2020 mate Labeling Act’’. 5

3636 DMINISTRATION OFPROGRAM.— 5

3838 ROHIBITION.—A person manufacturing, 6
3939 importing, distributing, or selling food may not place 7
4040 the food climate label developed under subsection (c) 8
4141 on the food or its labeling unless the Administrator 9
4242 has authorized such person to do so under para-10
4343 graph (3). 11

4545 PPLICATIONS.—An applicant shall submit 12
4646 to the Administrator an application at such time, in 13
4747 such manner, and containing such information as 14
4848 the Administrator may require. 15

5050 EVIEW OF APPLICATIONS .—The Adminis-16
5151 trator shall review all applications submitted under 17
5252 paragraph (2) and approve any such application— 18
5353 (A) on the basis of whether the applicant 19
5454 provides assurances satisfactory to the Adminis-20
5555 trator that the applicant will adhere to the re-21
5656 quirements of the labeling program; and 22
5757 (B) not on the basis of an assessment of 23
5858 the benefits to the environment associated with 24
5959 the food. 25

101101 ISUAL FORM.—The visual form of the food 7

104104 paragraph (4) to the consumer in a manner 10
105105 that is determined by the Administrator to be 11
106106 most useful to the consumer at the point of sale 12
107107 in making food purchasing decisions; 13
108108 (B) not convey that any given food is ac-14
109109 ceptable or unacceptable, but instead provide to 15
110110 the consumer a numerical quantification of the 16
111111 information described in paragraph (4); 17
112112 (C) employ words, numbers, and imagery, 18
113113 as specified by the Administrator; 19
114114 (D) convey that the information on the 20
115115 food climate label has been verified under re-21
116116 quirements established by the Environmental 22
117117 Protection Agency; 23

135135 house gas emissions released throughout the 13
136136 lifecycle of the food and its input materials as 14

138138 (i) The first numerical summary shall 16
139139 include the information on the greenhouse 17
140140 gas emissions released during— 18
141141 (I) the growing of ingredients; 19
142142 (II) the manufacture of the 20
143143 nonfood input materials; 21
144144 (III) processing; 22
145145 (IV) packaging; and 23
146146 (V) distribution. 24

193193 an indication that such food is subject to 12
194194 such commitment and a summary of the 13
195195 information reported pursuant to such 14
196196 commitment under such subsection. 15

200200 ETHOD OF VERIFICATION .— 18

202202 N GENERAL.—The Administrator 19
203203 shall specify the method by which the informa-20
204204 tion included on the food climate label shall be 21
205205 verified. Such method shall include— 22
206206 (i) adhering to uniform standards for 23
207207 the collection and analysis of such informa-24
208208 tion; 25

214214 such purpose) to measure, monitor, verify, 3
215215 and report such information; and 4
216216 (iii) using the best available scientific 5

219219 NTERNATIONAL STANDARDS .—In de-7
220220 veloping the method under subparagraph (A), 8
221221 the Administrator shall consider the established 9
222222 international standards for carbon accounting 10
223223 for product lifecycle assessment, including— 11
224224 (i) the ISO 14040 and ISO 14044 12
225225 standards of the International Organiza-13
226226 tion for Standardization; and 14
227227 (ii) protocols established under the 15
228228 Greenhouse Gas Protocol (commonly 16
229229 known as the ‘‘GHG Protocol’’) program 17
230230 of the World Business Council for Sustain-18
231231 able Development and the World Resources 19
232232 Institute, including— 20
233233 (I) the GHG Product Life Cycle 21
234234 Accounting and Reporting Standard; 22
235235 and 23

244244 PRACTICES OF FOOD INDUSTRY .—The Adminis-5
245245 trator shall ensure that the method under sub-6
246246 paragraph (A) is informed by, and generally 7
247247 aligned with, the current best practices of the 8
248248 food industry for validating the information in-9
249249 cluded on the food climate label. 10

251251 OLUNTARYCOMMITMENTS.—Not later than 2 11
252252 years after the date of enactment of this section, the Ad-12
253253 ministrator shall establish a program under which a man-13
254254 ufacturer, importer, distributor, or seller of a food bearing 14
255255 the food climate label may, on a voluntary basis— 15
256256 (1) make and report a voluntary commitment to 16
257257 reduce the greenhouse gas emissions associated with 17
258258 such food; and 18
259259 (2) report sustainability information pertaining 19
260260 to the food based on the best available scientific in-20
261261 formation. 21

263263 ATABASE.—Not later than 2 years after the date 22
264264 of enactment of this section, the Administrator shall estab-23
265265 lish and make publicly accessible a database under an 24

270270 formation pertaining to the labeling program, including— 2
271271 (1) explanations of the objectives and the meth-3
272272 odologies of the Administrator in developing the food 4
273273 climate label and in specifying the visual form, infor-5
274274 mation to be included, and method for verification 6
275275 referred to in subsection (c)(1); 7
276276 (2) the information described in clauses (i) and 8
277277 (ii) of subsection (c)(4)(B) with respect to each food 9
278278 in the labeling program; 10
279279 (3) the voluntary commitments and sustain-11
280280 ability information reported under subsection (d); 12
281281 and 13
282282 (4) as the Administrator determines appro-14
283283 priate, any sustainability information pertaining to 15
284284 food bearing the food climate label, based on the 16
285285 best available scientific information. 17

