SHORT TITLE. 1 This Act may be cited as the ‘‘Foreign Adversary 2 Risk Management Act’’ or the ‘‘FARM Act’’. 3 SEC. 2. UNITED STATES AGRICULTURE INCLUDED IN COM-4 MITTEE ON FOREIGN INVESTMENT IN THE 5 UNITED STATES. 6 (a) A GRICULTURE REPRESENTATIVE.—Section 7 721(k)(2) of the Defense Production Act of 1950 (50 8 U.S.C. 4565(k)(2)) is amended— 9 (1) by redesignating subparagraphs (H), (I), 10 and (J) as subparagraphs (I), (J), and (K), respec-11 tively; and 12 (2) by inserting after subparagraph (G) the fol-13 lowing: 14 ‘‘(H) The Secretary of Agriculture.’’. 15 (b) R EVIEW OFAGRICULTUREINVESTMENTS BY 16 F OREIGNENTITIES.—Section 721(a)(4) of the Defense 17 Production Act of 1950 (50 U.S.C. 4565(a)(4)) is amend-18 ed— 19 (1) in subparagraph (A)— 20 (A) in clause (i), by striking ‘‘; and’’ and 21 inserting a semicolon; 22 (B) in clause (ii), by striking the period at 23 the end and inserting ‘‘; and’’; and 24 (C) by adding at the end the following: 25 VerDate Sep 11 2014 00:17 Feb 19, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H620.IH H620 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 620 IH ‘‘(iii) any transaction described in 1 subparagraph (B)(vi) that is proposed, 2 pending, or completed on or after the date 3 of the enactment of the Foreign Adversary 4 Risk Management Act.’’; and 5 (2) in subparagraph (B), by adding at the end 6 the following: 7 ‘‘(vi) Any transaction, merger, acqui-8 sition, transfer, agreement, takeover, or 9 other arrangement that could result in for-10 eign control of any United States business 11 that is engaged in agriculture and uses ag-12 ricultural products (as defined in the first 13 section of the Act of July 2, 1926 (44 14 Stat. 802, chapter 725; 7 U.S.C. 451)).’’. 15 (c) A GRICULTURALSUPPLYCHAINSINCLUDED IN 16 C RITICALINFRASTRUCTURE.—Section 721(a)(5) of the 17 Defense Production Act of 1950 (50 U.S.C. 4565(a)(5)) 18 is amended— 19 (1) by striking ‘‘‘critical infrastructure’ means’’ 20 and inserting the following: ‘‘‘critical infrastruc-21 ture’— 22 ‘‘(i) means’’; 23 (2) by striking the period at the end and insert-24 ing ‘‘; and’’; and 25 VerDate Sep 11 2014 00:17 Feb 19, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H620.IH H620 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 620 IH (3) by adding at the end the following: 1 ‘‘(ii) includes, subject to regulations 2 prescribed by the Committee, agricultural 3 systems and supply chains.’’. 4 (d) A GRICULTURALSUPPLYCHAINSINCLUDED AS 5 C RITICALTECHNOLOGIES.—Section 721(a)(6)(A) of the 6 Defense Production Act of 1950 (50 U.S.C. 7 4565(a)(6)(A)) is amended by adding at the end the fol-8 lowing: 9 ‘‘(vii) Agricultural supply chains used 10 for agricultural products (as defined in the 11 first section of the Act of July 2, 1926 (44 12 Stat. 802, chapter 725; 7 U.S.C. 451)).’’. 13 SEC. 3.
