19	19	To limit the ability of the Secretary of Agriculture and
20	20	the Secretary of the Interior to penalize an owner of
21	21	livestock for grazing by such livestock on certain Federal
22	22	lands on which grazing is permitted on or after the
23	23	date of enactment of this Act and subsequently prohib-
24	24	ited, and for other purposes.
25	25	Be it enacted by the Senate and House of Representa-1
26	26	tives of the United States of America in Congress assembled, 2

30	30	SECTION 1. SHORT TITLE. 1
31	31	This Act may be cited as the ‘‘Protecting Agricultural 2
32	32	Spaces Through Effective Ranching Strategies Act’’ or the 3
33	33	‘‘PASTURES Act’’. 4
34	34	SEC. 2. LIMITATION ON PENALTIES FOR GRAZING LIVE-5
35	35	STOCK ON CERTAIN COVERED LANDS. 6
36	36	(a) L
37	37	IMITATION.—The Secretary concerned may not 7
38	38	impose a penalty on an owner of livestock for grazing by 8
39	39	such livestock on covered lands on which a fence for the 9
40	40	prevention of such grazing does not exist. 10
41	41	(b) F
42	42	ENCEEXPENSES.—The Secretary concerned 11
43	43	shall be responsible for any expense related to the con-12
44	44	struction or maintenance of any fence constructed or 13
45	45	maintained on covered lands for the prevention of grazing 14
46	46	by livestock on such covered lands. 15

48	48	EFINITIONS.—In this section: 16
49	49	(1) C
50	50	OVERED LANDS .—The term ‘‘covered 17
51	51	lands’’ means National Forest System lands, lands 18
52	52	administered by the United States Fish and Wildlife 19
53	53	Service, or public lands— 20
54	54	(A) on which grazing is permitted by graz-21
55	55	ing permit or lease on or after the date of en-22
56	56	actment of this Act and subsequently prohib-23
57	57	ited; and 24
58	58	(B) that borders private property. 25

62	62	(2) GRAZING PERMIT OR LEASE .—The term 1
63	63	‘‘grazing permit or lease’’ means— 2
64	64	(A) a grazing permit as such term is de-3
65	65	fined in section 222.1 of title 36, Code of Fed-4
66	66	eral Regulations (or successor regulations); 5
67	67	(B) a cooperative agreement referred to in 6
68	68	section 29.2 of title 50, Code of Federal Regu-7
69	69	lations (or successor regulations) that permits 8
70	70	grazing; or 9
71	71	(C) a grazing permit or lease described in 10
72	72	section 4130.2 of title 43, Code of Federal Reg-11
73	73	ulations (or successor regulations). 12

75	75	IVESTOCK.—The term ‘‘livestock’’ includes 13
76	76	cattle, bison, horses, sheep, and goats. 14

78	78	ATIONAL FOREST SYSTEM .—The term 15
79	79	‘‘National Forest System’’ has the meaning given 16
80	80	the term in section 11(a) of the Forest and Range-17
81	81	land Renewable Resources Planning Act of 1974 (16 18
82	82	U.S.C. 1609). 19

84	84	UBLIC LANDS.—The term ‘‘public lands’’ 20
85	85	has the meaning given that term in section 103 of 21
86	86	the Federal Land Policy and Management Act of 22
87	87	1976 (43 U.S.C. 1702). 23

89	89	ECRETARY CONCERNED .—The term ‘‘Sec-24
90	90	retary concerned’’ means— 25