287287 EPORTS.—Not later than 7 years after the date 18
288288 of enactment of this section, and every 5 years thereafter, 19
289289 the Administrator shall— 20
290290 (1) publish a report on the labeling program’s 21
291291 effectiveness in— 22
292292 (A) providing consumers information that 23
293293 consumers find useful; and 24

299299 the food and its input materials, as described in 3

301301 (2) submit to Congress a report containing any 5
302302 recommendations for legislative action that would 6
303303 improve the labeling program’s effectiveness in 7
304304 achieving the objectives described in subparagraphs 8
305305 (A) and (B) of paragraph (1). 9

309309 N GENERAL.—Not later than 2 years after 11
310310 the date of enactment of this section, the Adminis-12
311311 trator shall finalize regulations to carry out the la-13
312312 beling program. 14

314314 PDATES.—Not later than 7 years after the 15
315315 date of enactment of this section, and every 5 years 16
316316 thereafter, the Administrator shall update the regu-17
317317 lations for carrying out the labeling program to in-18
318318 crease the labeling program’s effectiveness, as deter-19
319319 mined by the Administrator with regard to the ob-20
320320 jectives described in subparagraphs (A) and (B) of 21
321321 subsection (f)(1). 22

325325 STABLISHMENT.—The Administrator shall 24
326326 establish a technical assistance advisory board with-25

332332 (A) entities participating in or seeking to 3
333333 participate in the labeling program; 4
334334 (B) entities certified or seeking to become 5
335335 certified under subsection (c)(5)(A)(ii); 6
336336 (C) entities making a voluntary commit-7
337337 ment or seeking to make such commitment 8
338338 under subsection (d); and 9
339339 (D) retail food establishments. 10

341341 OMPOSITION.—The technical assistance 11
342342 advisory board under paragraph (1) shall be com-12
343343 prised of subject matter experts and academics, 13
344344 trade associations, consultants, leaders of the De-14
345345 partment of Agriculture, and representatives of in-15
346346 dustry and appropriate organizations. 16

348348 ONSUMEROUTREACH.—Not later than 3 years 17
349349 after the date of enactment of this section, the Adminis-18
350350 trator shall establish a program to inform consumers 19
351351 about the labeling program by— 20
352352 (1) providing retail food establishments edu-21
353353 cational materials and other information to be con-22
354354 veyed to consumers regarding the labeling program, 23
355355 which materials and information shall display the 24

365365 ENALTIES FORFRAUDULENTUSE OFLABEL.— 6

367367 N GENERAL.—Any person that violates a 7
368368 requirement of this section shall be subject to a civil 8
369369 penalty of not more than $10,000 for each such vio-9
370370 lation. 10
371371 (2) S
372372 EPARATE VIOLATIONS .—Each separate 11
373373 violation of a requirement of this section with re-12
374374 spect to a given type of food shall be a separate of-13
375375 fense, except that in a case of a violation through 14
376376 continuing failure to obey or neglect to obey an 15
377377 order by the Administrator under this section, each 16
378378 day of continuance of such failure or neglect shall be 17
379379 deemed a separate offense. 18

381381 QUITABLE RELIEF .—In a civil action 19
382382 brought under this section, the United States dis-20
383383 trict courts are empowered to grant mandatory in-21
384384 junctions and such other equitable relief as such 22
385385 courts deem appropriate. 23

392392 trator’’ means the Administrator of the Environ-2
393393 mental Protection Agency. 3

395395 PPLICANT.—The term ‘‘applicant’’ means 4
396396 a person that— 5
397397 (A) manufactures, imports, distributes, or 6
398398 sells food; and 7
399399 (B) has an application pending under sub-8
400400 section (b) to participate in the labeling pro-9
401401 gram. 10

403403 OOD INDUSTRY STAKEHOLDERS .—The 11
404404 term ‘‘food industry stakeholders’’ means— 12
405405 (A) entities that— 13
406406 (i) grow, raise, process, prepare, man-14
407407 ufacture, or otherwise add value to a food 15
408408 product; 16
409409 (ii) store, package, repackage, trans-17
410410 port, or distribute a food product for 18
411411 wholesale; 19
412412 (iii) sell a food product directly to 20
413413 consumers; 21
414414 (iv) provide a food-related service to 22
415415 entities that engage in any of the activities 23
416416 described in clauses (i) through (iii); 24

438438 (F) any perfluorocarbon; 18
439439 (G) nitrogen trifluoride; 19
440440 (H) any fully fluorinated linear, branched, 20
441441 or cyclic— 21
442442 (i) alkane; 22
443443 (ii) ether; 23
444444 (iii) tertiary amine; or 24
445445 (iv) aminoether; 25

456456 REENHOUSE GAS EMISSION .—The term 7
457457 ‘‘greenhouse gas emission’’ means the release of a 8
458458 greenhouse gas into the ambient air. 9

460460 ABELING PROGRAM .—The term ‘‘labeling 10
461461 program’’ means the voluntary food climate labeling 11
462462 program established under this section. 12

464464 PEN LICENSE.—The term ‘‘open license’’ 13
465465 means any legally binding instrument that grants 14
466466 permission to access, reuse, and redistribute a work 15
467467 with few or no restrictions. 16

469469 ARTICIPANT.—The term ‘‘participant’’ 17
470470 means, with respect to food, the person authorized 18
471471 pursuant to subsection (b) to place the food climate 19
472472 label developed under subsection (c) on the food or 20
473473 its labeling. 21
