INVESTIGATION INTO REMAINS OF 5 BABIES DIS-1 COVERED IN WASHINGTON, DC. 2 (a) I NGENERAL.—The Attorney General shall con-3 duct an investigation to determine whether there was a 4 violation of section 1531 of title 18, United States Code, 5 (commonly known as the ‘‘Partial-Birth Abortion Ban Act 6 of 2003’’) in connection with the remains of the 5 babies 7 that were discovered by the D.C. Metropolitan Police De-8 partment on March 30, 2022. 9 (b) R EPORT.—Not later than 6 months after the date 10 of enactment of this Act, the Attorney General shall sub-11 mit to the Congress a report containing a detailed descrip-12 tion of the Attorney General’s investigation conducted 13 under subsection (a) into the circumstances surrounding 14 the deaths of each baby that was recovered, including any 15 enforcement action taken. 16 SEC. 3. REQUIREMENT TO INVESTIGATE VIOLATIONS OF 17 THE PARTIAL-BIRTH ABORTION BAN. 18 Section 1531 of title 18, United States Code, is 19 amended by adding at the end the following: 20 ‘‘(f) The Attorney General shall investigate and take 21 appropriate enforcement action for alleged violations of 22 this section.’’. 23 SEC. 4. REPORT ON VIOLATIONS OF THE PARTIAL-BIRTH 5 ABORTION BAN. 6 Not later than October 1 of each year, the Attorney 7 General shall submit to the Committees on the Judiciary 8 of the House of Representatives and of the Senate, and 9 publish on the website of the Department of Justice, a 10 report that includes the following: 11 (1) A list of steps taken by the Department of 12 Justice to inform abortion providers of their respon-13 sibility to comply with section 1531 of title 18, 14 United States Code. 15 (2) The number of alleged violations of such 16 section during the previous 10-year period, a de-17 scription of all efforts taken by the Department of 18 Justice to investigate such alleged violations, and the 19 number of enforcement actions related to such al-20 leged violations, including any preliminary investiga-21 tion of, prosecution of, and charges filed in connec-22 tion with such alleged violations. 23 VerDate Sep 11 2014 18:08 Feb 28, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H895.IH H895 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 895 IH SEC. 6. GAO REPORT. 1 Not later than 18 months after the date of enactment 2 of this Act, the Comptroller General of the United States 3 shall conduct a review of the enforcement actions taken 4 in connection with alleged violations of section 1531 of 5 title 18, United States Code, during fiscal years 2004 6 through 2024, and submit to the Committees on the Judi-7 ciary of the House of Representatives and of the Senate 8 a report on such review, including any recommendations, 9 particularly with respect strengthening the enforcement of 10 such section, that the Comptroller General determines ap-11 propriate. 12 SEC. 7.
