2424 SECTION 1. SHORT TITLE. 3
2525 This Act may be cited as the ‘‘Regulation Decimation 4
2626 Act’’. 5

3030 SEC. 2. REPEAL OF REGULATIONS REQUIRED BEFORE 1
3131 ISSUANCE OF A NEW RULE. 2
3232 (1) R
3333 EQUIREMENT FOR RULE .—An agency may 3
3434 not issue a rule unless such agency has repealed ten 4
3535 or more rules described in paragraph (4) that, to the 5
3636 extent practicable, are related to the rule. 6

3838 EQUIREMENT FOR MAJOR RULE .— 7
3939 (A) R
4040 EPEAL REQUIRED.—An agency may 8
4141 not issue a major rule unless— 9
4242 (i) such agency has repealed ten or 10
4343 more rules described in paragraph (4) 11
4444 that, to the extent practicable, are related 12
4545 to the major rule; and 13
4646 (ii) the cost of the new major rule is 14
4747 less than or equal to the cost of the rules 15
4848 repealed. 16

5050 ERTIFIED COST.—For any rule 17
5151 issued in accordance with subparagraph (A), 18
5252 the Administrator of the Office of Information 19
5353 and Regulatory Affairs of the Office of Manage-20
5454 ment and Budget must have certified that the 21
5555 cost of the new major rule is equal to or less 22
5656 that the cost of the rules repealed. 23

5858 UBLICATION REQUIRED .—Any rule re-24
5959 pealed under paragraph (1) or (2) shall be published 25
6060 in the Federal Register. 26

6464 (4) APPLICABILITY.—This section— 1
6565 (A) applies to any rule or major rule that 2
6666 imposes a cost or responsibility on a nongovern-3
6767 mental person or a State or local government; 4
6868 and 5
6969 (B) shall not apply to any rule or major 6
7070 rule— 7
7171 (i) that relates to the internal policy 8
7272 or practice of an agency or procurement by 9
7373 the agency; or 10
7474 (ii) that is being revised to be less 11
7575 burdensome to decrease requirements im-12
7676 posed by the rule or cost of compliance. 13

7878 EVIEW OF AGENCY RULES .—Not later 14
7979 than 90 days after the date of the enactment of this 15
8080 Act, the head of each agency shall submit to Con-16
8181 gress and the Director of the Office of Management 17
8282 and Budget a report that includes a review of each 18
8383 rule of the agency that identifies whether that rule 19
8484 is costly, ineffective, duplicative, or outdated, includ-20
8585 ing a list of any other unnecessary regulatory re-21
8686 striction of the agency that is costly, ineffective, du-22
8787 plicative, or outdated. 23

8989 EPORT ON RULES .—Not later than 5 24
9090 years after the date of the enactment of this Act, the 25

100100 GENCY.—The term ‘‘agency’’ has the 5
101101 meaning given that term in section 551 of title 6
102102 5, United States Code. 7

104104 AJOR RULE.—The term ‘‘major rule’’ 8
105105 has the meaning given that term in section 804 9
106106 of title 5, United States Code. 10

108108 ULE.—The term ‘‘rule’’ has the 11
109109 meaning given that term in section 551 of title 12
110110 5, United States Code. 13
111111 (D) S
112112 TATE.—The term ‘‘State’’ means 14
113113 each of the several States, the District of Co-15
114114 lumbia, each territory or possession of the 16
115115 United States, and each federally recognized In-17
116116 dian Tribe. 18
