3232 NGENERAL.—Chapter 243 of title 49, United 4
3333 States Code, is amended by adding at the end the fol-5
3434 lowing new section: 6
3535 ‘‘§ 24324. Right of rail passengers to recover certain 7
3636 unfulfilled fare 8
3737 ‘‘(a) I
3838 NGENERAL.—Not later than 180 days after 9
3939 the date of enactment of the All Aboard Act, the Secretary 10
4040 of Transportation shall issue regulations to ensure that 11
4141 any person who purchases covered rail passenger transpor-12
4242 tation receives a refund equal to the rate the person paid 13
4343 for such transportation, at the expense of Amtrak and in 14
4444 accordance with this section, if due to a failure of Amtrak, 15
4545 such transportation, or a part of such transportation, is— 16
4646 ‘‘(1) canceled; or 17
4747 ‘‘(2) delayed such that the transportation is 18
4848 completed more than 3 hours after the expected 19
4949 completion time as of the time of the purchase. 20

5353 AUSATION.—For purposes of subsection 22
5454 (a), a cancellation or delay is not a failure of Am-23
5555 trak if the cancellation or delay is attributable to 24
5656 forces or persons uncontrollable by Amtrak. 25

6161 subsection (a), the Secretary shall issue regulations 2

6363 ‘‘(A) procedures for determining if a can-4
6464 cellation or delay is subject to subsection (a); 5

6666 ‘‘(B) procedures by which Amtrak can dis-7
6767 pute that a cancellation or delay is subject to 8
6868 subsection (a), including that the cancellation 9
6969 or delay was due to a failure of Amtrak. 10

7373 IMING.—A provider of covered rail pas-12
7474 senger transportation shall issue a refund with re-13
7575 spect to a cancellation or delay described in sub-14
7676 section (a)— 15
7777 ‘‘(A) if Amtrak does not dispute that the 16
7878 cancellation or delay is due to a failure of Am-17
7979 trak— 18
8080 ‘‘(i) if the covered rail passenger 19
8181 transportation is purchased with credit, a 20
8282 voucher, or rewards points issued by the 21
8383 provider of such transportation, not later 22
8484 than 7 days after the cancellation or delay; 23
8585 or 24

8989 ‘‘(ii) if the covered rail passenger 1
9090 transportation is purchased with cash, as 2
9191 soon as is feasible after the cancellation or 3
9292 delay; or 4
9393 ‘‘(B) if Amtrak disputes, pursuant to the 5
9494 procedures established under subsection (b)(2), 6
9595 that the cancellation or delay is subject to sub-7
9696 section (a), not later than a date— 8
9797 ‘‘(i) which is after the date on which 9
9898 a final determination is issued that the 10
9999 cancellation or delay is subject to sub-11
100100 section (a); and 12
101101 ‘‘(ii) determined by the Secretary to 13
102102 be prompt and feasible. 14

104104 ORM.—A refund under subsection (a) 15
105105 shall be issued to a purchaser of covered rail pas-16
106106 senger transportation in the form of payment used 17
107107 by the purchaser. 18

111111 ARRIERS.—Amtrak shall, upon request from a rail car-20
112112 rier that issues a refund under subsection (a), reimburse 21
113113 the rail carrier in the amount equal to the refund. 22

115115 ONCOMPLIANCE.—Amtrak may not receive 23
116116 Federal funds for any period during which the Secretary 24
117117 determines that Amtrak is noncompliant with this section. 25

122122 any fiscal year in which Amtrak accepts Federal funds. 2

126126 EFINED.—In this section, the term ‘covered rail pas-4
127127 senger transportation’ means— 5
128128 ‘‘(1) rail passenger transportation provided by, 6
129129 or on behalf, of Amtrak; or 7
130130 ‘‘(2) commuter rail passenger transportation 8
131131 that travels over rails owned by Amtrak, regardless 9
132132 of if such transportation is provided by Amtrak or 10
133133 another rail carrier.’’. 11

138138 EPORT.—Not later than 6 months after 14
139139 the date of enactment of this Act, Amtrak shall sub-15
140140 mit to the Committee on Transportation and Infra-16
141141 structure of the House of Representatives and the 17
142142 Committee on Commerce, Science, and Transpor-18
143143 tation of the Senate a report including— 19
144144 (A) an identification of each asset mainte-20
145145 nance strategy that Amtrak could adopt as a 21
146146 replacement for a run-to-fail maintenance 22
147147 model; and 23

156156 may not use a run-to-fail maintenance model after 5
157157 the date that is 2 years after the date of enactment 6
158158 of this Act. 7

160160 MPLEMENTATION OF NEW ASSET MAINTE -8
161161 NANCE STRATEGY.—Not later than 2 years after the 9
162162 date of enactment of this Act, Amtrak shall imple-10
163163 ment an asset maintenance strategy identified in the 11
164164 report under paragraph (1). 12

166166 UN-TO-FAILMAINTENANCE MODELDE-13
167167 FINED.—In this section, the term ‘‘run-to-fail mainte-14
168168 nance model’’ means an asset maintenance strategy under 15
169169 which an asset (including equipment and infrastructure 16
170170 used for passenger rail transportation) is retired from use 17
171171 only at such time as— 18
172172 (1) the asset is no longer capable of fulfilling an 19
173173 intended use; or 20
174174 (2) the age of the asset exceeds the manufac-21
175175 turer-estimated lifespan of the asset. 22
