2424 tives of the United States of America in Congress assembled, 2
2525 SECTION 1. SHORT TITLE. 3
2626 This Act may be cited as the ‘‘Ending Chemical 4
2727 Abortions Act of 2025’’. 5
2828 SEC. 2. FINDINGS. 6
2929 Congress finds the following: 7

3333 (1) In 2000, the Food and Drug Administra-1
3434 tion approved chemical abortion drugs for use in the 2
3535 United States. The agency illegally categorized preg-3
3636 nancy as an illness and asserted chemical abortion 4
3737 drugs provide a meaningful therapeutic benefit. 5
3838 (2) In 2016, the Food and Drug Administra-6
3939 tion reduced the number of doctor visits required for 7
4040 administration of chemical abortion drugs from 3 8
4141 visits to 1 visit. The agency also removed the re-9
4242 quirement for both the in-person administration of 10
4343 misoprostol and a subsequent follow-up appointment. 11
4444 At this time, the agency also expanded the avail-12
4545 ability of inducing a chemical abortion from 7 to 10 13
4646 weeks. 14
4747 (3) In 2021, the Food and Drug Administra-15
4848 tion eliminated the in-person dispensing requirement 16
4949 for chemical abortion drugs, purporting to allow 17
5050 these drugs to be dispensed by mail in violation of 18
5151 longstanding Federal law. 19
5252 (4) When compared to surgical abortions, chem-20
5353 ical abortions are consistently more likely to result 21
5454 in complications that are miscoded as a spontaneous 22
5555 abortion or ‘‘miscarriage’’. 23
5656 (5) According to the Guttmacher Institute, the 24
5757 Abortion Industry’s think tank, since 2000, the ad-25

6262 grown to comprise over 50 percent of all induced 2
6363 abortions in the United States. 3
6464 (6) There is a four times higher risk of experi-4
6565 encing complications due to a chemical abortion than 5
6666 a surgical abortion. 6
6767 SEC. 3. RENAMING CHAPTER 74 OF TITLE 18, UNITED 7
6868 STATES CODE. 8
6969 The table of chapters for part I of title 18, United 9
7070 States Code, is amended by striking the item related to 10
7171 chapter 74 and inserting the following: 11
7272 ‘‘74. Abortion crimes.’’.
7373 SEC. 4. CHEMICAL ABORTIONS PROHIBITED.

7676 NGENERAL.—Chapter 74 of title 18, United 13
7777 States Code, is amended by inserting after section 1531 14
7878 the following: 15
7979 ‘‘§ 1532. Chemical abortions 16
8080 ‘‘(a) P
8181 ROHIBITION.—Notwithstanding any other pro-17
8282 vision of law, whoever prescribes, dispenses, distributes, 18
8383 or sells, any drug, medication, or chemical for the purpose 19
8484 of procuring or performing an abortion on any woman, 20
8585 shall be imprisoned for not more than 25 years, fined 21
8686 under this title, or both. 22
8787 ‘‘(b) E
8888 XCEPTIONS.—Subsection (a) shall not apply to 23
8989 any of the following: 24

9393 ‘‘(1) The sale, use, prescription or administra-1
9494 tion of any contraceptive agent administered before 2
9595 conception or before pregnancy can be confirmed 3
9696 through conventional testing. 4
9797 ‘‘(2) The treatment of a miscarriage according 5
9898 to medical guidelines as accepted as of the date of 6
9999 the miscarriage. 7
100100 ‘‘(3) In the case where a woman suffers from 8
101101 a physical disorder, physical injury, or physical ill-9
102102 ness, including a life-endangering physical condition 10
103103 caused by or arising from the pregnancy itself, that 11
104104 would, as certified by a physician, place the woman 12
105105 in danger of death. 13
106106 ‘‘(c) B
107107 AR TOPROSECUTION.—A woman upon whom 14
108108 a chemical abortion is performed or attempted may not 15
109109 be criminally prosecuted under this section. 16
110110 ‘‘(d) D
111111 EFINITIONS.—In this section: 17
112112 ‘‘(1) A
113113 BORTION.—The term ‘abortion’ means 18
114114 intentionally terminating the pregnancy of a woman 19
115115 known to be pregnant, with an intention other 20
116116 than— 21
117117 ‘‘(A) to produce a live birth; 22
118118 ‘‘(B) to remove a dead unborn child caused 23
119119 by miscarriage; or 24

126126 REGNANT; PREGNANCY.—The term ‘preg-3
127127 nant’ or ‘pregnancy’ refers to the human female re-4
128128 productive condition of having a living unborn child 5
129129 within her body throughout the entire embryonic and 6
130130 fetal stages from fertilization to full gestation and 7
131131 childbirth. 8
132132 ‘‘(3) U
133133 NBORN CHILD.—The term ‘unborn child’ 9
134134 means an individual organism of the species homo 10
135135 sapiens, beginning at fertilization, until the point of 11
136136 being born alive as defined in section 8(b) of title 1, 12
137137 United States Code.’’. 13

139139 LERICALAMENDMENT.—The table of sections 14
140140 for chapter 74 of title 18, United States Code, is amended 15
141141 by inserting after the item relating to section 1531 the 16
142142 following: 17
