2525 SECTION 1. SHORT TITLE. 3
2626 This Act may be cited as the ‘‘Ensuring Justice for 4
2727 Victims of Partial-Birth Abortion Act’’. 5

3333 (a) I
3434 NGENERAL.—The Attorney General shall con-3
3535 duct an investigation to determine whether there was a 4
3636 violation of section 1531 of title 18, United States Code, 5
3737 (commonly known as the ‘‘Partial-Birth Abortion Ban Act 6
3838 of 2003’’) in connection with the remains of the 5 babies 7
3939 that were discovered by the D.C. Metropolitan Police De-8
4040 partment on March 30, 2022. 9
4141 (b) R
4242 EPORT.—Not later than 6 months after the date 10
4343 of enactment of this Act, the Attorney General shall sub-11
4444 mit to the Congress a report containing a detailed descrip-12
4545 tion of the Attorney General’s investigation conducted 13
4646 under subsection (a) into the circumstances surrounding 14
4747 the deaths of each baby that was recovered, including any 15
4848 enforcement action taken. 16
4949 SEC. 3. REQUIREMENT TO INVESTIGATE VIOLATIONS OF 17
5050 THE PARTIAL-BIRTH ABORTION BAN. 18
5151 Section 1531 of title 18, United States Code, is 19
5252 amended by adding at the end the following: 20
5353 ‘‘(f) The Attorney General shall investigate and take 21
5454 appropriate enforcement action for alleged violations of 22
5555 this section.’’. 23
5656 SEC. 4. MANDATORY REPORTING OF VIOLATIONS. 24
5757 A health care practitioner or any employee of a hos-25
5858 pital, a physician’s office, or an abortion clinic who has 26

6262 knowledge of a violation of section 1531 of title 18, United 1
6363 States Code, shall immediately report such violation to an 2
6464 appropriate State or Federal law enforcement agency, or 3
6565 to both. 4
6666 SEC. 5. REPORT ON VIOLATIONS OF THE PARTIAL-BIRTH 5
6767 ABORTION BAN. 6
6868 Not later than October 1 of each year, the Attorney 7
6969 General shall submit to the Committees on the Judiciary 8
7070 of the House of Representatives and of the Senate, and 9
7171 publish on the website of the Department of Justice, a 10
7272 report that includes the following: 11
7373 (1) A list of steps taken by the Department of 12
7474 Justice to inform abortion providers of their respon-13
7575 sibility to comply with section 1531 of title 18, 14
7676 United States Code. 15
7777 (2) The number of alleged violations of such 16
7878 section during the previous 10-year period, a de-17
7979 scription of all efforts taken by the Department of 18
8080 Justice to investigate such alleged violations, and the 19
8181 number of enforcement actions related to such al-20
8282 leged violations, including any preliminary investiga-21
8383 tion of, prosecution of, and charges filed in connec-22
8484 tion with such alleged violations. 23

8989 Not later than 18 months after the date of enactment 2
9090 of this Act, the Comptroller General of the United States 3
9191 shall conduct a review of the enforcement actions taken 4
9292 in connection with alleged violations of section 1531 of 5
9393 title 18, United States Code, during fiscal years 2004 6
9494 through 2024, and submit to the Committees on the Judi-7
9595 ciary of the House of Representatives and of the Senate 8
9696 a report on such review, including any recommendations, 9
9797 particularly with respect strengthening the enforcement of 10
9898 such section, that the Comptroller General determines ap-11
9999 propriate. 12
100100 SEC. 7. SEVERABILITY. 13
101101 If any provision of this Act, an amendment made by 14
102102 this Act, or the application of such provision or amend-15
103103 ment to any person or circumstance is held to be unconsti-16
104104 tutional, the remainder of this Act, the amendments made 17
105105 by this Act, and the application of such to any other per-18
106106 son or circumstance shall not be affected thereby. 19
