37	37	SECTION 1. SHORT TITLE; PURPOSES. 1
38	38	(a) S
39	39	HORTTITLE.—This Act may be cited as the 2
40	40	‘‘Federal Firefighters Families First Act’’. 3
41	41	(b) P
42	42	URPOSES.—The purposes of this Act are— 4
43	43	(1) to improve pay equality between Federal 5
44	44	firefighters, other Federal employees, and municipal 6
45	45	and other public sector firefighters; 7
46	46	(2) to enhance recruitment and retention of 8
47	47	firefighters in order to maintain the highest quality 9
48	48	of Federal fire service; 10
49	49	(3) to include the pay of all regularly reoccur-11
50	50	ring scheduled hours during the firefighter workweek 12
51	51	when computing such retirement benefits of fire-13
52	52	fighters; and 14
53	53	(4) to establish the regular workweek for Fed-15
54	54	eral firefighters. 16
55	55	SEC. 2. COMPUTATION OF PAY. 17
56	56	Sections 5545b(b)(1)(A) and 5545b(c)(1)(B) of title 18
57	57	5, United States Code, are amended by striking ‘‘2756’’ 19
58	58	and inserting ‘‘2087’’. 20
59	59	SEC. 3. COMPUTATION OF ANNUITY BASED ON CERTAIN 21
60	60	FIREFIGHTER SERVICE. 22
61	61	(a) I
62	62	NGENERAL.—Section 5545b of title 5, United 23
63	63	States Code, as amended by section 2, is further amended 24
64	64	by adding at the end the following: 25

68	68	‘‘(e) For purposes of any determination of ‘average 1
69	69	pay’ under section 8331(4) or 8401(3), in the case of a 2
70	70	firefighter who is subject to subsection (b), the rate of 3
71	71	basic pay in effect for such firefighter for a year of cred-4
72	72	itable service (or, in the case of an annuity under sub-5
73	73	section (d) or (e)(1) of section 8341 or under chapter 84 6
74	74	based on less than 3 years of creditable service, for any 7
75	75	other period of creditable service) shall, in addition to the 8
76	76	amount determined under subsection (b) for such year (or 9
77	77	other period), include an amount equal to one-half the 10
78	78	firefighter’s basic hourly rate (as computed under sub-11
79	79	section (b)(1)(A)) for such year (or other period) times 12
80	80	the number of overtime hours included as part of such 13
81	81	firefighter’s regular tour of duty during such year (or 14
82	82	other period).’’. 15

84	84	ONFORMINGAMENDMENTS.—Sections 8331(4) 16
85	85	and 8401(3) of title 5, United States Code, are amended 17
86	86	by striking the semicolon at the end and inserting ‘‘, sub-18
87	87	ject to section 5545b(e);’’. 19
88	88	SEC. 4. ESTABLISHMENT OF A MAXIMUM HOURS OF FED-20
89	89	ERAL FIREFIGHTERS’ REGULAR WORKWEEK. 21
90	90	Section 5545b of title 5, United States Code, as 22
91	91	amended by section 3, is further amended by adding at 23
92	92	the end the following: 24

96	96	‘‘(f) Not later than one year after the date of enact-1
97	97	ment of the Federal Firefighters Families First Act, the 2
98	98	Office of Personnel Management shall prescribe regula-3
99	99	tions establishing the maximum number of regularly reoc-4
100	100	curring hours which comprise a workweek for a firefighter 5
101	101	covered by this section. The maximum number of such 6
102	102	hours shall not exceed an average of 60 hours per week.’’. 7
103	103	SEC. 5. EFFECTIVE DATE. 8
104	104	The amendments made by this Act shall apply with 9
105	105	respect to any annuity entitlement to which is based on 10
106	106	a separation from service occurring after the end of the 11
107	107	60-day period beginning on the date of the enactment of 12
108	108	this Act. 13
