86	86	LLOTTEE.—The term ‘‘allottee’’ means an 19
87	87	individual who holds a beneficial real property inter-20
88	88	est in an allotment of Indian land that is— 21
89	89	(A) located within the Reservation; and 22
90	90	(B) held in trust by the United States. 23

354	354	pact does not conflict with this title, the Secretary 7
355	355	shall execute the Compact, including all appendices 8
356	356	to, or parts of, the Compact requiring the signature 9
357	357	of the Secretary. 10

359	359	ODIFICATIONS.—Nothing in this title pre-11
360	360	cludes the Secretary from approving any modifica-12
361	361	tion to an appendix to the Compact that is con-13
362	362	sistent with this title, to the extent that the modi-14
363	363	fication does not otherwise require congressional ap-15
364	364	proval under section 2116 of the Revised Statutes 16
365	365	(25 U.S.C. 177) or any other applicable provision of 17
366	366	Federal law. 18

368	368	NVIRONMENTAL COMPLIANCE.— 19

370	370	N GENERAL.—In implementing the Com-20
371	371	pact and this title, the Secretary shall comply with 21
372	372	all applicable provisions of— 22
373	373	(A) the Endangered Species Act of 1973 23
374	374	(16 U.S.C. 1531 et seq.); 24

387	387	Compact and this title, the Fort Belknap In-8
388	388	dian Community shall prepare any necessary 9
389	389	environmental documents, except for any envi-10
390	390	ronmental documents required under section 11
391	391	108, consistent with all applicable provisions 12
392	392	of— 13
393	393	(i) the Endangered Species Act of 14
394	394	1973 (16 U.S.C. 1531 et seq.); 15
395	395	(ii) the National Environmental Policy 16
396	396	Act of 1969 (42 U.S.C. 4231 et seq.), in-17
397	397	cluding the implementing regulations of 18
398	398	that Act; and 19
399	399	(iii) all other applicable Federal envi-20
400	400	ronmental laws and regulations. 21
401	401	(B) A
402	402	UTHORIZATIONS.—The Secretary 22
403	403	shall— 23

413	413	FFECT OF EXECUTION .—The execution of 6
414	414	the Compact by the Secretary under this section 7
415	415	shall not constitute a major Federal action for pur-8
416	416	poses of the National Environmental Policy Act of 9
417	417	1969 (42 U.S.C. 4321 et seq.). 10
418	418	(4) C
419	419	OSTS.—Any costs associated with the per-11
420	420	formance of the compliance activities described in 12
421	421	paragraph (2) shall be paid from funds deposited in 13
422	422	the Trust Fund, subject to the condition that any 14
423	423	costs associated with the performance of Federal ap-15
424	424	proval or other review of such compliance work or 16
425	425	costs associated with inherently Federal functions 17
426	426	shall remain the responsibility of the Secretary. 18
427	427	SEC. 105. TRIBAL WATER RIGHTS. 19

429	429	ONFIRMATION OFTRIBALWATERRIGHTS.— 20

431	431	N GENERAL.—The Tribal water rights are 21
432	432	ratified, confirmed, and declared to be valid. 22

434	434	SE.—Any use of the Tribal water rights 23
435	435	shall be subject to the terms and conditions of the 24
436	436	Compact and this title. 25

444	444	NTENT OFCONGRESS.—It is the intent of Con-4
445	445	gress to provide to each allottee benefits that are equiva-5
446	446	lent to, or exceed, the benefits the allottees possess on the 6
447	447	day before the date of enactment of this Act, taking into 7
