60	60	tives of the United States of America in Congress assembled, 2
61	61	SECTION 1. SHORT TITLE. 3
62	62	This Act may be cited as the ‘‘Stop the Wait Act of 4
63	63	2025’’. 5
64	64	SEC. 2. ELIMINATION OF DISABILITY WAITING PERIOD FOR 6
65	65	SOCIAL SECURITY DISABILITY INSURANCE 7
66	66	BENEFITS. 8

68	68	LIMINATION OF WAITINGPERIOD FORDIS-9
69	69	ABILITYINSURANCEBENEFITS.—Section 223 of the So-10
70	70	cial Security Act (42 U.S.C. 423) is amended— 11
71	71	(1) in subsection (a)— 12
72	72	(A) in paragraph (1), in the matter fol-13
73	73	lowing subparagraph (E)— 14
74	74	(i) by striking ‘‘disability insurance 15
75	75	benefit (i) for each month’’ and all that 16
76	76	follows through ‘‘, or (iii)’’ and inserting 17
77	77	‘‘disability insurance benefit’’; and 18
78	78	(ii) by striking ‘‘, but only if’’ and all 19
79	79	that follows through ‘‘under such dis-20
80	80	ability’’; and 21
81	81	(B) in paragraph (2), by striking ‘‘as 22

91	91	(2) in subsection (c)— 6
92	92	(A) in the subsection heading, by striking 7

94	94	riod’’ and inserting ‘‘Definition of Insured Sta-9

124	124	cations for disability insurance benefits filed on or after 10
125	125	the date of enactment of this Act and before January 1, 11
126	126	2030, section 223(c)(2) of the Social Security Act (42 12
127	127	U.S.C. 423(c)(2)) shall be applied by making the following 13
128	128	substitutions: 14
129	129	(1) For applications filed in calendar years 15
130	130	2025, 2026, or 2027, substitute ‘‘three’’ for ‘‘five’’ 16
131	131	and ‘‘fifteenth’’ for ‘‘seventeenth’’ each place it ap-17
132	132	pears. 18
133	133	(2) For applications filed in calendar year 19
134	134	2028, substitute ‘‘two’’ for ‘‘five’’ and ‘‘fourteenth’’ 20
135	135	for ‘‘seventeenth’’ each place it appears. 21
136	136	(3) For applications filed in calendar year 22
137	137	2029, substitute ‘‘one’’ for ‘‘five’’ and ‘‘thirteenth’’ 23

167	167	‘‘(j)(1) For purposes of applying this section in the 22
168	168	case of an eligible individual described in paragraph (2), 23
169	169	the following special rules shall apply: 24

174	174	if there were no requirement for any entitle-2
175	175	ment to benefits, or status, for a period of 24 3
176	176	months prior to receiving such benefits or sta-4
177	177	tus. 5
178	178	‘‘(B) The entitlement under such sub-6
179	179	section shall be available retroactively to the 7
180	180	first day of the first month (rather than twen-8
181	181	ty-fifth month) of entitlement or status. 9
182	182	‘‘(C) Subsection (f) shall not be applied. 10
183	183	‘‘(2) For purposes of applying this section, an 11
184	184	‘eligible individual’ is an individual, with respect to 12
185	185	a month— 13
186	186	‘‘(A) who has not yet attained the age of 14
187	187	65; 15
188	188	‘‘(B) who is entitled to benefits described 16
189	189	in subparagraph (A) of subsection (b)(2); and 17
190	190	‘‘(C) with respect to whom section 18
191	191	5000A(e)(1)(A) of the Internal Revenue Code 19
192	192	of 1986 would apply if the reference to ‘8 per-20
193	193	cent’ in such section were a reference to ‘8.5 21
194	194	percent’.’’. 22

217	217	‘‘(o)(1) In applying this section in the case of an eligi-14
218	218	ble individual who is entitled to benefits under part A pur-15
219	219	suant to the operation of section 226(j), the following spe-16
220	220	cial rules shall apply: 17
221	221	‘‘(A) The initial enrollment period under 18
222	222	subsection (d) shall begin on the first day of the 19
223	223	first month in which the individual satisfies the 20
224	224	requirement of section 1836(a)(1). 21
225	225	‘‘(B) In applying subsection (g)(1), the ini-22
226	226	tial enrollment period shall begin on the first 23
227	227	day of the first month of entitlement to dis-24

233	233	‘‘(2) In applying this section in the case of an 3
234	234	individual who became entitled to benefits under 4
235	235	part A, but had not been entitled to such benefits 5
236	236	for a period of 24 calendar months as of the date 6
237	237	of enactment of the Stop the Wait Act of 2025, and 7
238	238	is entitled to such benefits pursuant to the applica-8
239	239	tion of section 226(j), the initial enrollment period 9
240	240	under subsection (d) for such individual shall begin 10
241	241	on the first day of the first month following the date 11
242	242	of enactment of the Stop the Wait Act of 2025 and 12
243	243	shall end seven months later.’’. 13
