20	20	Be it enacted by the Senate and House of Representa-1
21	21	tives of the United States of America in Congress assembled, 2
22	22	SECTION 1. SHORT TITLE. 3
23	23	This Act may be cited as the ‘‘Silencers Help Us Save 4
24	24	Hearing Act’’ or the ‘‘SHUSH Act’’. 5
25	25	SEC. 2. EQUAL TREATMENT OF SILENCERS AND FIREARMS. 6
26	26	(a) I
27	27	NGENERAL.—Section 5845(a) of the Internal 7
28	28	Revenue Code of 1986 is amended by striking ‘‘(7) any 8

32	32	silencer’’ and all that follows through ‘‘; and (8)’’ and in-1
33	33	serting ‘‘; and (7)’’. 2

35	35	FFECTIVEDATE.— 3
36	36	(1) I
37	37	N GENERAL.—Except as otherwise pro-4
38	38	vided in this subsection, the amendment made by 5
39	39	this section shall take effect on the date of the en-6
40	40	actment of this Act. 7
41	41	(2) T
42	42	RANSFERS.—In the case of the tax im-8
43	43	posed by section 5811 of such Code, the amendment 9
44	44	made by this section shall apply with respect to 10
45	45	transfers after October 22, 2015. 11
46	46	SEC. 3. TREATMENT OF CERTAIN SILENCERS. 12
47	47	Section 5841 of the Internal Revenue Code of 1986 13
48	48	is amended by adding at the end the following: 14
49	49	‘‘(f) F
50	50	IREARMSILENCERS.—A person acquiring or 15
51	51	possessing a firearm silencer in accordance with Chapter 16
52	52	44 of title 18, United States Code, shall be treated as 17
53	53	meeting any registration and licensing requirements of the 18
54	54	National Firearms Act (as in effect on the day before the 19
55	55	date of the enactment of this subsection) with respect to 20
56	56	such silencer.’’. 21
57	57	SEC. 4. PREEMPTION OF CERTAIN STATE LAWS IN RELA-22
58	58	TION TO FIREARM SILENCERS. 23
59	59	Section 927 of title 18, United States Code, is 24
60	60	amended by adding at the end the following: ‘‘Notwith-25

64	64	standing the preceding sentence, a law of a State or a 1
65	65	political subdivision of a State that, as a condition of law-2
66	66	fully making, transferring, using, possessing, or trans-3
67	67	porting a firearm silencer in or affecting interstate or for-4
68	68	eign commerce, imposes a tax on any such conduct, or a 5
69	69	marking, recordkeeping or registration requirement with 6
70	70	respect to the firearm silencer, shall have no force or ef-7
71	71	fect.’’. 8
72	72	SEC. 5. SILENCERS AND MUFFLERS NOT TO BE FEDERALLY 9
73	73	REGULATED. 10

75	75	EFINITIONS.—Section 921(a) of title 18, United 11
76	76	States Code, is amended— 12
77	77	(1) in paragraph (3), by striking ‘‘(C) any fire-13
78	78	arm muffler or firearm silencer; or (D)’’ and insert-14
79	79	ing ‘‘or (C)’’; and 15
80	80	(2) by striking paragraph (24). 16

82	82	ENALTIES.—Section 924 of such title is amend-17
83	83	ed— 18
84	84	(1) in subsection (c)— 19
85	85	(A) in paragraph (1)(B)(ii) by striking ‘‘, 20
86	86	or is equipped with a firearm silencer or fire-21
87	87	arm muffler’’; and 22
88	88	(B) in paragraph (1)(C)(ii), by striking 23
89	89	‘‘or is equipped with a firearm silencer or fire-24
90	90	arm muffler,’’; and 25
