15	15	Authorization Act of 1989 to include the City of North
16	16	Las Vegas and the Apex Industrial Park Owners Asso-
17	17	ciation, and for other purposes.
18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘Apex Area Technical 4
22	22	Corrections Act’’. 5

27	27	THORIZATION ACT OF 1989. 2
28	28	The Apex Project, Nevada Land Transfer and Au-3
29	29	thorization Act of 1989 (Public Law 101–67; 103 Stat. 4
30	30	168) is amended— 5
31	31	(1) in section 2(a), by adding at the end the 6
32	32	following: 7
33	33	‘‘(9) Nevada’s ‘boom and bust’ economic 8
34	34	timeline demonstrates a need for economic diversity 9
35	35	and stability in the Las Vegas Valley. In the year 10
36	36	2000, Nevada was the fastest growing State for 14 11
37	37	consecutive years and had increased its population 12
38	38	by 1,000,000 residents since 1980. During the reces-13
39	39	sion and mortgage crisis in 2009, Nevada was one 14
40	40	of the hardest hit States, with its population facing 15
41	41	a 20 percent increase in economic insecurity. Over 16
42	42	the following decade, the Las Vegas Valley rebuilt, 17
43	43	and by 2020, Nevada led in growth nationally. How-18
44	44	ever, in 2021, the State experienced economic hard-19
45	45	ship at higher rates due to the impact of the 20
46	46	COVID–19 pandemic on the travel and tourism in-21
47	47	dustries. 22
48	48	‘‘(10) The Apex Project has expanded to be one 23
49	49	of the most promising economic endeavors in South-24
50	50	ern Nevada, with the potential to create jobs, stimu-25
51	51	late wages, and improve the well-being of everyone 26

55	55	in the region—especially the citizens of North Las 1
56	56	Vegas, the only predominantly minority population, 2
57	57	which has been hit particularly hard by recessions 3
58	58	and the COVID–19 pandemic. 4
59	59	‘‘(11) The Apex Project has evolved since 1989, 5
60	60	but the partnership between Federal and private 6
61	61	land owners remains unwavering. The Bureau of 7
62	62	Land Management and Apex stakeholders have cre-8
63	63	ated important environmental protections and per-9
64	64	mitting procedures that are appropriate to utilize in 10
65	65	a streamlined capacity as the Apex Project continues 11
66	66	to take a new direction.’’; 12
67	67	(2) in section 2(b)— 13
68	68	(A) by redesignating paragraph (6) as 14
69	69	paragraph (8); and 15
70	70	(B) by inserting after paragraph (5) the 16
71	71	following: 17
72	72	‘‘(6) The term ‘Apex Industrial Park Owners 18
73	73	Association’ has the meaning given such term by the 19
74	74	charter document for the entity entitled ‘Apex In-20
75	75	dustrial Park Owners Association’, formed on April 21
76	76	9, 2001, and any successor documents to such char-22
77	77	ter document, on file with the Nevada Secretary of 23
78	78	State. 24

82	82	‘‘(7) The term ‘City of North Las Vegas’ means 1
83	83	North Las Vegas, Nevada.’’; 2
84	84	(3) in section 3(b)— 3
85	85	(A) by striking ‘‘Clark County for the con-4
86	86	nection’’ and inserting ‘‘Clark County, the City 5
87	87	of North Las Vegas, and the Apex Industrial 6
88	88	Park Owners Association, individually or jointly 7
89	89	as appropriate, for the connection’’; 8
90	90	(B) by striking ‘‘Kerr-McGee Site’’ and in-9
91	91	serting ‘‘Kerr-McGee Site and other lands con-10
92	92	veyed in accordance with this Act’’; and 11
93	93	(C) by inserting ‘‘(or any successor maps 12
94	94	created by the Secretary)’’ after ‘‘May 1989’’; 13
95	95	(4) in section 4(c), by striking ‘‘Pursuant’’ and 14
96	96	all that follows through ‘‘Clark County’’ and insert-15
97	97	ing ‘‘During such time as the requirements of sec-16
98	98	tion 6 are met, and pursuant to applicable law, the 17
99	99	Secretary shall grant Clark County, the City of 18
100	100	North Las Vegas, and the Apex Industrial Owners 19
101	101	Association’’; 20
102	102	(5) in section 4(e)(1), by striking the last sen-21
103	103	tence and inserting ‘‘The withdrawal made by this 22
104	104	subsection shall continue in perpetuity for all lands 23
105	105	transferred in accordance with this subsection.’’; 24

109	109	(6) in section 4(e), by adding at the end the fol-1
110	110	lowing: 2
111	111	‘‘(3) In the case of the sale of mineral materials re-3
112	112	sulting from grading, land balancing, or other activities 4
113	113	on the surface of a parcel within the Apex Site for which 5
114	114	the United States retains and interest in the minerals— 6
115	115	‘‘(A) it shall be considered impracticable to ob-7
116	116	tain competition for purposes of section 8
117	117	3602.31(a)(2) of title 43, Code of Federal Regula-9
118	118	tions (as in effect on the date of the enactment of 10
119	119	the Apex Area Technical Corrections Act); and 11
120	120	‘‘(B) such sale shall be exempt from the quan-12
121	121	tity and term limitations imposed on noncompetitive 13
122	122	sales under subpart 3602 of such title (as in effect 14
123	123	on the date of the enactment of the Apex Area Tech-15
124	124	nical Corrections Act.’’; and 16
125	125	(7) in section 6, by adding at the end the fol-17
126	126	lowing: 18

128	128	OMPLIANCEWITHENVIRONMENTAL ASSESS-19
129	129	MENTS.—Each transfer by the United States of additional 20
130	130	lands or interests in lands within the Apex Site or rights- 21
131	131	of-way issued pursuant to this Act shall be conditioned 22
132	132	upon compliance with applicable Federal land laws, includ-23
