4242 In this Act, the term ‘‘Secretary’’ means the Sec-2

4646 ULEMAKING.—Not later than 1 year after the 5
4747 date on which the National Transportation Safety Board 6
4848 issues the report on the East Palestine, Ohio crash, the 7
4949 Secretary, in consultation with the Administrator of the 8
5050 Federal Railroad Administration, shall issue regulations, 9
5151 or modify existing regulations, based on such report estab-10
5252 lishing safety requirements, in accordance with subsection 11
5353 (b), with which a rail carrier operating a train trans-12
5454 porting hazardous materials that is not subject to the re-13
5555 quirements for a high-hazard flammable train under sec-14
5656 tion 174.310 of title 49, Code of Federal Regulations, 15
5757 shall comply with respect to the operation of each such 16
5858 train and the maintenance of specification tank cars. 17

6060 EQUIREMENTS.—The regulations issued pursu-18
6161 ant to subsection (a) shall require rail carriers— 19
6262 (1) to provide advance notification and informa-20
6363 tion regarding the transportation of hazardous mate-21
6464 rials described in subsection (a) to each State emer-22

8181 regulations required under subsection (a), the Secretary 13
8282 shall include requirements regarding— 14
8383 (1) train length and weight; 15
8484 (2) train consist; 16
8585 (3) route analysis and selection; 17
8686 (4) speed restrictions; 18
8787 (5) track standards; 19
8888 (6) track, bridge, and rail car maintenance; 20
8989 (7) signaling and train control; and 21

103103 required for an employee to complete a railcar, locomotive, 6
104104 or brake inspection to ensure that each railcar, locomotive, 7
105105 and brake system complies with safety laws and regula-8
106106 tions. 9

108108 EQUIREMENT.—Employees shall perform their 10
109109 inspection duties promptly and shall not delay other than 11
110110 for reasons related to safety.’’. 12

118118 later than 120 days after the date of the enactment of 18
119119 this Act, the Secretary shall amend the pre-departure in-19
120120 spection requirements for Class I railroads under part 215 20
121121 of title 49, Code of Federal Regulations (as written on 21
122122 such date of enactment)— 22
123123 (1) to ensure that after initial consultation with 23
124124 the Federal Railroad Administration, and after each 24
125125 subsequent annual consultation, each railroad identi-25

133133 by an inspector designated under part 215 at a des-5
134134 ignated inspection location in the direction of travel 6
135135 as soon as practicable; and 7
136136 (3) to require each railroad that operates rail-8
137137 road freight cars to which such part 215 applies to 9
138138 designate persons qualified to inspect railroad 10
139139 freight rail cars, subject to any existing collective 11
140140 bargaining agreement, for compliance and deter-12
141141 minations required under such part. 13

143143 UALIFIEDLOCOMOTIVEINSPECTIONS.—Not 14
144144 later than 1 year after the date of the enactment of this 15
145145 Act, the Secretary shall review and amend, as necessary, 16
146146 regulations under chapters 229 and 243 of title 49, Code 17
147147 of Federal Regulations— 18
148148 (1) to ensure appropriate training qualifications 19
149149 and proficiency of employees, including qualified me-20
150150 chanical inspectors, performing locomotive inspec-21
151151 tions; and 22
152152 (2) for locomotives in service on a Class I rail-23
153153 road, to require an additional daily inspection to be 24
154154 performed by a qualified mechanical inspector be-25

165165 the date of the enactment of this Act, the Secretary 6
166166 shall initiate audits of Federal railcar, locomotive, 7
167167 and train brake system inspection compliance with 8
168168 chapter II of subtitle B of title 49, Code of Federal 9
169169 Regulations, which— 10
170170 (A) consider whether the railroad has in 11
171171 place procedures necessary for railcar, loco-12
172172 motive, and train brake system inspection com-13
173173 pliance under such chapter; 14
174174 (B) assess the type, content, and adequacy 15
175175 of training and performance metrics the rail-16
176176 road provides employees who perform railcar, 17
177177 locomotive, and train brake system inspections, 18
178178 including the qualifications specified for such 19
179179 employees; 20
180180 (C) determine whether the railroad has 21
181181 practices that would interfere with an employ-22
182182 ee’s responsibility to perform an inspection 23
183183 safely; 24

188188 motives, and train brake systems are inspected 2
189189 on the railroad’s network in accordance with 3
190190 such chapter; 4
191191 (E) involve proper communication of iden-5
192192 tified defects to railroad personnel and make 6
193193 appropriate use of remedial action reports to 7
194194 verify that repairs are made; 8
195195 (F) determine whether managers coerce 9
196196 employees to sign off on any documents 10
197197 verifying an inspection or repair of a railcar, lo-11
198198 comotive, or train brake system; 12
199199 (G) determine whether the railroad’s in-13
200200 spection procedures reflect the current oper-14
201201 ating practices of the railroad carrier; and 15
202202 (H) ensure that railroad inspection proce-16
203203 dures only provide for the use of persons per-17
204204 mitted to perform each relevant inspection 18
205205 under such chapter. 19

207207 UDIT SCHEDULING .—The Secretary 20
208208 shall— 21
209209 (A) schedule the audits required under 22
210210 paragraph (1) to ensure that— 23

