33	33	This Act may be cited as the ‘‘Expanded Food Safety 2
34	34	Investigation Act of 2025’’. 3
35	35	SEC. 2. MICROBIAL SAMPLING ON CONCENTRATED ANIMAL 4
36	36	FEEDING OPERATIONS. 5
37	37	(a) I
38	38	NGENERAL.—Chapter IV of the Federal Food, 6
39	39	Drug, and Cosmetic Act (21 U.S.C. 341 et seq.) is amend-7
40	40	ed by adding at the end the following: 8
41	41	‘‘SEC. 425. MICROBIAL SAMPLING ON CONCENTRATED ANI-9
42	42	MAL FEEDING OPERATIONS. 10
43	43	‘‘(a) I
44	44	NGENERAL.—The Secretary may request ac-11
45	45	cess to a concentrated animal feeding operation in order 12
46	46	to conduct microbial sampling, if the Secretary determines 13
47	47	that such microbial sampling is necessary in order to fa-14
48	48	cilitate a foodborne illness outbreak investigation, deter-15
49	49	mine the root cause of an outbreak of foodborne illness, 16
50	50	or address other public health needs. 17
51	51	‘‘(b) G
52	52	RANTING OFREASONABLEACCESS.—A con-18
53	53	centrated animal feeding operation that receives a request 19
54	54	for access under subsection (a) shall provide reasonable 20
55	55	access to the Secretary to conduct such microbial sam-21
56	56	pling, including sampling of plants, animals, water, and 22
57	57	the environment, as the Secretary determines appropriate 23
58	58	to address the public health need. Such operation may 24
59	59	place reasonable conditions on access to the operation, in-25
60	60	cluding by specifying a time, place, and manner for sam-26

65	65	the Secretary from conducting appropriate sampling with-2
66	66	in a reasonable period of time. 3

68	68	UTHORITYOVERFOODSREGULATED BY THE 4
69	69	S
70	70	ECRETARY OFAGRICULTURE.—Nothing in this section 5
71	71	shall be construed to impose additional requirements by 6
72	72	the Secretary, beyond microbial sampling, with respect to 7
73	73	food that is within the jurisdiction of the Secretary of Ag-8
74	74	riculture pursuant to the Federal Meat Inspection Act, the 9
75	75	Poultry Products Inspection Act, or the Egg Products In-10
76	76	spection Act. 11

78	78	OORDINATIONWITHOTHERPUBLICHEALTH 12

80	80	GENCIES.—The Secretary shall ensure that data col-13
81	81	lected under this section are made available to the Sec-14
82	82	retary of Agriculture and relevant State and Federal pub-15
83	83	lic health agencies in order to facilitate work in detecting, 16
84	84	investigating, or preventing foodborne illness. Nothing in 17
85	85	this section shall be construed to limit the rights and ex-18
86	86	emptions otherwise available under section 552 of title 5, 19
87	87	United States Code. 20
88	88	‘‘(e) D
89	89	EFINITION.—In this section, the term ‘con-21
90	90	centrated animal feeding operation’ has the meaning given 22
91	91	such term in section 122.23(b) of title 40, Code of Federal 23
92	92	Regulations (or any successor regulations).’’. 24

96	96	(b) ENFORCEMENT.—Section 301 of the Federal 1
97	97	Food, Drug, and Cosmetic Act (21 U.S.C. 331) is amend-2
98	98	ed by adding at the end the following: 3
99	99	‘‘(jjj) The refusal to provide reasonable access for mi-4
100	100	crobial sampling in accordance with section 425.’’. 5
