2525 This Act may be cited as the ‘‘Expanding Access to 4

3030 SEC. 2. AUTHORIZATION AND DISTRIBUTION OF FUNDS. 1

3232 UTHORIZATION OF APPROPRIATIONS.—There 2
3333 are authorized to be appropriated to carry out this Act 3
3434 such sums as may be necessary for each of fiscal years 4
3535 2026 through 2030. 5
3636 (b) D
3737 ISTRIBUTION OF FUNDS.—Of the amounts 6
3838 made available under subsection (a) for a fiscal year, the 7
3939 Secretary shall— 8
4040 (1) use 80 percent to award or renew grants, 9
4141 as applicable, to State educational agencies to award 10
4242 subgrants to local educational agencies in accord-11
4343 ance with section 4; 12
4444 (2) use 10 percent to coordinate and support 13
4545 the development of a nationwide tutoring workforce 14
4646 in accordance with section 7; 15
4747 (3) allocate 5 percent to State educational 16
4848 agencies receiving a grant under this Act to carry 17
4949 out evaluation activities under section 6(b)(4); and 18
5050 (4) allocate 5 percent to the Advisory Board to 19
5151 carry out the activities required under section 5. 20
5252 SEC. 3. HIGH-IMPACT TUTORING GRANT PROGRAM ESTAB-21
5353 LISHED. 22
5454 (a) I
5555 NGENERAL.—For the purpose of improving the 23
5656 academic achievement and recovery of students, as defined 24
5757 by each State educational agency’s academic standards 25
5858 pursuant to section 1111 of part A of title I of the Ele-26

6363 6311 et seq.), the Secretary of Education shall award 2
6464 grants to each State educational agency with an approved 3
6565 application under subsection (b). 4
6666 (b) A
6767 PPLICATION.—A State educational agency seek-5
6868 ing a grant under this section shall submit to the Sec-6
6969 retary and the Advisory Board an application each year 7
7070 in such form and containing such information as the Sec-8
7171 retary may require, and which shall include the applica-9
7272 tions and plans submitted by local educational agencies 10
7373 to State educational agencies during that year, during 11
7474 which time such applications and plans will be approved 12
7575 by the Secretary and Advisory Board. 13

7777 RANTAMOUNTS.—Of the total amount made 14
7878 available for a fiscal year pursuant to section 2(b)(1), the 15
7979 Secretary shall award to each State educational agency a 16
8080 grant in an amount that bears the same proportion to 17
8181 such total amount as— 18
8282 (1) the amount that such agency received under 19
8383 part A of title I of the Elementary and Secondary 20
8484 Education Act of 1965 (20 U.S.C. 6311 et seq.) for 21
8585 the fiscal year immediately preceding the fiscal year 22
8686 in which such grant is awarded; bears to 23
8787 (2) the total amount allocated under part A of 24
8888 title I of the Elementary and Secondary Education 25

9494 SEC. 4. SUBGRANTS TO LOCAL EDUCATIONAL AGENCIES. 3
9595 (a) I
9696 NGENERAL.—A State educational agency that 4
9797 receives a grant under section 3 shall award, on a competi-5
9898 tive basis and in coordination with the Advisory Board, 6
9999 subgrants to local educational agencies served by such 7
100100 State educational agency for the implementation, adminis-8
101101 tration, and evaluation of tutoring programs in elementary 9
102102 and secondary schools. 10
103103 (b) P
104104 RIORITY.—In awarding subgrants under this 11
105105 section, a State educational agency shall prioritize local 12
106106 educational agencies, in coordination with the Advisory 13
107107 Board, based upon— 14
108108 (1) the number or percentage of students eligi-15
109109 ble for services under title I of the Elementary and 16
110110 Secondary Education Act (20 U.S.C. 1001 et seq.) 17
111111 that will be served by the tutoring programs; 18
112112 (2) the level of decline in students’ academic 19
113113 achievement, relative to each State educational agen-20
114114 cy’s academic standards pursuant to section 1111 of 21
115115 part A of title I of the Elementary and Secondary 22
116116 Education Act of 1965 (20 U.S.C. 6311 et seq.), 23
117117 since the declaration of COVID–19 as a nationwide 24
118118 Public Health Emergency on January 31, 2020; 25

