6262 This Act may be cited as the ‘‘Stop the Wait Act of 4

6464 SEC. 2. ELIMINATION OF DISABILITY WAITING PERIOD FOR 6
6565 SOCIAL SECURITY DISABILITY INSURANCE 7

6969 ABILITYINSURANCEBENEFITS.—Section 223 of the So-10
7070 cial Security Act (42 U.S.C. 423) is amended— 11
7171 (1) in subsection (a)— 12
7272 (A) in paragraph (1), in the matter fol-13
7373 lowing subparagraph (E)— 14
7474 (i) by striking ‘‘disability insurance 15
7575 benefit (i) for each month’’ and all that 16
7676 follows through ‘‘, or (iii)’’ and inserting 17
7777 ‘‘disability insurance benefit’’; and 18
7878 (ii) by striking ‘‘, but only if’’ and all 19

123123 ABILITYINSURANCEBENEFITS.—For purposes of appli-9
124124 cations for disability insurance benefits filed on or after 10
125125 the date of enactment of this Act and before January 1, 11
126126 2030, section 223(c)(2) of the Social Security Act (42 12
127127 U.S.C. 423(c)(2)) shall be applied by making the following 13
128128 substitutions: 14
129129 (1) For applications filed in calendar years 15
130130 2025, 2026, or 2027, substitute ‘‘three’’ for ‘‘five’’ 16
131131 and ‘‘fifteenth’’ for ‘‘seventeenth’’ each place it ap-17
132132 pears. 18
133133 (2) For applications filed in calendar year 19
134134 2028, substitute ‘‘two’’ for ‘‘five’’ and ‘‘fourteenth’’ 20
135135 for ‘‘seventeenth’’ each place it appears. 21
136136 (3) For applications filed in calendar year 22
137137 2029, substitute ‘‘one’’ for ‘‘five’’ and ‘‘thirteenth’’ 23

167167 ‘‘(j)(1) For purposes of applying this section in the 22
168168 case of an eligible individual described in paragraph (2), 23
169169 the following special rules shall apply: 24

175175 ment to benefits, or status, for a period of 24 3
176176 months prior to receiving such benefits or sta-4

178178 ‘‘(B) The entitlement under such sub-6
179179 section shall be available retroactively to the 7
180180 first day of the first month (rather than twen-8
181181 ty-fifth month) of entitlement or status. 9
182182 ‘‘(C) Subsection (f) shall not be applied. 10
183183 ‘‘(2) For purposes of applying this section, an 11
184184 ‘eligible individual’ is an individual, with respect to 12
185185 a month— 13
186186 ‘‘(A) who has not yet attained the age of 14
187187 65; 15
188188 ‘‘(B) who is entitled to benefits described 16
189189 in subparagraph (A) of subsection (b)(2); and 17
190190 ‘‘(C) with respect to whom section 18
191191 5000A(e)(1)(A) of the Internal Revenue Code 19
192192 of 1986 would apply if the reference to ‘8 per-20
193193 cent’ in such section were a reference to ‘8.5 21
194194 percent’.’’. 22

217217 ‘‘(o)(1) In applying this section in the case of an eligi-14
218218 ble individual who is entitled to benefits under part A pur-15
219219 suant to the operation of section 226(j), the following spe-16
220220 cial rules shall apply: 17
221221 ‘‘(A) The initial enrollment period under 18
222222 subsection (d) shall begin on the first day of the 19
223223 first month in which the individual satisfies the 20
224224 requirement of section 1836(a)(1). 21
225225 ‘‘(B) In applying subsection (g)(1), the ini-22
226226 tial enrollment period shall begin on the first 23
227227 day of the first month of entitlement to dis-24

233233 ‘‘(2) In applying this section in the case of an 3
234234 individual who became entitled to benefits under 4
235235 part A, but had not been entitled to such benefits 5
236236 for a period of 24 calendar months as of the date 6
237237 of enactment of the Stop the Wait Act of 2025, and 7
238238 is entitled to such benefits pursuant to the applica-8
239239 tion of section 226(j), the initial enrollment period 9
240240 under subsection (d) for such individual shall begin 10
241241 on the first day of the first month following the date 11
242242 of enactment of the Stop the Wait Act of 2025 and 12
243243 shall end seven months later.’’. 13
