To amend the Immigration and Nationality Act to provide 
that aliens who have been convicted of or who have 
committed an offense for driving while intoxicated or 
impaired are inadmissible and deportable.

Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Jeremy and Angel Seay 4
and Sergeant Brandon Mendoza Protect Our Communities 5
from DUIs Act of 2025’’. 6
SEC. 2. INADMISSIBILITY AND DEPORTABILITY RELATED 7
TO DRIVING WHILE INTOXICATED OR IM-8
PAIRED. 9
(a) I
NADMISSIBILITY.—Section 212(a)(2) of the Immi-10
gration and Nationality Act (8 U.S.C. 1182(a)(2)) is 11
amended by adding at the end the following: 12
‘‘(J) D
RIVING WHILE INTOXICATED OR IM -13
PAIRED.—Any alien who has been convicted of, 14
who admits having committed, or who admits 15
committing acts which constitute the essential 16
elements of an offense for driving while intoxi-17
cated or impaired, as those terms are defined 18
under the law of the jurisdiction where the con-19
viction, offense, or acts constituting the essential 20
elements of the offense occurred (including an of-21
fense for driving while under the influence of or 22
impaired by alcohol or drugs), without regard to 23
whether the conviction or offense is classified as 24

a misdemeanor or felony under Federal, State, 1
tribal, or local law, is inadmissible.’’. 2
(b) D
EPORTABILITY.—Section 237(a)(2) of the Immi-3
gration and Nationality Act (8 U.S.C. 1227(a)(2)) is 4
amended by adding at the end the following: 5
‘‘(G) D
RIVING WHILE INTOXICATED OR IM -6
PAIRED.—Any alien who has been convicted of 7
an offense for driving while intoxicated or im-8
paired, as those terms are defined under the law 9
of the jurisdiction where the conviction occurred 10
(including a conviction for driving while under 11
the influence of or impaired by alcohol or drugs), 12
without regard to whether the conviction is clas-13
sified as a misdemeanor or felony under Federal, 14
State, tribal, or local law, is deportable.’’. 15