123123 grams as described in the plan submitted under sub-2
124124 section (c)(2), including— 3
125125 (A) the number of hours of tutoring per 4
126126 school day; and 5
127127 (B) number of days of tutoring per week 6
128128 during the school year; and 7
129129 (4) whether the local educational agency has al-8
130130 located American Rescue Plan Elementary and Sec-9
131131 ondary School Emergency Relief Fund funding to 10
132132 tutoring programs that have demonstrated signifi-11
133133 cant results in improving student achievement, with 12
134134 prioritization for local educational agencies that have 13
135135 implemented proven programs using American Res-14
136136 cue Plan Elementary and Secondary School Emer-15
137137 gency Relief Fund funds. 16

139139 PPLICATION.— 17

141141 PPLICATION.—A local educational agency 18
142142 seeking a subgrant under this section shall submit to 19
143143 the State educational agency an application in such 20
144144 form, at such time, and containing such information 21
145145 as the State educational agency and Advisory Board 22
146146 determines appropriate, including the plan described 23
147147 in paragraph (2). 24

152152 (1) shall include the following: 2
153153 (A) How subgrant funds will be used to 3
154154 implement tutoring programs that meet the re-4
155155 quirements of section 6(b). 5
156156 (B) If such tutoring programs will not be 6
157157 implemented in all elementary and secondary 7
158158 schools served by the local educational agency, 8
159159 the schools in which such agency plans to im-9
160160 plement such programs. 10
161161 (C) If such tutoring programs will not 11
162162 serve each grade level in an elementary and sec-12
163163 ondary school, which such grade levels will be 13
164164 served by such programs. 14
165165 (D) How such tutoring programs will be 15
166166 administered, including— 16
167167 (i) the number of hours of tutoring 17
168168 per school day and number of days of tu-18
169169 toring per week during the school year, in-19
170170 cluding— 20
171171 (I) how such tutoring programs 21
172172 will structure the timing of their ses-22
173173 sions to fit at least 30 minutes of tu-23
174174 toring per student for at least 3 days 24
175175 per week into student schedules; or 25

182182 use an alternative timing format be-4
183183 cause of scheduling or labor con-5
184184 straints, as applicable; and 6
185185 (ii) a plan to— 7
186186 (I) ensure maintenance of the 3- 8
187187 to-1 student-to-tutor ratio or ratio de-9
188188 termined by the Advisory Board; or 10
189189 (II) request approval from the 11
190190 Advisory Board, in coordination with 12
191191 the State educational agency, to main-13
192192 tain a different student-to-teacher 14
193193 ratio. 15
194194 (E) The qualifications of tutors (including 16
195195 teachers, paraprofessionals, or volunteers from 17
196196 a government or nonprofit service organization) 18
197197 and subjects taught (including math, reading, 19
198198 or both). 20
199199 (F) A plan to— 21
200200 (i) not fewer than 2 times per month, 22
201201 provide, in coordination with the Advisory 23
202202 Board, training and professional develop-24
203203 ment for tutors; and 25

208208 ensure that each tutor is observed by a 2
209209 program administrator. 3
210210 (G) Whether the tutoring programs will be 4
211211 run by the local educational agency or in part-5
212212 nership with a nonprofit provider, including, in 6
213213 the case of such a partnership— 7
214214 (i) identifying and submitting the 8
215215 nonprofit provider to the Advisory Board 9
216216 for approval, in coordination with the State 10
217217 educational agency, including with respect 11
218218 to how— 12
219219 (I) the nonprofit provider was se-13
220220 lected; and 14
221221 (II) such provider will partner 15
222222 with the local educational agency to 16
223223 carry out the tutoring program; and 17
224224 (ii) a plan to carry out the tutoring 18
225225 program if the nonprofit provider is not 19
226226 approved by the Advisory Board, in coordi-20
227227 nation with the State educational agency. 21
228228 (H) How such tutoring programs will be 22
229229 designed to improve the academic achievement 23
230230 and recovery of students, as defined by each 24
231231 State educational agency’s academic standards 25

