3333 This Act may be cited as the ‘‘Protecting Our Chil-2

3535 SEC. 2. POSTING OF ALL CLINICAL DATA FOR COVID–19 4

3838 Part C of subtitle 2 of title XXI of the Public Health 7
3939 Service Act (42 U.S.C. 300aa–25 et seq.) is amended by 8
4040 adding at the end the following: 9
4141 ‘‘SEC. 2129. POSTING OF ALL CLINICAL DATA FOR COVID–19 10
4242 VACCINES BEFORE PLACEMENT ON CHILD 11
4343 AND ADOLESCENT SCHEDULE. 12
4444 ‘‘(a) N
4545 OINCLUSION OF COVID VACCINES.—The 13
4646 Secretary, and any official, agency, or office of the Depart-14
4747 ment of Health and Human Services (including the Cen-15
4848 ters for Disease Control and Prevention and the Advisory 16
4949 Committee of Immunization Practices), shall not include 17
5050 any vaccine for COVID–19 on the child and adolescent 18
5151 immunization schedule unless the Secretary has posted on 19
5252 the public website of the Centers for Disease Control and 20
5353 Prevention all clinical data in the possession of the De-21
5454 partment of Health and Human Services (including the 22
5555 Advisory Committee of Immunization Practices) relating 23
5656 to the safety and efficacy (including any adverse effects) 24
5757 of such vaccine. All such data posted under this subsection 25
5858 shall be deidentified to protect all individually identifiable 26

6868 EMOVAL.—Any vaccine for COVID–19 5
6969 that is included on the child and adolescent immuni-6
7070 zation schedule as of the date of enactment of this 7
7171 section is hereby deemed to be removed from such 8
7272 schedule. 9
7373 ‘‘(2) A
7474 DMINISTRATIVE ACTION.—The Secretary 10
7575 shall take such actions as may be necessary to effec-11
7676 tuate the removal of a vaccine from the child and 12
7777 adolescent immunization schedule by operation of 13
7878 paragraph (1). 14
7979 ‘‘(3) R
8080 ULE OF CONSTRUCTION .—The removal 15
8181 of a vaccine from the child and adolescent immuni-16
8282 zation schedule by operation of paragraph (1) shall 17
8383 not be construed to affect the authority of the Sec-18
8484 retary (or other officials, agencies, or offices) to 19
8585 place such vaccine back on such schedule so long as 20
8686 such placement is in accordance with subsection (a) 21
8787 and other applicable provisions of law. 22
8888 ‘‘(c) D
8989 EFINITION.—In this section, the term ‘child 23
9090 and adolescent immunization schedule’ means the child 24
9191 and adolescent immunization schedule of the Advisory 25
