3434 NGENERAL.—Section 324 of the Robert T. 2
3535 Stafford Disaster Relief and Emergency Assistance Act 3
3636 (42 U.S.C. 5165b) is amended— 4
3737 (1) in subsection (b)(2)— 5
3838 (A) by redesignating subparagraphs (A) 6
3939 and (B) as clauses (i) and (ii), respectively, and 7
4040 adjusting the margins accordingly; and 8
4141 (B) in the matter preceding clause (i), as 9
4242 so redesignated, by striking ‘‘provide the fol-10
4343 lowing percentage rates’’ and inserting ‘‘pro-11
4444 vide— 12
4545 ‘‘(A) excess funds for management costs as 13
4646 described in subsection (c); and 14
4747 ‘‘(B) the following percentage rates’’; 15
4848 (2) by redesignating subsection (c) as sub-16
4949 section (d); and 17

5757 EFINITION.—In this subsection, the term 22
5858 ‘excess funds for management costs’ means the dif-23

6464 management costs authorized under subsection 2
6565 (b)(1) and subsection (b)(2)(B); and 3

6767 award is closed, the amount of funding for 5
6868 management costs activities expended by the 6
6969 grantee or subgrantee receiving the financial as-7
7070 sistance for costs described in subparagraph 8

7373 VAILABILITY OF EXCESS FUNDS FOR 10
7474 MANAGEMENT COSTS .—The President may make 11
7575 available to a grantee or subgrantee receiving finan-12
7676 cial assistance under section 403, 404, 406, 407, or 13
7777 502 any excess funds for management costs. 14
7878 ‘‘(3) U
7979 SE OF FUNDS.—Excess funds for man-15
8080 agement costs made available to a grantee or sub-16
8181 grantee under paragraph (2) may be used for— 17
8282 ‘‘(A) activities associated with building ca-18
8383 pacity to prepare for, recover from, or mitigate 19
8484 the impacts of a major disaster or emergency 20
8585 declared under section 401 or 501, respectively; 21
8686 and 22
8787 ‘‘(B) management costs associated with 23
8888 any— 24
8989 ‘‘(i) major disaster; 25

100100 VAILABILITY.—Excess funds for manage-7
101101 ment costs made available to a grantee or sub-8
102102 grantee under paragraph (2) shall remain available 9
103103 to the grantee or subgrantee until the date that is 10
104104 5 years after the date on which the excess funds for 11
105105 management costs are made available under para-12
106106 graph (2).’’. 13

108108 PPLICABILITY.—The amendments made by sub-14
109109 section (a) shall apply with respect to any grant award 15
110110 in relation to a major disaster or emergency declared 16
111111 under section 401 or 501, respectively, of the Robert T. 17
112112 Stafford Disaster Relief and Emergency Assistance Act 18
113113 (42 U.S.C. 5170, 5191)— 19
114114 (1) the declaration of which is made on or after 20
115115 the date of enactment of this Act; and 21
116116 (2) that is funded with amounts appropriated 22
117117 on or after the date of enactment of this Act. 23

119119 TUDY.—Not later than 180 days after the 24
120120 date of enactment of this Act, the Comptroller General 25

126126 ate and the Committee on Transportation and Infrastruc-3
127127 ture of the House of Representatives a report— 4
128128 (1) on the actual management costs described 5
129129 in section 324 of the Robert T. Stafford Disaster 6
130130 Relief and Emergency Assistance Act (42 U.S.C. 7
131131 5165b) during the period of a major disaster dec-8
132132 laration under section 401 of such Act (42 U.S.C. 9
133133 5170) to determine whether the amount set aside for 10
134134 those management costs after the date of enactment 11
135135 of this Act is appropriate; and 12
136136 (2) that includes the management costs de-13
137137 scribed in section 324 of the Robert T. Stafford Dis-14
138138 aster Relief and Emergency Assistance Act (42 15
139139 U.S.C. 5165b) for each disaster declared under dur-16
140140 ing the period of a major disaster declaration under 17
141141 section 401 of such Act (42 U.S.C. 5170) during the 18
142142 5-year period preceding the date of the report, the 19
143143 amount set aside for those management costs, the 20
144144 use of those management costs, the length of each 21
145145 disaster, and the reason for the length of each dis-22
146146 aster. 23