238238 (I) How the local educational agency, in 4
239239 coordination with the State educational agency, 5
240240 will partner with a government or nonprofit re-6
241241 search organization or researchers to evaluate 7
242242 the impact of the tutoring programs on aca-8
243243 demic achievement and recovery of students, as 9
244244 defined by each State educational agency’s aca-10
245245 demic standards pursuant to section 1111 of 11
246246 part A of title I of the Elementary and Sec-12
247247 ondary Education Act of 1965 (20 U.S.C. 6311 13
248248 et seq.), including identifying and submitting 14
249249 the organization or researchers to the Advisory 15
250250 Board for approval. 16
251251 (J) How the local educational agency will 17
252252 partner with State and local educator unions to 18
253253 bargain, or where bargaining is not permitted, 19
254254 collaborate, over any workplace-related issues or 20
255255 outcomes related to the implementation of a tu-21
256256 toring program in the elementary or secondary 22
257257 school at which members of such union are 23
258258 working, including educator responsibilities and 24
259259 compensation. 25

267267 N GENERAL.—A subgrant awarded under 3
268268 this Act shall be for a period of 4 years. 4

270270 NNUAL ALLOCATION OF SUBGRANT 5
271271 FUNDS.—Subgrant funds awarded to a local edu-6
272272 cational agency under this section for the subgrant 7
273273 period described in paragraph (1) shall be allocated 8
274274 to such agency— 9
275275 (A) in equal amounts for each year of such 10
276276 period; and 11
277277 (B) with respect to each year in the grant 12
278278 period following the first year of such period, in 13
279279 accordance with paragraph (3). 14

281281 NNUAL REPORT.— 15

283283 EPORT REQUIRED.— 16

285285 N GENERAL.—In order to receive 17
286286 the annual allocation under paragraph (2) 18
287287 for any year described in subparagraph 19
288288 (B) of such paragraph, a local educational 20
289289 agency shall submit to the State edu-21
290290 cational agency, at the conclusion of each 22
291291 year of such subgrant period, an annual 23
292292 report containing a compilation of the 24
293293 monthly reports submitted to the State 25

300300 XCEPTION.—In the case of a 3
301301 local educational agency that received an 4
302302 annual allocation for a year during such 5
303303 subgrant period after submitting an up-6
304304 dated plan under clauses (i) or (ii) of sub-7
305305 paragraph (C), such agency shall not, with 8
306306 respect to the monthly report for a month 9
307307 during which such agency awaited approval 10
308308 by the Secretary of such updated plan and 11
309309 did not have access to such annual alloca-12
310310 tion, be required to— 13
311311 (I) submit such report to the 14
312312 State educational agency or Advisory 15
313313 Board under section 6(b)(5); or 16
314314 (II) include such report in the 17
315315 annual report under clause (i) for 18
316316 such year. 19

322322 Board, shall review the annual report sub-23
323323 mitted under subparagraph (A)(i) for such 24

344344 comes, the State educational agency 16
345345 shall make available to the local edu-17
346346 cational agency the annual allocation 18
347347 for such year; or 19
348348 (II) not improving such student 20
349349 outcomes, the State educational agen-21
350350 cy shall direct the local educational 22
351351 agency to submit an updated plan in 23
352352 accordance with subparagraph (C). 24

426426 dent outcomes, the local educational 10
427427 agency shall, not later than 3 months 11
428428 after the date of the submission of 12
429429 such updated plan— 13
430430 (aa) make changes, in co-14
431431 ordination with the State edu-15
432432 cational agency and Advisory 16
433433 Board, to the tutoring design de-17
434434 scribed in such updated plan to 18
435435 ensure that such tutoring design 19
436436 will improve such student out-20
437437 comes; and 21
438438 (bb) resubmit such updated 22
439439 plan to the State educational 23
440440 agency. 24

445445 State educational agency, in coordina-2
446446 tion with the Advisory Board, makes 3
447447 a determination that the tutoring pro-4
448448 gram design described in such resub-5
449449 mitted plan— 6
450450 (aa) will improve such stu-7
451451 dent outcomes, the State edu-8
452452 cational agency shall make avail-9
453453 able to the local educational 10
454454 agency the annual allocation for 11
455455 such year; or 12
456456 (bb) will not improve such 13
457457 student outcomes, the State edu-14
458458 cational agency shall declare such 15
459459 agency ineligible to receive an an-16
460460 nual allocation for the remainder 17
461461 of the subgrant period. 18
462462 (iii) N
463463 EW APPLICATION.—A local edu-19
464464 cational agency that is declared ineligible 20
465465 to receive an annual allocation for the re-21
466466 mainder of a grant period under clause 22
467467 (ii)(II)(bb) may, at any point after the 23
468468 conclusion of such grant period, submit an 24