217217 (ii) a limited number, as determined 4
218218 by the Secretary, of Class II and Class III 5
219219 railroads are audited annually, provided 6
220220 that— 7
221221 (I) no audit of a tourist, scenic, 8
222222 historic, or excursion operation may 9
223223 be required under this subsection; and 10
224224 (II) no other Class II or III rail-11
225225 road may be audited more frequently 12
226226 than once every 5 years; and 13
227227 (B) conduct the audits described in sub-14
228228 paragraph (A)(ii) in accordance with— 15
229229 (i) the Small Business Regulatory En-16
230230 forcement Fairness Act of 1996 (5 U.S.C. 17
231231 601 note); and 18
232232 (ii) appendix C of part 209 of title 49, 19
233233 Code of Federal Regulations. 20

235235 PDATES TO INSPECTION PROGRAM AND 21
236236 PROCEDURES.—If, during an audit required under 22
237237 this subsection, the auditor identifies a deficiency in 23
238238 a railroad’s procedures or practices necessary to en-24
239239 sure compliance with chapter II of subtitle B of title 25

245245 the opportunity to address whether such a deficiency 3
246246 exists. 4

248248 ONSULTATION AND COOPERATION .— 5

250250 ONSULTATION.—In conducting any 6
251251 audit required under this subsection, the Sec-7
252252 retary shall consult with the railroad being au-8
253253 dited and its employees, including any nonprofit 9
254254 employee labor organization representing the 10
255255 employees of the railroad that conduct railcar, 11
256256 locomotive, or train brake system inspections. 12
257257 (B) C
258258 OOPERATION.—The railroad being 13
259259 audited and its employees, including any non-14
260260 profit employee labor organization representing 15
261261 mechanical employees, shall fully cooperate with 16
262262 any audit conducted pursuant to this sub-17
263263 section— 18
264264 (i) by providing any relevant docu-19
265265 ments requested; and 20
266266 (ii) by making available any employees 21
267267 for interview without undue delay or ob-22
268268 struction. 23

270270 AILURE TO COOPERATE .—If the Sec-24
271271 retary determines that a railroad or any of its 25

278278 with an audit conducted pursuant to this sub-4
279279 section, the Secretary shall electronically notify 5
280280 the Committee on Commerce, Science, and 6
281281 Transportation of the Senate and the Com-7
282282 mittee on Transportation and Infrastructure of 8
283283 the House of Representatives of such non-9
284284 cooperation. 10
285285 (e) R
286286 EVIEW OFREGULATIONS.—Not later than 5 11
287287 years after the date of the enactment of this Act, and peri-12
288288 odically thereafter, the Secretary shall determine whether 13
289289 any update to chapters I and II of subtitle B of title 49, 14
290290 Code of Federal Regulations, is necessary to ensure the 15
291291 adequacy of railcar, locomotive, and train brake system 16
292292 inspections. 17
293293 (f) A
294294 NNUALREPORT.—The Secretary shall publish 18
295295 an annual report on the public website of the Federal Rail-19
296296 road Administration that— 20
297297 (1) summarizes the findings of the audits con-21
298298 ducted pursuant to subsection (c) during the most 22
299299 recently concluded fiscal year; 23

309309 ULE OFCONSTRUCTION.—Nothing in this sec-6
310310 tion may be construed— 7
311311 (1) to provide the Secretary with any authority 8
312312 to interpret, revise, alter, or apply a collectively bar-9
313313 gained agreement, nor any authority over collective 10
314314 bargaining, collectively bargained agreements, or any 11
315315 aspect of the Railway Labor Act (45 U.S.C. 151 et 12
316316 seq.); 13
317317 (2) to alter the terms or interpretations of ex-14
318318 isting collective bargaining agreements; or 15
319319 (3) to abridge any procedural rights or rem-16
320320 edies provided under a collectively bargained agree-17
321321 ment. 18
322322 SEC. 5. DEFECT DETECTORS. 19
323323 (a) R
324324 ULEMAKING.—Not later than 1 year after the 20
325325 date of the enactment of this Act, the Secretary shall issue 21
326326 regulations establishing requirements for the installation, 22
327327 repair, testing, maintenance, and operation of wayside de-23
328328 fect detectors for each rail carrier operating a train consist 24
329329 carrying hazardous materials. 25

334334 ant to subsection (a) shall include requirements regard-2
335335 ing— 3
336336 (1) the frequency of the placement of wayside 4
337337 defect detectors, including a requirement that all 5
338338 Class I railroads install a hotbox detector along 6
339339 every 10-mile segment of rail track over which trains 7
340340 carrying hazardous materials operate; 8
341341 (2) performance standards for such detectors; 9
342342 (3) the maintenance and repair requirements 10
343343 for such detectors; 11
344344 (4) reporting data and maintenance records of 12
345345 such detectors; 13
346346 (5) appropriate steps the rail carrier must take 14
347347 when receiving an alert of a defect or failure from 15
348348 or regarding a wayside defect detector; and 16
349349 (6) the use of hotbox detectors to prevent 17
350350 derailments from wheel bearing failures, including— 18
351351 (A) the temperatures, to be specified by 19
352352 the Secretary, at which an alert from a hotbox 20
353353 detector is triggered to warn of a potential 21
354354 wheel bearing failure; and 22
355355 (B) any actions that shall be taken by a 23
356356 rail carrier upon receiving an alert from a hot-24

468468 deadlines or requirements that are inconsistent 12
