19	19	To amend title XVIII of the Social Security Act to perma-
20	20	nently extend certain in-home cardiopulmonary rehabili-
21	21	tation flexibilities established in response to COVID–
22	22	19, and for other purposes.
23	23	Be it enacted by the Senate and House of Representa-1
24	24	tives of the United States of America in Congress assembled, 2
25	25	SECTION 1. SHORT TITLE. 3
26	26	This Act may be cited as the ‘‘Sustainable 4
27	27	Cardiopulmonary Rehabilitation Services in the Home 5
28	28	Act’’. 6

33	33	BILITATION FLEXIBILITIES ESTABLISHED IN 2
34	34	RESPONSE TO COVID–19. 3
35	35	(a) I
36	36	NGENERAL.—Section 1861(eee)(2) of the Social 4
37	37	Security Act (42 U.S.C. 1395x(eee)(2)) is amended— 5
38	38	(1) in subparagraph (A)(ii), by inserting ‘‘, in-6
39	39	cluding in the home of an individual when furnished 7
40	40	as a telehealth service through two-way audio-visual 8
41	41	communications technology, or when such home is 9
42	42	designated as a provider-based location of a hospital 10
43	43	outpatient department’’ after ‘‘outpatient basis’’; 11
44	44	and 12
45	45	(2) in subparagraph (B), by inserting ‘‘, includ-13
46	46	ing through the virtual presence of such physician, 14
47	47	physician assistant, nurse practitioner, or clinical 15
48	48	nurse specialist, through two-way audio-visual com-16
49	49	munications technology’’ after ‘‘under the program’’. 17

51	51	XPANDING ORIGINATING SITES.—Section 18
52	52	1834(m) of the Social Security Act (42 U.S.C. 1395m(m)) 19
53	53	is amended— 20
54	54	(1) in paragraph (1), by striking ‘‘and (9)’’ 21
55	55	through ‘‘(as defined in paragraph (4)(E))’’ and in-22
56	56	serting ‘‘, (9), and (10), the Secretary shall pay for 23
57	57	telehealth services that are furnished via a tele-24
58	58	communications system by a physician (as defined in 25
59	59	section 1861(r)) or a practitioner (as defined in 26

86	86	ments described in paragraph (4)(C)(i) shall not 23
87	87	apply with respect to telehealth services for cardiac 24
88	88	rehabilitation programs and intensive cardiac reha-25

103	103	N GENERAL.—The Secretary of Health and 9
104	104	Human Services shall promulgate rules to— 10
105	105	(A) establish standards for the designation 11
106	106	of the home of an individual with status as a 12
107	107	provider-based organization of a hospital con-13
108	108	sistent with waivers issued through the Hospital 14
109	109	Without Walls program for cardiac rehabilita-15
110	110	tion, pulmonary rehabilitation, and intensive 16
111	111	cardiac rehabilitation; and 17
112	112	(B) include cardiac rehabilitation programs 18
113	113	and intensive cardiac rehabilitation programs 19
114	114	(as such terms are defined in section 1861(eee) 20
115	115	of the Social Security Act (42 U.S.C. 21
116	116	1395x(eee))), and pulmonary rehabilitation pro-22
117	117	grams (as defined in section 1861(fff) of such 23
118	118	Act (42 U.S.C. 1395x(fff))) among telehealth 24
119	119	services to be specified under section 25
