To amend the Help America Vote Act of 2002 to prohibit
a State from receiving or using funds or certain dona-
tions from private entities for the administration of an
election for Federal office, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Protect American Elec-4
tion Administration Act of 2025’’. 5

SEC. 2. PROHIBITION AGAINST THE RECEIPT OR USE OF 1
FUNDS OR CERTAIN DONATIONS FROM PRI-2

(a) R
EQUIREMENTS.—Title III of the Help America 4
Vote Act of 2002 (52 U.S.C. 21081 et seq.) is amended— 5
(1) by redesignating sections 305 and 306 as 6
sections 306 and 307, respectively; and 7
(2) by inserting after section 304 the following 8
new section: 9
‘‘SEC. 305. PROHIBITION AGAINST THE RECEIPT OR USE OF 10
FUNDS OR CERTAIN DONATIONS FROM PRI-11
VATE ENTITIES FOR ELECTION ADMINISTRA-12
TION. 13
‘‘(a) I
NGENERAL.—A State may not solicit, receive, 14
or expend any payment or donation of funds, property, 15
or personal services from a private entity for the purpose 16
of the administration of an election for Federal office, in-17
cluding any programs with respect to voter education, 18
voter outreach, and voter registration. 19
‘‘(b) E
XCEPTION.—This section shall not apply with 20
respect to the acceptance and use by a State of a donation 21
from a private entity of space to be used for a polling place 22
or an early voting site in the State.’’. 23

FORCEMENT.—Section 401 of the Help America Vote Act 25

of 2002 (52 U.S.C. 21111) is amended by striking ‘‘303, 1
and 304’’ and inserting ‘‘303, 304, and 305’’. 2
(c) C
LERICALAMENDMENT.—The table of contents 3
of such Act is amended— 4
(1) by redesignating the items relating to sec-5
tions 305 and 306 as relating to sections 306 and 6
307, respectively; and 7
(2) by inserting after the item relating to sec-8
tion 304 the following new item: 9
‘‘Sec. 305. Prohibition against the receipt or use of funds or certain donations
from private entities for election administration.’’.
(d) EFFECTIVEDATE.—The amendment made by 10
this section shall apply with respect to any election for 11
Federal office held after the date of the enactment of this 12
Act. 13
