To direct the Secretary of Health and Human Services to
revise regulations to remove the requirement under the
Medicare program that an off-campus facility or organi-
zation shall be located within a 35-mile radius of a
hospital or critical access hospital.

SECTION 1. SHORT TITLE. 3
This Act may cited as the ‘‘Rural ER Access Act’’. 4

SEC. 2. REMOVING LOCATION REQUIREMENTS UNDER THE 1
MEDICARE PROGRAM APPLICABLE TO OFF- 2
CAMPUS FACILITIES OR ORGANIZATIONS. 3
Not later than 60 days after the date of the enact-4
ment of this Act, the Secretary of Health and Human 5
Services shall revise section 413.65(e)(3)(i) of title 42, 6
Code of Federal Regulations (or any successor regulation), 7
to remove the requirement under the Medicare program 8
that an off-campus facility or organization shall be located 9
within a 35-mile radius of the campus of a hospital or 10
critical access hospital that is the potential main provider 11
to meet the location requirements to be eligible for pro-12
vider-based status. 13
