6363 SECTION 1. SHORT TITLE. 3
6464 This Act may be cited as the ‘‘National Origin-Based 4
6565 Antidiscrimination for Nonimmigrants Act’’ or the ‘‘NO 5
6666 BAN Act’’. 6
6767 SEC. 2. EXPANSION OF NONDISCRIMINATION PROVISION. 7
6868 Section 202(a)(1)(A) of the Immigration and Nation-8
6969 ality Act (8 U.S.C. 1152(a)(1)(A)) is amended— 9
7070 (1) by striking ‘‘Except as specifically provided 10
7171 in paragraph (2) and in sections 101(a)(27), 11
7272 201(b)(2)(A)(i), and 203, no’’ and inserting ‘‘No’’; 12
7373 (2) by inserting ‘‘or a nonimmigrant visa, ad-13
7474 mission or other entry into the United States, or the 14
7575 approval or revocation of any immigration benefit’’ 15
7676 after ‘‘immigrant visa’’; 16
7777 (3) by inserting ‘‘religion,’’ after ‘‘sex,’’; and 17
7878 (4) by inserting before the period at the end the 18

9797 N GENERAL.—Subject to paragraph (2), 10
9898 if the Secretary of State, in consultation with the 11
9999 Secretary of Homeland Security, determines, based 12
100100 on specific and credible facts, that the entry of any 13
101101 aliens or any class of aliens into the United States 14
102102 would undermine the security or public safety of the 15
103103 United States or the preservation of human rights, 16
104104 democratic processes or institutions, or international 17
105105 stability, the President may temporarily— 18
106106 ‘‘(A) suspend the entry of such aliens or 19
107107 class of aliens as immigrants or nonimmigrants; 20
108108 or 21
109109 ‘‘(B) impose any restrictions on the entry 22
110110 of such aliens that the President deems appro-23
111111 priate. 24

115115 ‘‘(2) LIMITATIONS.—In carrying out paragraph 1
116116 (1), the President, the Secretary of State, and the 2
117117 Secretary of Homeland Security shall— 3
118118 ‘‘(A) only issue a suspension or restriction 4
119119 when required to address specific acts impli-5
120120 cating a compelling government interest in a 6
121121 factor identified in paragraph (1); 7
122122 ‘‘(B) narrowly tailor the suspension or re-8
123123 striction, using the least restrictive means, to 9
124124 achieve such compelling government interest; 10
125125 ‘‘(C) specify the duration of the suspension 11
126126 or restriction; 12
127127 ‘‘(D) consider waivers to any class-based 13
128128 restriction or suspension and apply a rebuttable 14
129129 presumption in favor of granting family-based 15
130130 and humanitarian waivers; and 16
131131 ‘‘(E) comply with all provisions of this Act. 17

133133 ONGRESSIONAL NOTIFICATION .— 18
134134 ‘‘(A) I
135135 N GENERAL.—Prior to the President 19
136136 exercising the authority under paragraph (1), 20
137137 the Secretary of State and the Secretary of 21
138138 Homeland Security shall consult Congress and 22
139139 provide Congress with specific evidence sup-23
140140 porting the need for the suspension or restric-24
141141 tion and its proposed duration. 25

146146 than 48 hours after the President exercises the 2
147147 authority under paragraph (1), the Secretary of 3
148148 State and the Secretary of Homeland Security 4
149149 shall provide a briefing and submit a written re-5
150150 port to Congress that describes— 6
151151 ‘‘(i) the action taken pursuant to 7
152152 paragraph (1) and the specified objective 8
153153 of such action; 9
154154 ‘‘(ii) the estimated number of individ-10
155155 uals who will be impacted by such action; 11
156156 ‘‘(iii) the constitutional and legislative 12
157157 authority under which such action took 13
158158 place; and 14
159159 ‘‘(iv) the circumstances necessitating 15
160160 such action, including how such action 16
161161 complies with paragraph (2), as well as 17
162162 any intelligence informing such actions. 18
163163 ‘‘(C) T
164164 ERMINATION.—If the briefing and 19
165165 report described in subparagraph (B) are not 20
166166 provided to Congress during the 48 hours that 21
167167 begin when the President exercises the author-22
168168 ity under paragraph (1), the suspension or re-23
169169 striction shall immediately terminate absent in-24
170170 tervening congressional action. 25

