To amend the Food and Nutrition Act of 2008 with respect
to the issuance of quality control guidance issued by
the Secretary of Agriculture.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. PUBLIC COMMENT ON QUALITY CONTROL 3
GUIDANCE. 4
Section 16(c) of the Food and Nutrition Act of 2008 5
(7 U.S.C. 2025(c)) is amended by adding at the end the 6
following: 7

‘‘(A) IN GENERAL.—The Secretary shall 1
provide notice and make available for public 2
comment for a period of not fewer than 60 days 3
any new or updated guidance proposing sub-4
stantive changes for conducting quality control 5
reviews prior to any such guidance being final-6
ized. 7
‘‘(B) S
COPE.—The requirement in (A) 8
shall be applicable to any proposed guidance 9
reasonably expected to require state agencies to 10
make changes to systems, procedures, or staff-11
ing pertaining to quality control reviews or that 12
impact verification requirements for supple-13
mental nutrition assistance program recipients. 14
‘‘(C) E
XCEPTION.—In the case of an ur-15
gent and immediate need, the Secretary may 16
issue interim final guidance simultaneous with 17
the notice and comment requirements required 18
in (A).’’. 19
