18	18	To amend the Public Health Service Act to prohibit the

22	22	on the public website of the Centers for Disease Control
23	23	and Prevention all clinical data in the possession of the
24	24	Department of Health and Human Services relating to
25	25	the safety and efficacy of such vaccine, and for other
26	26	purposes.
27	27	Be it enacted by the Senate and House of Representa-1
28	28	tives of the United States of America in Congress assembled, 2

32	32	SECTION 1. SHORT TITLE. 1
33	33	This Act may be cited as the ‘‘Protecting Our Chil-2
34	34	dren from the CDC Act’’. 3
35	35	SEC. 2. POSTING OF ALL CLINICAL DATA FOR COVID–19 4
36	36	VACCINES BEFORE PLACEMENT ON CHILD 5
37	37	AND ADOLESCENT SCHEDULE. 6
38	38	Part C of subtitle 2 of title XXI of the Public Health 7
39	39	Service Act (42 U.S.C. 300aa–25 et seq.) is amended by 8
40	40	adding at the end the following: 9
41	41	‘‘SEC. 2129. POSTING OF ALL CLINICAL DATA FOR COVID–19 10
42	42	VACCINES BEFORE PLACEMENT ON CHILD 11
43	43	AND ADOLESCENT SCHEDULE. 12
44	44	‘‘(a) N
45	45	OINCLUSION OF COVID VACCINES.—The 13
46	46	Secretary, and any official, agency, or office of the Depart-14
47	47	ment of Health and Human Services (including the Cen-15
48	48	ters for Disease Control and Prevention and the Advisory 16
49	49	Committee of Immunization Practices), shall not include 17
50	50	any vaccine for COVID–19 on the child and adolescent 18
51	51	immunization schedule unless the Secretary has posted on 19
52	52	the public website of the Centers for Disease Control and 20
53	53	Prevention all clinical data in the possession of the De-21
54	54	partment of Health and Human Services (including the 22
55	55	Advisory Committee of Immunization Practices) relating 23
56	56	to the safety and efficacy (including any adverse effects) 24
57	57	of such vaccine. All such data posted under this subsection 25
58	58	shall be deidentified to protect all individually identifiable 26

63	63	agency and sponsor personnel of the data involved. 2
64	64	‘‘(b) V
65	65	ACCINESALREADY ONSCHEDULE AS OF EN-3
66	66	ACTMENT.— 4
67	67	‘‘(1) R
68	68	EMOVAL.—Any vaccine for COVID–19 5
69	69	that is included on the child and adolescent immuni-6
70	70	zation schedule as of the date of enactment of this 7
71	71	section is hereby deemed to be removed from such 8
72	72	schedule. 9
73	73	‘‘(2) A
74	74	DMINISTRATIVE ACTION.—The Secretary 10
75	75	shall take such actions as may be necessary to effec-11
76	76	tuate the removal of a vaccine from the child and 12
77	77	adolescent immunization schedule by operation of 13
78	78	paragraph (1). 14
79	79	‘‘(3) R
80	80	ULE OF CONSTRUCTION .—The removal 15
81	81	of a vaccine from the child and adolescent immuni-16
82	82	zation schedule by operation of paragraph (1) shall 17
83	83	not be construed to affect the authority of the Sec-18
84	84	retary (or other officials, agencies, or offices) to 19
85	85	place such vaccine back on such schedule so long as 20
86	86	such placement is in accordance with subsection (a) 21
87	87	and other applicable provisions of law. 22
88	88	‘‘(c) D
89	89	EFINITION.—In this section, the term ‘child 23
90	90	and adolescent immunization schedule’ means the child 24
91	91	and adolescent immunization schedule of the Advisory 25