477477 N GENERAL.—The State educational agen-4
478478 cy shall, at the conclusion of the subgrant period de-5
479479 scribed in subsection (d)(1), renew a subgrant for a 6
480480 local educational agency that— 7
481481 (A) submits an application described in 8
482482 paragraph (2); 9
483483 (B) was not declared ineligible to receive 10
484484 annual allocations under subsection 11
485485 (d)(3)(C)(ii)(II)(bb) during such grant period; 12
486486 and 13
487487 (C) the State educational agency, in co-14
488488 ordination with the Advisory Board, determines, 15
489489 based on such application, is sufficiently car-16
490490 rying out tutoring programs that meet the re-17
491491 quirements under section 6(b). 18
492492 (2) A
493493 PPLICATION.—At the conclusion of the 19
494494 subgrant period described in subsection (d)(1), a 20
495495 local educational agency seeking renewal of a 21
496496 subgrant awarded under this section may submit to 22
497497 the State educational agency an application that in-23
498498 cludes— 24

508508 UPPLEMENTNOTSUPPLANT.—Subgrant funds 6
509509 awarded under this section shall supplement, not supplant, 7
510510 other Federal or State funds available to carry out activi-8
511511 ties described in this section. 9

542542 quirements under section 6(b) and will imple-10
543543 ment programs so as to have the greatest im-11
544544 pact on student academic outcomes, including 12
545545 by considering— 13
546546 (i) the quality and appropriateness of 14
547547 the instructional method; and 15
548548 (ii) the degree to which instructional 16
549549 choices are supported by evidence or are 17
550550 appropriate to the setting, such as using 18
551551 virtual tutoring when in-person tutoring is 19
552552 not feasible; and 20
553553 (B) will conduct evaluations of the tutoring 21
554554 programs in partnership with State educational 22
555555 agencies and government or nonprofit research 23
556556 organizations or researchers. 24

569569 cy requesting to partner with a nonprofit pro-10
570570 vider to implement tutoring programs, rec-11
571571 ommendations for such nonprofit providers; and 12
572572 (D) best practices for the establishment 13
573573 and administration of tutoring programs and 14
574574 implementation of such programs by local edu-15
575575 cational agencies and not in partnership with 16
576576 nonprofit providers. 17
577577 (3) Review and issue, in coordination with State 18
578578 educational agencies, a decision with respect to— 19
579579 (A) a request by a local educational agency 20
580580 under section 4(c)(2)(D)(i)(II) to maintain an 21
581581 alternative timing format, approving such re-22
582582 quest only if available evidence supports that al-23
583583 ternative format as likely to be effective in 24
584584 boosting student outcomes; 25

622622 at the time of assessment, the student-to-tutor 7
623623 ratio; and 8
624624 (B) on a program-by-program basis and 9
625625 based on the effectiveness, evaluation status, 10
626626 and number of years of existence of such pro-11
627627 gram, the required frequency of tutor trainings, 12
628628 professional development, and observation. 13
629629 (7) Develop and publish, based on the evalua-14
630630 tions of tutoring programs under section 6(b)(4) and 15
631631 outside evaluations and studies of such tutoring pro-16
632632 grams, a database of— 17
633633 (A) different tutoring methods and the im-18
634634 pact of each such method on the academic 19
635635 achievement and recovery of students as defined 20
636636 by each State educational agency’s academic 21
637637 standards pursuant to section 1111 of part A 22
638638 of title I of the Elementary and Secondary 23
639639 Education Act of 1965 (20 U.S.C. 6311 et 24
640640 seq.); and 25

665665 use such subgrant funds to implement tutoring pro-20
666666 grams that meet the requirements described in sub-21

668668 served by such State educational agency. 23

670670 ONPROFIT PROVIDER .—A local edu-24
671671 cational agency shall have the option of partnering 25

681681 high-quality tutoring programs. Local educational 7
682682 agencies will be required to develop a long-term plan 8
683683 to operate tutoring programs without a nonprofit 9
684684 provider and taught by licensed elementary or sec-10
685685 ondary school teachers or paraprofessionals, with an 11
686686 exemption available if the local educational agency 12
687687 certifies and the State educational agency approves 13
688688 that it is unable to run such a program without a 14
689689 nonprofit due to labor shortages. 15

694694 local educational agency pursuant to subsection (a) 18

697697 at least 30 minutes during the school day and 21
698698 for at least 3 days per week during the school 22
699699 year; 23
700700 (B) taught by a compensated licensed ele-24
701701 mentary or secondary school teacher or para-25

