1313 CONCURRENT RESOLUTION
1414 Expressing support for the work of open water lifeguards
1515 as first responders and emergency response providers.
1616 Whereas open water lifeguards perform an essential function
1717 of protecting countless lives from death or serious injury;
1818 Whereas these lifeguards do so at great risk to their own
1919 lives;
2020 Whereas, in 2021, two lifeguards in the State of New Jersey
2121 lost their lives while performing their duty;
2222 Whereas many open water lifeguards are cross-trained in
2323 emergency medical response, marine fire safety, law en-
2424 forcement, and water rescue craft operations;

2828 Whereas lifeguards respond and attend to victims, treat vic-
2929 tims, assist victims, and transport victims, the 4 defined
3030 duties of a emergency response employee;
3131 Whereas lifeguards not only protect life, but also property,
3232 evidence, and the environment, the 4 tenets which define
3333 a first responder;
3434 Whereas United States law already recognizes open water
3535 lifeguards as first responders or emergency response pro-
3636 viders;
3737 Whereas many other countries recognize lifeguards as emer-
3838 gency responders, and grant them access to the programs
3939 to which first responders are entitled; and
4040 Whereas, during the COVID–19 emergency, open water life-
4141 guards ought to have been considered ‘‘essential workers’’
4242 and given priority access to vaccinations: Now, therefore,
4343 be it
4444 Resolved by the House of Representatives (the Senate 1
4545 concurring), That Congress reaffirms that open water life-2
4646 guards qualify as first responders and emergency response 3
4747 providers, and recognizes the essential, lifesaving work 4
4848 performed by these brave individuals. 5
