3737 SECTION 1. SHORT TITLE; PURPOSES. 1

3939 HORTTITLE.—This Act may be cited as the 2
4040 ‘‘Federal Firefighters Families First Act’’. 3
4141 (b) P
4242 URPOSES.—The purposes of this Act are— 4
4343 (1) to improve pay equality between Federal 5
4444 firefighters, other Federal employees, and municipal 6
4545 and other public sector firefighters; 7
4646 (2) to enhance recruitment and retention of 8
4747 firefighters in order to maintain the highest quality 9
4848 of Federal fire service; 10
4949 (3) to include the pay of all regularly reoccur-11
5050 ring scheduled hours during the firefighter workweek 12
5151 when computing such retirement benefits of fire-13
5252 fighters; and 14
5353 (4) to establish the regular workweek for Fed-15
5454 eral firefighters. 16
5555 SEC. 2. COMPUTATION OF PAY. 17
5656 Sections 5545b(b)(1)(A) and 5545b(c)(1)(B) of title 18
5757 5, United States Code, are amended by striking ‘‘2756’’ 19
5858 and inserting ‘‘2087’’. 20
5959 SEC. 3. COMPUTATION OF ANNUITY BASED ON CERTAIN 21
6060 FIREFIGHTER SERVICE. 22

6262 NGENERAL.—Section 5545b of title 5, United 23
6363 States Code, as amended by section 2, is further amended 24
6464 by adding at the end the following: 25

6868 ‘‘(e) For purposes of any determination of ‘average 1
6969 pay’ under section 8331(4) or 8401(3), in the case of a 2
7070 firefighter who is subject to subsection (b), the rate of 3
7171 basic pay in effect for such firefighter for a year of cred-4
7272 itable service (or, in the case of an annuity under sub-5
7373 section (d) or (e)(1) of section 8341 or under chapter 84 6
7474 based on less than 3 years of creditable service, for any 7
7575 other period of creditable service) shall, in addition to the 8
7676 amount determined under subsection (b) for such year (or 9
7777 other period), include an amount equal to one-half the 10
7878 firefighter’s basic hourly rate (as computed under sub-11
7979 section (b)(1)(A)) for such year (or other period) times 12
8080 the number of overtime hours included as part of such 13
8181 firefighter’s regular tour of duty during such year (or 14
8282 other period).’’. 15

8484 ONFORMINGAMENDMENTS.—Sections 8331(4) 16
8585 and 8401(3) of title 5, United States Code, are amended 17
8686 by striking the semicolon at the end and inserting ‘‘, sub-18
8787 ject to section 5545b(e);’’. 19
8888 SEC. 4. ESTABLISHMENT OF A MAXIMUM HOURS OF FED-20
8989 ERAL FIREFIGHTERS’ REGULAR WORKWEEK. 21
9090 Section 5545b of title 5, United States Code, as 22
9191 amended by section 3, is further amended by adding at 23
9292 the end the following: 24

9696 ‘‘(f) Not later than one year after the date of enact-1
9797 ment of the Federal Firefighters Families First Act, the 2
9898 Office of Personnel Management shall prescribe regula-3
9999 tions establishing the maximum number of regularly reoc-4
100100 curring hours which comprise a workweek for a firefighter 5
101101 covered by this section. The maximum number of such 6
102102 hours shall not exceed an average of 60 hours per week.’’. 7
103103 SEC. 5. EFFECTIVE DATE. 8
104104 The amendments made by this Act shall apply with 9
105105 respect to any annuity entitlement to which is based on 10
106106 a separation from service occurring after the end of the 11
107107 60-day period beginning on the date of the enactment of 12
108108 this Act. 13
