3333 This Act may be cited as the ‘‘Expanded Food Safety 2
3434 Investigation Act of 2025’’. 3
3535 SEC. 2. MICROBIAL SAMPLING ON CONCENTRATED ANIMAL 4

3838 NGENERAL.—Chapter IV of the Federal Food, 6
3939 Drug, and Cosmetic Act (21 U.S.C. 341 et seq.) is amend-7
4040 ed by adding at the end the following: 8
4141 ‘‘SEC. 425. MICROBIAL SAMPLING ON CONCENTRATED ANI-9
4242 MAL FEEDING OPERATIONS. 10
4343 ‘‘(a) I
4444 NGENERAL.—The Secretary may request ac-11
4545 cess to a concentrated animal feeding operation in order 12
4646 to conduct microbial sampling, if the Secretary determines 13
4747 that such microbial sampling is necessary in order to fa-14
4848 cilitate a foodborne illness outbreak investigation, deter-15
4949 mine the root cause of an outbreak of foodborne illness, 16
5050 or address other public health needs. 17
5151 ‘‘(b) G
5252 RANTING OFREASONABLEACCESS.—A con-18
5353 centrated animal feeding operation that receives a request 19
5454 for access under subsection (a) shall provide reasonable 20
5555 access to the Secretary to conduct such microbial sam-21
5656 pling, including sampling of plants, animals, water, and 22
5757 the environment, as the Secretary determines appropriate 23
5858 to address the public health need. Such operation may 24
5959 place reasonable conditions on access to the operation, in-25
6060 cluding by specifying a time, place, and manner for sam-26

7070 ECRETARY OFAGRICULTURE.—Nothing in this section 5
7171 shall be construed to impose additional requirements by 6
7272 the Secretary, beyond microbial sampling, with respect to 7
7373 food that is within the jurisdiction of the Secretary of Ag-8
7474 riculture pursuant to the Federal Meat Inspection Act, the 9
7575 Poultry Products Inspection Act, or the Egg Products In-10
7676 spection Act. 11

8080 GENCIES.—The Secretary shall ensure that data col-13
8181 lected under this section are made available to the Sec-14
8282 retary of Agriculture and relevant State and Federal pub-15
8383 lic health agencies in order to facilitate work in detecting, 16
8484 investigating, or preventing foodborne illness. Nothing in 17
8585 this section shall be construed to limit the rights and ex-18
8686 emptions otherwise available under section 552 of title 5, 19
8787 United States Code. 20
8888 ‘‘(e) D
8989 EFINITION.—In this section, the term ‘con-21
9090 centrated animal feeding operation’ has the meaning given 22
9191 such term in section 122.23(b) of title 40, Code of Federal 23
9292 Regulations (or any successor regulations).’’. 24
