3030 (1) IN GENERAL.—The number of acres of 1
3131 land, water, and interests therein acquired by the 2
3232 United States and put under the administrative ju-3
3333 risdiction of the Secretary of the Interior or the Sec-4
3434 retary of Agriculture in a State during a fiscal year 5
3535 may not exceed the number of acres of Federal land 6
3636 under the administrative jurisdiction of the Sec-7
3737 retary of the Interior or the Secretary of Agriculture 8
3838 disposed of in that State during that fiscal year. 9

4040 PPLICATION.—In applying paragraph 10
4141 (1)— 11
4242 (A) only the disposal of fee title to lands 12
4343 or waters may be counted against acquisition of 13
4444 fee title to lands or waters; and 14
4545 (B) only disposal of interests in lands or 15
4646 waters of less than fee may be counted against 16
4747 acquisition of comparable interests in lands or 17
4848 waters of less than fee. 18

5353 NVENTORY.—The Secretary shall complete 21
5454 an annual inventory of the total number of acres of 22
5555 Federal land, categorized according to the type of 23
5656 interest (such as fee, easement, mineral interest, 24
5757 etc.), under the administrative jurisdiction of each 25

6161 agency of the Department of the Interior or the De-1
6262 partment of Agriculture, as the case may be— 2
6363 (A) in each State; and 3
6464 (B) in the aggregate. 4

6666 ETERMINATION.—Based on the inventory 5
6767 required by subparagraph (A), the Secretary shall 6
6868 make an annual determination of the increase or de-7
6969 crease in the previous fiscal year of the total number 8
7070 of acres of Federal land, categorized according to 9
7171 the type of interest (such as fee, easement, mineral 10
7272 interest), under the administrative jurisdiction of— 11
7373 (A) each agency of the Department of the 12
7474 Interior or the Department of Agriculture, as 13
7575 the case may be; and 14
7676 (B) the Department of the Interior, in 15
7777 total, and the Department of Agriculture, in 16
7878 total, as the case may be. 17

8080 EPORT.—Not later than September 30 of 18
8181 each year, the Secretary shall submit to the Presi-19
8282 dent and Congress a report containing the inventory 20
8383 and determination required under this subsection. 21

8888 after the Secretary determines under subsection (b) 24

9393 Federal land under the administrative jurisdiction of 1
9494 that Secretary in a State than it disposed of in that 2
9595 State during a fiscal year, the President shall convey 3
9696 to that State sufficient Federal land under the ad-4
9797 ministrative jurisdiction of that Secretary to comply 5
9898 with subsection (a) for that fiscal year. 6

100100 O MAJOR FEDERAL ACTION .—A convey-7
101101 ance under paragraph (1) shall not be considered a 8
102102 major Federal action for the purposes of section 9
103103 102(2)(C) of the National Environmental Policy Act 10
104104 of 1969 (42 U.S.C. 4332(2)(C)). 11

106106 EFINITIONS.—For the purposes of this Act, the 12
107107 following definitions apply: 13
108108 (1) F
109109 EDERAL LAND .—The term ‘‘Federal 14
110110 land’’— 15
111111 (A) means Federal lands, waters, and in-16
112112 terests therein, including lands held in trust by 17
113113 the Federal Government (except as provided in 18
114114 subparagraph (C)); 19
115115 (B) includes non-Federal land that is— 20
116116 (i) leased by the Federal Government; 21
117117 (ii) held as a conservation easement 22
118118 by the Federal Government; or 23
119119 (iii) requires oversight by, involvement 24
120120 in, or other authority is exercised by the 25

125125 hibits use of the non-Federal land that is 2
126126 not specifically authorized by the Federal 3
127127 Government; and 4
128128 (C) does not include land, water, and inter-5
129129 ests therein— 6
130130 (i) held by an Indian Tribe or indi-7
131131 vidual Indian subject to a restriction by 8
132132 the Federal Government against alienation; 9
133133 (ii) acquired pursuant to a foreclosure 10
134134 under title 18, United States Code; 11
135135 (iii) acquired by any department, 12
136136 agency, or independent establishment in its 13
137137 capacity as a receiver, conserver, or liqui-14
138138 dating agent which is held by that depart-15
139139 ment, agency, or independent establish-16
140140 ment in such capacity pending disposal; 17
141141 (iv) that has reverted to the Federal 18
142142 Government pursuant to a reversionary 19
143143 clause in a deed or statute; 20
144144 (v) subject to seizure, levy, or lien 21
145145 under the Internal Revenue Code of 1986; 22
146146 or 23
147147 (vi) securing a debt owed to the 24
148148 United States. 25

158158 gard to Federal land under the administrative 7
159159 jurisdiction of that Secretary. 8

161161 TATE.—The term ‘‘State’’ means the sev-9
162162 eral States and the District of Columbia. 10
