15	15	Impeaching Paul Adam Engelmayer, United States District
16	16	Court Judge for the Southern District of New York,
17	17	for high crimes and misdemeanors.
18	18	Resolved, That Paul Adam Engelmayer, United 1
19	19	States District Court Judge for the Southern District of 2
20	20	New York, is impeached for high crimes and mis-3
21	21	demeanors, and that the following article of impeachment 4
22	22	be exhibited to the United States Senate: 5
23	23	Article of impeachment exhibited by the House of 6
24	24	Representatives of the United States of America in the 7
25	25	name of itself and of the people of the United States of 8
26	26	America, against Paul Adam Engelmayer, United States 9

31	31	York, in maintenance and support of its impeachment 2
32	32	against him for high crimes and misdemeanors. 3
33	33	ARTICLE I: ABUSE OF POWER 4
34	34	5
35	35	Judge Paul Engelmayer, in violation of his oath of 6
36	36	office, did knowingly and willfully use his judicial position 7
37	37	to advance personal interests and political gain. 8
38	38	The Constitution provides that the House of Rep-9
39	39	resentatives ‘‘shall have the sole Power of Impeachment’’ 10
40	40	and that ‘‘civil Officers of the United States’’, including 11
41	41	Federal judges, are subject to impeachment and removal. 12
42	42	Further, the separation of powers under the Con-13
43	43	stitution grants the President broad authority over the ex-14
44	44	ecutive branch, including direct control and access to de-15
45	45	partments, as part of his role in ensuring the administra-16
46	46	tion of laws and policies of the United States. 17
47	47	In his conduct of the office of United States District 18
48	48	Court Judge, in which he violated his oath to the Constitu-19
49	49	tion and duty of impartiality to the people of the United 20
50	50	States, Paul A. Engelmayer has abused the powers of his 21
51	51	judicial authority, having engaged in actions that 22
52	52	prioritize personal and political affiliations over the duty 23
53	53	of impartiality owed to the public and litigants as follows: 24
54	54	(1) Judge Engelmayer restrained President 25
55	55	Trump and Secretary Bessent from granting access 26

59	59	to any Department of the Treasury record, payment 1
60	60	systems, or any other data systems maintained by 2
61	61	the Department of the Treasury containing person-3
62	62	ally identifiable information or confidential financial 4
63	63	information of payees; and 5
64	64	(2) Judge Engelmayer restrained President 6
65	65	Trump and Secretary Bessent from granting access 7
66	66	to all political appointees, special Government em-8
67	67	ployees, and Government employees detailed from 9
68	68	another Federal agency, to any Department of the 10
69	69	Treasury payment record, payment systems, or any 11
70	70	other data systems maintained by the Department of 12
71	71	the Treasury containing personally identifiable infor-13
72	72	mation. 14
73	73	This conduct has resulted in apparent bias and favor-15
74	74	itism, representing an abuse of judicial power and is detri-16
75	75	mental to the orderly functioning of the judiciary. Using 17
76	76	the powers of his high office, Judge Engelmayer interfered 18
77	77	with the will of the people. 19
78	78	In so doing, Judge Engelmayer used the powers of 20
79	79	his position to engage in actions that overstep his judicial 21
80	80	authority. By making a political decision outside the scope 22
81	81	of his legal duties, he compromised the impartiality of our 23
82	82	judicial system. 24
