4040 the District Court of Rhode Island, Chief Judge John 9
4141 James McConnell Jr. knowingly politicized and 10
4242 weaponized his judicial position to advance his own polit-11
4343 ical views and beliefs. 12
4444 The Constitution provides that the House of Rep-13
4545 resentatives ‘‘shall have the sole Power of Impeachment’’ 14
4646 and that ‘‘civil Officers of the United States’’, including 15
4747 Federal judges, are subject to impeachment and removal. 16
4848 The separation of powers under the Constitution 17
4949 grants the President broad authority over the Executive 18
5050 Branch, including direct control and access to depart-19
5151 ments, as part of his role in ensuring the faithful adminis-20
5252 tration of the laws and policies of the United States. 21

5454 actions that prioritized his own political views and beliefs 23

6868 Chief Judge John James McConnell Jr. served as the 9
6969 director of the Rhode Island branch of Planned Parent-10
7070 hood, and Chief Judge John McConnell Jr. and his wife 11
7171 contributed almost $700,000 in political donations to 12
7272 Democratic committees, causes, and campaigns. 13
7373 Chief Judge John James McConnell Jr. has allowed 14
7474 his personal, political opinions to influence his decisions 15
7575 and rulings. Chief Judge John James McConnell Jr. has 16
7676 made an array of public comments clearly demonstrating 17
7777 a bias that would warp his decision in State of New York 18

153153 Chief Judge John James McConnell Jr. stated that 12
154154 ‘‘All the States rely on federal funds to provide and main-13

172172 accept freely and willingly restrictions that might be 3
173173 viewed as burdensome by the ordinary citizen.’’. 4
174174 Section 455 of title 28, United States Code, requires 5
175175 that ‘‘Any justice, judge, or magistrate judge of the 6
176176 United States shall disqualify himself in any proceeding 7
177177 in which his impartiality might reasonably be ques-8
178178 tioned.’’. 9
179179 Moreover, section 455 of title 28, United States Code, 10
180180 requires that judges must disqualify themselves from a 11
181181 proceeding when ‘‘He knows that he, individually or as 12
182182 a fiduciary, or his spouse or minor child residing in his 13
183183 household, has a financial interest in the subject matter 14
184184 in controversy or in a party to the proceeding, or any other 15
185185 interest that could be substantially affected by the out-16
186186 come of the proceeding’’. 17
187187 Chief Judge John James McConnell Jr. had a signifi-18
188188 cant conflict of interest in presiding over State of New 19
189189 York et al. v. Donald J. Trump, et al., No. 1:25–cv–39 20
190190 (JJM) (PAS) (D.R.I.) due to his simultaneous role as a 21
191191 director of Crossroads Rhode Island. This conflict of inter-22
192192 est made it impossible for him to be impartial in this pro-23
193193 ceeding. 24