213213 REATMENT OF COMMERCIAL AIRLINES .— 7
214214 Whenever the Secretary of Homeland Security finds 8
215215 that a commercial airline has failed to comply with 9
216216 regulations of the Secretary of Homeland Security 10
217217 relating to requirements of airlines for the detection 11
218218 of fraudulent documents used by passengers trav-12
219219 eling to the United States (including the training of 13
220220 personnel in such detection), the Secretary of Home-14
221221 land Security may suspend the entry of some or all 15
222222 aliens transported to the United States by such air-16
223223 line. 17

225225 ULE OF CONSTRUCTION .—Nothing in 18
226226 this section may be construed as authorizing the 19
227227 President, the Secretary of State, or the Secretary 20
228228 of Homeland Security to act in a manner incon-21
229229 sistent with the policy decisions expressed in the im-22
230230 migration laws.’’. 23

240240 Homeland Security and the heads of other relevant 4
241241 Federal agencies, shall submit a report to the con-5
242242 gressional committees referred to in section 6
243243 212(f)(3)(D) of the Immigration and Nationality 7
244244 Act, as amended by section 3 of this Act, that de-8
245245 scribes the implementation of Presidential Proclama-9
246246 tions 9645, 9822, and 9983 and Executive Order 10
247247 Nos. 13769, 13780, and 13815, during the effective 11
248248 period of each such proclamation and order. 12
249249 (2) P
250250 RESIDENTIAL PROCLAMATION 9645 AND 13
251251 9983.—In addition to the content described in para-14
252252 graph (1), the report submitted with respect to Pres-15
253253 idential Proclamation 9645, issued on September 24, 16
254254 2017, and Presidential Proclamation 9983, issued 17
255255 on January 31, 2020, shall include, for each country 18
256256 listed in such proclamation— 19
257257 (A) the total number of individuals who 20
258258 applied for a visa during the time period the 21
259259 proclamation was in effect, disaggregated by 22
260260 country and visa category; 23
261261 (B) the total number of visa applicants de-24
262262 scribed in subparagraph (A) who were ap-25

278278 a waiver, disaggregated by country and visa 13

280280 (F) the total number of visa applicants de-15
281281 scribed in subparagraph (A) who were denied a 16
282282 waiver, disaggregated by country and visa cat-17
283283 egory, and the reasons such waiver requests 18
284284 were denied; 19
285285 (G) the total number of refugees admitted, 20
286286 disaggregated by country; and 21
287287 (H) the complete reports that were sub-22
288288 mitted to the President every 180 days in ac-23
289289 cordance with section 4 of Presidential Procla-24

299299 ality Act (8 U.S.C. 1182(f)), as amended by section 3 of 6
300300 this Act, and every 30 days thereafter, the Secretary of 7
301301 State, in coordination with the Secretary of Homeland Se-8
302302 curity and heads of other relevant Federal agencies, shall 9
303303 submit a report to the congressional committees referred 10
304304 to in paragraph (3)(D) of such section 212(f) that identi-11
305305 fies, with respect to countries affected by a suspension or 12
306306 restriction, the information described in subparagraphs 13
307307 (A) through (G) of subsection (a)(2) of this section and 14
308308 the specific evidence supporting the need for the continued 15
309309 exercise of presidential authority under such section 16
310310 212(f), including the information described in paragraph 17
311311 (3)(B) of such section 212(f). If the report described in 18
312312 this subsection is not provided to such congressional com-19
313313 mittees in the time specified, the suspension or restriction 20
314314 shall immediately terminate absent intervening congres-21
315315 sional action. A final report with such information shall 22
316316 be prepared and submitted to such congressional commit-23
317317 tees not later than 30 days after the suspension or restric-24
318318 tion is lifted. 25
