1919 mis Abuse Act’’. 5
2020 SEC. 2. MODIFICATION OF ADMINISTRATIVE EXEMPTIONS 6
2121 UNDER THE TARIFF ACT OF 1930. 7
2222 (a) I
2323 NGENERAL.—Section 321 of the Tariff Act of 8
2424 1930 (19 U.S.C. 1321) is amended— 9
2525 (1) in subsection (a)(2)— 10

4444 ‘‘(b)(1) The privilege of subparagraph (A), (B), or 16
4545 (C) of subsection (a)(2) shall not be granted in any case 17

4747 is forwarded in separate lots to secure the benefit of such 19
4848 subsection. 20
4949 ‘‘(2) The privilege of subparagraph (C) of subsection 21
5050 (a)(2) shall not be granted with respect to any article that 22
5151 is subject to duties or other import restrictions under any 23
5252 of the following provisions of law: 24
5353 ‘‘(A) Subtitle A or B of title VII of this Act. 25

6363 ‘‘(3)(A) No covered article may receive the privilege 7
6464 of subparagraph (C) of subsection (a)(2) unless the 10- 8
6565 digit classification of the article under the Harmonized 9
6666 Tariff Schedule of the United States is provided to U.S. 10
6767 Customs and Border Protection, pursuant to an author-11
6868 ized electronic data interchange system, as part of the 12
6969 entry filing in accordance with section 498 of this Act, 13
7070 in addition to any other information required by law. 14
7171 ‘‘(B) In this paragraph, the term ‘covered article’ 15
7272 means an article the origin of which is a country with any 16
7373 goods subject to duties or other import restrictions under 17
7474 section 301 of the Trade Act of 1974 (19 U.S.C. 2411). 18
7575 ‘‘(c) Any person who enters, introduces, or attempts 19
7676 to introduce an article in violation of this section is liable 20
7777 for a civil penalty of $5,000 for the first violation; and 21
7878 $10,000 for each subsequent violation. A penalty imposed 22
7979 under this subsection is in addition to any other penalty 23
8080 authorized by law.’’. 24

8484 (b) EFFECTIVEDATE.—The amendments made by 1
8585 this section shall apply with respect to articles entered, 2
8686 or withdrawn from warehouse for consumption, on or after 3
8787 the 30th day after the date of the enactment of this Act. 4
