19	19	Be it enacted by the Senate and House of Representa-1
20	20	tives of the United States of America in Congress assembled, 2
21	21	SECTION 1. SHORT TITLE. 3
22	22	This Act may be cited as the ‘‘Teleabortion Preven-4
23	23	tion Act of 2025’’. 5

28	28	HEALTHCARE PROVIDER PRESENT. 2

32	32	HYSICIANPRESENT.—Chapter 74 of title 18, United 4
33	33	States Code, is amended— 5
34	34	(1) in the chapter heading by striking ‘‘PAR-6
35	35	TIAL-BIRTH’’; and 7
36	36	(2) by inserting after section 1531 the fol-8
37	37	lowing: 9
38	38	‘‘§ 1532. Chemical abortions prohibited without a 10
39	39	healthcare provider physically present 11
40	40	‘‘(a) O
41	41	FFENSE.—Any healthcare provider who, in or 12
42	42	affecting interstate or foreign commerce, who knowingly 13
43	43	provides or attempts to provide a chemical abortion— 14
44	44	‘‘(1) without physically examining the patient; 15
45	45	‘‘(2) without being physically present at the lo-16
46	46	cation of the chemical abortion; and 17
47	47	‘‘(3) without scheduling a follow-up visit for the 18
48	48	patient to occur not more than 14 days after the ad-19
49	49	ministration or use of the drug to assess the pa-20
50	50	tient’s physical condition, 21
51	51	shall be fined not more than $1,000 or imprisoned not 22
52	52	more than 2 years, or both. This subsection does not apply 23
53	53	to a chemical abortion that is necessary to save the life 24
54	54	of a mother whose life is endangered by a physical dis-25
55	55	order, physical illness, or physical injury, including a life- 26

59	59	endangering physical condition caused by or arising from 1
60	60	the pregnancy itself. 2
61	61	‘‘(b) N
62	62	OLIABILITY OF THE PATIENT.—A patient 3
63	63	upon whom an abortion is performed may not be pros-4
64	64	ecuted under this section or for a conspiracy to violate 5
65	65	this section. 6
66	66	‘‘(c) D
67	67	EFINITIONS.—In this section: 7
68	68	‘‘(1) A
69	69	BORTION DRUG.—The term ‘abortion 8
70	70	drug’ means any medicine, drug or any other sub-9
71	71	stance, or any combination of drugs, medicines or 10
72	72	substances, when it is used— 11
73	73	‘‘(A) to intentionally kill the unborn child 12
74	74	of a woman known to be pregnant; or 13
75	75	‘‘(B) to intentionally terminate the preg-14
76	76	nancy of a woman known to be pregnant, with 15
77	77	an intention other than— 16
78	78	‘‘(i) to produce a live birth; or 17
79	79	‘‘(ii) to remove a dead unborn child. 18

81	81	TTEMPTS TO PROVIDE .—In this section, 19
82	82	the term ‘attempts to provide’, means conduct that, 20
83	83	under the circumstances as the actor believes them 21
84	84	to be, constitutes a substantial step in a course of 22
85	85	conduct planned to culminate in a chemical abortion. 23
86	86	‘‘(3) H
87	87	EALTHCARE PROVIDER .—The term 24
88	88	‘healthcare provider’ means any person licensed to 25

92	92	prescribe prescription drugs under applicable Fed-1
93	93	eral and State laws. 2
94	94	‘‘(4) P
95	95	ROVIDE.—In this section, the term ‘pro-3
96	96	vide’, means to dispense or prescribe an abortion 4
97	97	drug, or to otherwise make an abortion drug avail-5
98	98	able to a patient. 6
99	99	‘‘(5) C
100	100	HEMICAL ABORTION .—The term ‘chem-7
101	101	ical abortion’ refers to the use of an abortion drug 8
102	102	to— 9
103	103	‘‘(A) intentionally kill the unborn child of 10
104	104	a woman known to be pregnant; or 11
105	105	‘‘(B) intentionally terminate the pregnancy 12
106	106	of a woman known to be pregnant, with an in-13
107	107	tention other than— 14
108	108	‘‘(i) to produce a live birth; or 15
109	109	‘‘(ii) to remove a dead unborn child. 16
110	110	‘‘(6) U
111	111	NBORN CHILD.—The term ‘unborn child’ 17
112	112	means an individual organism of the species homo 18
113	113	sapiens, beginning at fertilization, until the point of 19
114	114	being born alive as defined in section 8(b). 20

116	116	ULE OFCONSTRUCTIONREGARDINGECTOPIC 21

118	118	REGNANCY.—Nothing in this section shall be construed 22
119	119	to have any impact on the treatment of a verified ectopic 23
120	120	pregnancy. 24

124	124	‘‘(e) SEVERABILITY.—If any provision of this section 1
125	125	or the application of such provision to any person or cir-2
126	126	cumstance is held to be invalid, the remainder of this sec-3
127	127	tion and the application of the provisions of the remainder 4
128	128	to any person or circumstance shall not be affected there-5
129	129	by.’’. 6