717717 (E) that, with respect to a student, is re-13
718718 lated to and aligned with the classwork in the 14
719719 student’s regular classes. 15

721721 RAINING AND OBSERVATION .—A program 16
722722 carried out by a local educational agency pursuant 17
723723 to subsection (a) shall— 18
724724 (A) not fewer than 2 times per month and 19
725725 in coordination with the State educational agen-20
726726 cy and Advisory Board, provide training and 21
727727 professional development for tutors. 22
728728 (B) not fewer than 1 time per month, en-23
729729 sure that each tutor is observed by a program 24

747747 gram is not improving student outcomes, the 12
748748 program’s updated plan under section 13
749749 4(d)(3)(C)(i) must include a plan to transition 14
750750 to in-person tutoring for that program. 15

752752 VALUATIONS.—A program carried out by 16
753753 a local educational agency pursuant to subsection (a) 17
754754 shall, not less than 1 time per subgrant period de-18
755755 scribed in section 4(d)(1), partner with a govern-19
756756 ment or nonprofit research organization, subject to 20
757757 approval from the Advisory Board in coordination 21
758758 with the State educational agency, to evaluate the 22
759759 impact of the tutoring programs on the academic 23
760760 achievement and recovery of students, as defined by 24
761761 each State educational agency’s academic standards 25

784784 SEC. 7. NATIONWIDE TUTORING WORKFORCE. 19

788788 ceiving a grant under this Act, institutions of higher edu-22
789789 cation, government or nonprofit service organizations, and 23
790790 State and local workforce boards, shall develop a nation-24
791791 wide tutoring workforce. 25

800800 Secondary Education Act (20 U.S.C. 1001 et seq.). 6
801801 (2) Provide, in consultation with States, fund-7
802802 ing to institutions of higher education and State and 8
803803 local workforce boards to create a tutoring workforce 9
804804 that meets the staffing needs identified in paragraph 10
805805 (1) by recruiting and training additional teachers, 11
806806 paraprofessionals, and volunteers working within a 12
807807 government or nonprofit service organization. 13
808808 (3) Provide, in consultation with States, fund-14
809809 ing to local educational agencies to implement Grow 15
810810 Your Own programs, through which school districts, 16
811811 community-based organizations, and colleges partner 17
812812 to recruit and train community members as edu-18
813813 cators, to develop locally-driven tutor workforces 19
814814 under which local educational agencies will recruit 20
815815 and provide workforce development training for— 21
816816 (A) community members; and 22
817817 (B) school staff members that are not tu-23
818818 tors, provided that— 24

831831 service organizations such as AmeriCorps to recruit 10
832832 and train volunteers to work in tutoring programs in 11
833833 local educational agencies with teacher and para-12
834834 professional shortages. 13
835835 (5) Coordinate with institutions of higher edu-14
836836 cation and State and local educational agencies to 15
837837 recruit and train students at institutions of higher 16
838838 education who are studying to pursue a career in 17
839839 education to work for tutoring programs in local 18
840840 educational agencies with teacher and paraprofes-19
841841 sional shortages. 20
842842 (6) Develop and administer a pilot program to 21
843843 provide funding for training and compensation of 22
844844 graduates from institutions of higher education if 23
845845 such graduates commit to tutoring for at least 2 24
846846 years in schools receiving funds under title I of the 25

856856 terms and conditions of employment of any local edu-6
857857 cational agency employee, then before the subgrant is 7
858858 awarded such program must be agreed to through bar-8
859859 gaining, or where bargaining does not exist, through col-9
860860 laboration with the State or local educator union, with the 10
861861 Secretary working to mediate any disputes if an agree-11
862862 ment cannot be reached. 12
863863 (b) C
864864 ONFLICTS.—In the event that any requirements 13
865865 under this Act conflict with the rights, remedies, and pro-14
866866 cedures afforded to school or local educational agency em-15
867867 ployees under Federal, State, or local laws (including ap-16
868868 plicable regulations or court orders or requirements that 17
869869 local educational agencies negotiate or meet and confer in 18
870870 good faith) or under the terms of collective bargaining 19
871871 agreements, memoranda of understanding, or other agree-20
872872 ments between such school or local educational agency and 21
873873 their employees, the latter shall control, and compliance 22
874874 with the latter will not provide a basis for withholding 23
875875 funds under this law. 24
