| 40 | 40 | | ‘‘(1) The Secretary shall determine whether the 16 |

| 41 | 41 | | draft regulation, if implemented, would result in an 17 |

| 42 | 42 | | increase in a subsidy cost. 18 |

| 43 | 43 | | ‘‘(2) If the Secretary determines under para-19 |

| 44 | 44 | | graph (1) that the draft regulation would result in 20 |
|---|
| 45 | 45 | | an increase in a subsidy cost, then the Secretary 21 |
