of 2025’’. 5

3030 THORIZATION AND IMPROVEMENTS. 2
3131 Section 303 of the Healthy Forests Restoration Act 3
3232 of 2003 (16 U.S.C. 6542) is amended— 4
3333 (1) in subsection (a)— 5
3434 (A) in paragraph (1)— 6
3535 (i) by redesignating subparagraphs 7
3636 (G) and (H) as subparagraphs (K) and 8
3737 (L), respectively; and 9
3838 (ii) by inserting after subparagraph 10
3939 (F) the following: 11
4040 ‘‘(G) an acequia association; 12
4141 ‘‘(H) a local, regional, or other public enti-13
4242 ty that manages stormwater or wastewater re-14
4343 sources or other related water infrastructure; 15
4444 ‘‘(I) a land-grant mercedes; 16
4545 ‘‘(J) a local, regional, or other private enti-17
4646 ty that has water delivery authority;’’; 18
4747 (B) by redesignating paragraphs (1) 19
4848 through (7) as paragraphs (2) through (8), re-20
4949 spectively; and 21

7878 insect infestation and disease or wildfire; or 18
7979 ‘‘(C) advance any combination of the pur-19
8080 poses described in subparagraphs (A) and (B). 20

8282 RIORITIES.—In selecting watershed pro-21
8383 tection and restoration projects under the Program, 22
8484 the Secretary shall give priority to projects that 23

9090 sociated with drought, wildfire, post-wildfire 2
9191 conditions, extreme weather, or flooding, includ-3
9292 ing minimizing risks to watershed health, water 4
9393 supply and quality, and water-related infra-5
9494 structure, including municipal and agricultural 6
9595 water supply systems; 7
9696 ‘‘(B) be designed to support aquatic res-8
9797 toration and conservation efforts that com-9
9898 plement existing or planned forest restoration 10
9999 or wildfire risk reduction efforts; 11
100100 ‘‘(C) include— 12
101101 ‘‘(i) partners with demonstrated ca-13
102102 pacity and success in designing and imple-14
103103 menting ecological restoration projects, 15
104104 wildfire risk reduction efforts, or post-wild-16
105105 fire restoration projects; or 17
106106 ‘‘(ii) in the case of disadvantaged 18
107107 communities that have historically lacked 19
108108 access to adequate resources, partners with 20
109109 a strong likelihood of success in designing 21
110110 and implementing a watershed protection 22
111111 and restoration project; and 23
112112 ‘‘(D)(i) include a contribution of funds or 24
113113 in-kind support from non-Federal partners in 25

121121 based solutions, such as restoring wetland and 5

123123 ‘‘(iii) be designed to improve— 7
124124 ‘‘(I) resilience to climate change; or 8
125125 ‘‘(II) watershed and fire resilience; or 9
126126 ‘‘(iv) include such other characteristics as 10
127127 the Secretary determines to be appropriate. 11

129129 ONDITIONS FOR PROJECTS ON ADJACENT 12
130130 LAND.— 13
131131 ‘‘(A) I
132132 N GENERAL.—No project or activity 14
133133 may be carried out under this section on adja-15
134134 cent land unless the owner of the adjacent land 16
135135 provides express support for, and is a willing 17
136136 and engaged partner in, carrying out that 18
137137 project or activity. 19
138138 ‘‘(B) E
139139 FFECT.—Nothing in this section 20
140140 authorizes any change in— 21
141141 ‘‘(i) the ownership of adjacent land on 22
142142 which a project or activity is carried out 23
143143 under this section; or 24

206206 documents may be used as the basis for a water 5
207207 source management plan under this subsection.’’; 6
208208 (5) in subsection (e)(1), by striking ‘‘purpose 7
209209 of—’’ in the matter preceding subparagraph (A) and 8
210210 all that follows through the period at the end of sub-9
211211 paragraph (C) and inserting ‘‘purpose of advancing 10

251251 SEC. 3. WATERSHED CONDITION FRAMEWORK IMPROVE-19
252252 MENTS. 20
253253 Section 304 of the Healthy Forests Restoration Act 21
254254 of 2003 (16 U.S.C. 6543) is amended— 22

272272 is authorized to be appropriated to carry out this section 11
273273 $30,000,000 for each of fiscal years 2025 through 2029.’’. 12
274274 SEC. 4. EFFECT. 13
275275 Nothing in this Act or an amendment made by this 14
276276 Act shall be construed— 15
277277 (1) to supersede or in any manner affect or 16
278278 conflict with State water law, Federal water law, 17
279279 interstate compacts, or treaty obligations; or 18
280280 (2) to authorize any acquisition of land by the 19
281281 Federal Government or any exertion of Federal con-20
282282 trol over non-Federal land. 21
