34 | 34 | | not issue a rule unless such agency has repealed ten 4 |

35 | 35 | | or more rules described in paragraph (4) that, to the 5 |

36 | 36 | | extent practicable, are related to the rule. 6 |

38 | 38 | | EQUIREMENT FOR MAJOR RULE .— 7 |

40 | 40 | | EPEAL REQUIRED.—An agency may 8 |
---|
41 | 41 | | not issue a major rule unless— 9 |
---|
42 | 42 | | (i) such agency has repealed ten or 10 |
---|
43 | 43 | | more rules described in paragraph (4) 11 |
---|
44 | 44 | | that, to the extent practicable, are related 12 |
---|
45 | 45 | | to the major rule; and 13 |
---|
46 | 46 | | (ii) the cost of the new major rule is 14 |
---|
47 | 47 | | less than or equal to the cost of the rules 15 |
---|
48 | 48 | | repealed. 16 |

50 | 50 | | ERTIFIED COST.—For any rule 17 |
---|
51 | 51 | | issued in accordance with subparagraph (A), 18 |
---|
52 | 52 | | the Administrator of the Office of Information 19 |

53 | 53 | | and Regulatory Affairs of the Office of Manage-20 |
---|
54 | 54 | | ment and Budget must have certified that the 21 |
---|
55 | 55 | | cost of the new major rule is equal to or less 22 |
---|
56 | 56 | | that the cost of the rules repealed. 23 |

58 | 58 | | UBLICATION REQUIRED .—Any rule re-24 |
---|
59 | 59 | | pealed under paragraph (1) or (2) shall be published 25 |

79 | 79 | | than 90 days after the date of the enactment of this 15 |

80 | 80 | | Act, the head of each agency shall submit to Con-16 |

81 | 81 | | gress and the Director of the Office of Management 17 |
---|
82 | 82 | | and Budget a report that includes a review of each 18 |
---|
83 | 83 | | rule of the agency that identifies whether that rule 19 |
---|
84 | 84 | | is costly, ineffective, duplicative, or outdated, includ-20 |
---|
85 | 85 | | ing a list of any other unnecessary regulatory re-21 |
---|
86 | 86 | | striction of the agency that is costly, ineffective, du-22 |
---|
87 | 87 | | plicative, or outdated. 23 |
