To amend the Omnibus Public Land Management Act of
2009 to increase Tribal access to water conservation
and efficiency grants, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘WaterSMART Access 4
for Tribes Act’’. 5

SEC. 2. WATER MANAGEMENT IMPROVEMENT. 1
Section 9504(a)(3)(E)(i) of the Omnibus Public 2
Land Management Act of 2009 (42 U.S.C. 3
10364(a)(3)(E)(i)) is amended— 4
(1) in subclause (I), by striking ‘‘subclause 5
(II)’’ and inserting ‘‘subclauses (II) and (III)’’; and 6
(2) after subclause (II), by inserting the fol-7
lowing: 8
‘‘(III) W
AIVER; REDUCTION.— 9
With respect to a grant or other 10
agreement entered into under para-11
graph (1) between the Secretary and 12
an Indian Tribe, the Secretary may 13
reduce or waive the non-Federal share 14
(and increase the Federal share ac-15
cordingly) of the cost of any infra-16
structure improvement or activity that 17
is the subject of that grant or other 18
agreement if the Secretary determines 19
that contribution of the non-Federal 20
share would result in a financial hard-21
ship for the Indian Tribe.’’. 22
