21	21	To amend title 18, United States Code, to prohibit chemical
22	22	abortions, and for other purposes.
23	23	Be it enacted by the Senate and House of Representa-1
24	24	tives of the United States of America in Congress assembled, 2
25	25	SECTION 1. SHORT TITLE. 3
26	26	This Act may be cited as the ‘‘Ending Chemical 4
27	27	Abortions Act of 2025’’. 5
28	28	SEC. 2. FINDINGS. 6
29	29	Congress finds the following: 7

33	33	(1) In 2000, the Food and Drug Administra-1
34	34	tion approved chemical abortion drugs for use in the 2
35	35	United States. The agency illegally categorized preg-3
36	36	nancy as an illness and asserted chemical abortion 4
37	37	drugs provide a meaningful therapeutic benefit. 5
38	38	(2) In 2016, the Food and Drug Administra-6
39	39	tion reduced the number of doctor visits required for 7
40	40	administration of chemical abortion drugs from 3 8
41	41	visits to 1 visit. The agency also removed the re-9
42	42	quirement for both the in-person administration of 10
43	43	misoprostol and a subsequent follow-up appointment. 11
44	44	At this time, the agency also expanded the avail-12
45	45	ability of inducing a chemical abortion from 7 to 10 13
46	46	weeks. 14
47	47	(3) In 2021, the Food and Drug Administra-15
48	48	tion eliminated the in-person dispensing requirement 16
49	49	for chemical abortion drugs, purporting to allow 17
50	50	these drugs to be dispensed by mail in violation of 18
51	51	longstanding Federal law. 19
52	52	(4) When compared to surgical abortions, chem-20
53	53	ical abortions are consistently more likely to result 21
54	54	in complications that are miscoded as a spontaneous 22
55	55	abortion or ‘‘miscarriage’’. 23
56	56	(5) According to the Guttmacher Institute, the 24
57	57	Abortion Industry’s think tank, since 2000, the ad-25

61	61	ministration of mifepristone and misoprostol has 1
62	62	grown to comprise over 50 percent of all induced 2
63	63	abortions in the United States. 3
64	64	(6) There is a four times higher risk of experi-4
65	65	encing complications due to a chemical abortion than 5
66	66	a surgical abortion. 6
67	67	SEC. 3. RENAMING CHAPTER 74 OF TITLE 18, UNITED 7
68	68	STATES CODE. 8
69	69	The table of chapters for part I of title 18, United 9
70	70	States Code, is amended by striking the item related to 10
71	71	chapter 74 and inserting the following: 11
72	72	‘‘74. Abortion crimes.’’.
73	73	SEC. 4. CHEMICAL ABORTIONS PROHIBITED.

76	76	NGENERAL.—Chapter 74 of title 18, United 13
77	77	States Code, is amended by inserting after section 1531 14
78	78	the following: 15
79	79	‘‘§ 1532. Chemical abortions 16
80	80	‘‘(a) P
81	81	ROHIBITION.—Notwithstanding any other pro-17
82	82	vision of law, whoever prescribes, dispenses, distributes, 18
83	83	or sells, any drug, medication, or chemical for the purpose 19
84	84	of procuring or performing an abortion on any woman, 20
85	85	shall be imprisoned for not more than 25 years, fined 21
86	86	under this title, or both. 22
87	87	‘‘(b) E
88	88	XCEPTIONS.—Subsection (a) shall not apply to 23
89	89	any of the following: 24

93	93	‘‘(1) The sale, use, prescription or administra-1
94	94	tion of any contraceptive agent administered before 2
95	95	conception or before pregnancy can be confirmed 3
96	96	through conventional testing. 4
97	97	‘‘(2) The treatment of a miscarriage according 5
98	98	to medical guidelines as accepted as of the date of 6
99	99	the miscarriage. 7
100	100	‘‘(3) In the case where a woman suffers from 8
101	101	a physical disorder, physical injury, or physical ill-9
102	102	ness, including a life-endangering physical condition 10
103	103	caused by or arising from the pregnancy itself, that 11
104	104	would, as certified by a physician, place the woman 12
105	105	in danger of death. 13
106	106	‘‘(c) B
107	107	AR TOPROSECUTION.—A woman upon whom 14
108	108	a chemical abortion is performed or attempted may not 15
109	109	be criminally prosecuted under this section. 16
110	110	‘‘(d) D
111	111	EFINITIONS.—In this section: 17
112	112	‘‘(1) A
113	113	BORTION.—The term ‘abortion’ means 18
114	114	intentionally terminating the pregnancy of a woman 19
115	115	known to be pregnant, with an intention other 20
116	116	than— 21
117	117	‘‘(A) to produce a live birth; 22
118	118	‘‘(B) to remove a dead unborn child caused 23
119	119	by miscarriage; or 24

126	126	REGNANT; PREGNANCY.—The term ‘preg-3
127	127	nant’ or ‘pregnancy’ refers to the human female re-4
128	128	productive condition of having a living unborn child 5
129	129	within her body throughout the entire embryonic and 6
130	130	fetal stages from fertilization to full gestation and 7
131	131	childbirth. 8
132	132	‘‘(3) U
133	133	NBORN CHILD.—The term ‘unborn child’ 9
134	134	means an individual organism of the species homo 10
135	135	sapiens, beginning at fertilization, until the point of 11
136	136	being born alive as defined in section 8(b) of title 1, 12
137	137	United States Code.’’. 13

139	139	LERICALAMENDMENT.—The table of sections 14
140	140	for chapter 74 of title 18, United States Code, is amended 15
141	141	by inserting after the item relating to section 1531 the 16
