JOINT RESOLUTION 
Proposing an amendment to the Constitution of the United 
States to provide for balanced budgets for the Government. 
Resolved by the Senate and House of Representatives 1
of the United States of America in Congress assembled2
(two-thirds of each House concurring therein), That the fol-3
lowing article is proposed as an amendment to the Con-4
stitution of the United States, which shall be valid to all 5
intents and purposes as part of the Constitution when 6
ratified by the legislatures of three-fourths of the several 7
States: 8

‘‘ARTICLE— 1
‘‘S
ECTION1. Total outlays for any fiscal year shall 2
not exceed total receipts for that fiscal year, unless two- 3
thirds of the whole number of each House of Congress 4
shall provide by law for a specific excess of outlays over 5
receipts by a rollcall vote. 6

ECTION2. Prior to each fiscal year, the President 7
shall transmit to the Congress a proposed budget for the 8
United States Government for that fiscal year in which 9
total outlays do not exceed total receipts. 10

ECTION3. The Congress may waive the provisions 11
of this article for any fiscal year in which a declaration 12
of war is in effect by a rollcall vote. 13
‘‘S
ECTION4. The Congress may waive the provisions 14
of this article for any fiscal year in which a declaration 15
of national emergency is in effect, as so declared by a joint 16
resolution, adopted by a majority of the whole number of 17
each House, which becomes law. 18

ECTION5. The Congress may waive the provisions 19
of this article for any fiscal year in which a declaration 20
of a natural disaster is in effect, as so declared by a joint 21
resolution, adopted by a majority of the whole number of 22
each House, which becomes law. 23

‘‘SECTION6. The Congress shall enforce and imple-1
ment this article by appropriate legislation, which may rely 2
on estimates of outlays and receipts. 3

ECTION7. This article shall take effect beginning 4
with the fifth fiscal year beginning after its ratification.’’. 5
