1414 Calling an Article V Convention for proposing a Fiscal Re-
1515 sponsibility Amendment to the United States Constitu-
1616 tion and stipulating ratification by a vote of We the
1717 People, and for other purposes.
1818 Whereas Article V of the Constitution of the United States
1919 states that ‘‘The Congress . . . on the Application of the
2020 Legislatures of two thirds of the several States, shall call
2121 a Convention for proposing Amendments’’ to the Con-
2222 stitution;
2323 Whereas congressional and State records of plenary applica-
2424 tions for amendments on any subject and applications for
2525 the single subject of Inflation-fighting Fiscal Responsi-
2626 bility Amendments compiled by the Article V Library
2727 counts Nevada’s ‘‘continuing’’ application, reported Feb-

3232 thus achieving the ‘‘two thirds’’ congressional mandate to
3333 call the Convention for proposing amendments; congres-
3434 sional records reported 39 applications by the end of
3535 1979, 40 in 1983, and 42 total applications over time;
3636 Whereas Alexander Hamilton in Federalist 85 stated that
3737 ‘‘The Congress ‘shall call a Convention’. Nothing in this
3838 particular is left to the discretion of that body’’;
3939 Whereas, beginning in 1979, when Congress appears to have
4040 failed in its constitutional duty to count applications and
4141 call a ‘‘Convention for proposing Amendments’’, the Na-
4242 tion’s debt has increased to more than $36 trillion from
4343 $860 billion, while the value of the dollar has declined by
4444 over 80 percent;
4545 Whereas the Constitution was ratified by Convention dele-
4646 gates ‘‘chosen in each State by the People thereof’’, and
4747 the 21st Amendment, repealing Prohibition, was ratified
4848 in 1933 by a vote of the people for Yes-pledged delegates
4949 in 38 of 39 State Conventions; and
5050 Whereas the Supreme Court’s unanimous opinion in Chiafalo
5151 v. Washington stated: ‘‘electors . . . have no ground for
5252 reversing the vote of millions of its citizens. That direc-
5353 tion accords with the Constitution—as well as with the
5454 trust of the Nation that here, We the People rule.’’: Now,
5555 therefore, be it

6464 (1) CALL FOR CONVENTION ; TIMING.—As pro-1
6565 vided in Article V of the Constitution of the United 2
6666 States, and except as provided in paragraph (2), 3
6767 Congress hereby calls a Convention for proposing 4
6868 amendments to the Constitution of the United 5
6969 States for a date and place to be determined on call-6

7272 XCEPTION.—Paragraph (1) does not apply 8
7373 if, prior to the expiration of the 60-day period which 9
7474 begins on the date of the adoption of this concurrent 10

7676 (A) the House Clerk provides a written re-12
7777 port stating there have never been unrescinded 13
7878 and ‘‘continuing’’ applications for a Convention 14
7979 to propose amendments from at least two-thirds 15
8080 (34) of the States on any national issues (ple-16
8181 nary) plus the single issue of fiscal responsi-17
8282 bility; and 18
8383 (B) the House Clerk includes in the report 19
8484 detailed findings for each State. 20

8686 ATIFICATION OFAMENDMENTS BY STATES.— 21
8787 Each proposed amendment at the Convention for pro-22
8888 posing amendments called under this section shall be rati-23
8989 fied by a vote of We the People in three-quarters (38) of 24
9090 the States via State Convention delegates who shall ‘‘have 25
