16	16	To establish Department of Homeland Security funding re-
17	17	strictions on institutions of higher education that have
18	18	a relationship with Confucius Institutes, and for other
19	19	purposes.
20	20	Be it enacted by the Senate and House of Representa-1
21	21	tives of the United States of America in Congress assembled, 2
22	22	SECTION 1. SHORT TITLE. 3
23	23	This Act may be cited as the ‘‘DHS Restrictions on 4
24	24	Confucius Institutes and Chinese Entities of Concern 5
25	25	Act’’. 6

32	32	EFINITIONS.—In this section: 3
33	33	(1) C
34	34	HINESE ENTITY OF CONCERN .—The term 4
35	35	‘‘Chinese entity of concern’’ means any university or 5
36	36	college in the People’s Republic of China that— 6
37	37	(A) is involved in the implementation of 7
38	38	military-civil fusion; 8
39	39	(B) participates in the Chinese defense in-9
40	40	dustrial base; 10
41	41	(C) is affiliated with the Chinese State Ad-11
42	42	ministration for Science, Technology and Indus-12
43	43	try for the National Defense; 13
44	44	(D) receives funding from any organization 14
45	45	subordinate to the Central Military Commission 15
46	46	of the Chinese Communist Party; 16
47	47	(E) provides support to any security, de-17
48	48	fense, police, or intelligence organization of the 18
49	49	Government of the People’s Republic of China 19
50	50	or the Chinese Communist Party; 20
51	51	(F) purposefully undermines the United 21
52	52	States’ relationship with Taiwan; 22
53	53	(G) aids, abets, or enables the detention, 23
54	54	imprisonment, persecution, or forced labor of 24
55	55	Uyghur Muslims in the People’s Republic of 25
56	56	China; 26

61	61	licious activities, including online disinformation 2
62	62	campaigns and propaganda, for the purpose of 3
63	63	interfering with United States Federal, State, 4
64	64	or local elections; or 5
65	65	(I) is affiliated with the Chinese Academy 6
66	66	of Sciences. 7

68	68	ONFUCIUS INSTITUTE.—The term ‘‘Confu-8
69	69	cius Institute’’ means a cultural institute funded by 9
70	70	the Government of the People’s Republic of China. 10

72	72	NSTITUTION OF HIGHER EDUCATION .—The 11
73	73	term ‘‘institution of higher education’’ has the 12
74	74	meaning given such term in section 102 of the High-13
75	75	er Education Act of 1965 (20 U.S.C. 1002). 14

77	77	ELATIONSHIP.—The term ‘‘relationship’’ 15
78	78	means, with respect to an institution of higher edu-16
79	79	cation, any contract awarded, or agreement entered 17
80	80	into, as well as any in-kind donation or gift, received 18
81	81	from a Confucius Institute or Chinese entity of con-19
82	82	cern. 20

84	84	HOUSAND TALENTS PROGRAM .—The term 21
85	85	‘‘Thousand Talents Program’’ means any techno-22
86	86	logical or educational program funded or adminis-23
87	87	tered by the Chinese Communist Party’s Ministry of 24
88	88	Industry and Information Technology. 25

92	92	(b) RESTRICTIONS ON INSTITUTIONS OF HIGHER 1

94	94	DUCATION.—Beginning with the first fiscal year that be-2
95	95	gins after the date that is 12 months after the date of 3
96	96	the enactment of this Act, the Secretary of Homeland Se-4
97	97	curity shall ensure that an institution of higher education 5
98	98	(referred to in this subsection as an ‘‘institution’’) which 6
99	99	has a relationship with a Confucius Institute, Thousand 7
100	100	Talents Program, or Chinese entity of concern is ineligible 8
101	101	to receive any funds from the Department of Homeland 9
102	102	Security, unless the institution terminates the relationship 10
103	103	between the institution and such Confucius Institute, 11
104	104	Thousand Talents Program, or Chinese entity of concern, 12
105	105	as the case may be. Upon termination of such a relation-13
106	106	ship, the institution at issue shall be eligible to receive 14
107	107	funds from the Department of Homeland Security. 15

109	109	EPORT.—The Secretary of Homeland Security 16
110	110	shall submit to the Committee on Homeland Security of 17
111	111	the House of Representatives and the Committee on 18
112	112	Homeland Security and Governmental Affairs of the Sen-19
113	113	ate a report containing information regarding any institu-20
114	114	tion of higher education that has a relationship with a 21
115	115	Confucius Institute or Chinese entity of concern and re-22
116	116	ceives funds from the Department of Homeland Security. 23
