1818 Resolved, That Paul Adam Engelmayer, United 1
1919 States District Court Judge for the Southern District of 2
2020 New York, is impeached for high crimes and mis-3
2121 demeanors, and that the following article of impeachment 4

3535 Judge Paul Engelmayer, in violation of his oath of 6
3636 office, did knowingly and willfully use his judicial position 7
3737 to advance personal interests and political gain. 8
3838 The Constitution provides that the House of Rep-9
3939 resentatives ‘‘shall have the sole Power of Impeachment’’ 10
4040 and that ‘‘civil Officers of the United States’’, including 11
4141 Federal judges, are subject to impeachment and removal. 12
4242 Further, the separation of powers under the Con-13
4343 stitution grants the President broad authority over the ex-14
4444 ecutive branch, including direct control and access to de-15
4545 partments, as part of his role in ensuring the administra-16
4646 tion of laws and policies of the United States. 17
4747 In his conduct of the office of United States District 18
4848 Court Judge, in which he violated his oath to the Constitu-19
4949 tion and duty of impartiality to the people of the United 20
5050 States, Paul A. Engelmayer has abused the powers of his 21
5151 judicial authority, having engaged in actions that 22
5252 prioritize personal and political affiliations over the duty 23
5353 of impartiality owed to the public and litigants as follows: 24
5454 (1) Judge Engelmayer restrained President 25
5555 Trump and Secretary Bessent from granting access 26

6060 systems, or any other data systems maintained by 2
6161 the Department of the Treasury containing person-3
6262 ally identifiable information or confidential financial 4
6363 information of payees; and 5
6464 (2) Judge Engelmayer restrained President 6
6565 Trump and Secretary Bessent from granting access 7
6666 to all political appointees, special Government em-8
6767 ployees, and Government employees detailed from 9
6868 another Federal agency, to any Department of the 10
6969 Treasury payment record, payment systems, or any 11
7070 other data systems maintained by the Department of 12
7171 the Treasury containing personally identifiable infor-13
7272 mation. 14
7373 This conduct has resulted in apparent bias and favor-15
7474 itism, representing an abuse of judicial power and is detri-16
7575 mental to the orderly functioning of the judiciary. Using 17
7676 the powers of his high office, Judge Engelmayer interfered 18
7777 with the will of the people. 19
7878 In so doing, Judge Engelmayer used the powers of 20
7979 his position to engage in actions that overstep his judicial 21
8080 authority. By making a political decision outside the scope 22
8181 of his legal duties, he compromised the impartiality of our 23
8282 judicial system. 24
