1919 RESOLUTION
2020 Recognizing that members and affiliates of Tren de Aragua
2121 are alien enemies perpetrating an invasion of the United
2222 States and affirming that the President is exercising
2323 his constitutional authority to repel that invasion.
2424 Whereas article II of the United States Constitution vests
2525 Executive power to the President of the United States,
2626 and establishes the President as Commander in Chief of
2727 the Armed Forces;
2828 Whereas the Alien Enemies Act of 1798 was enacted by Con-
2929 gress and signed into law to give the President of the
3030 United States the authority to repel an alien invasion of
3131 the United States;

3535 Whereas invocation of the Alien Enemies Act of 1798 is an
3636 exercise of the President’s authorities as Commander in
3737 Chief;
3838 Whereas the Alien Enemies Act of 1798 states: ‘‘Whenever
3939 there shall be a declared war between the United States
4040 and any foreign nation or government, or any invasion or
4141 predatory incursion shall be perpetrated, attempted, or
4242 threatened against the territory of the United States, by
4343 any foreign nation or government, and the President of
4444 the United States shall make public proclamation of the
4545 event, all natives, citizens, denizens, or subjects of the
4646 hostile nation or government, being males of the age of
4747 fourteen years and upwards, who shall be within the
4848 United States, and not actually naturalized, shall be lia-
4949 ble to be apprehended, restrained, secured and removed,
5050 as alien enemies’’;
5151 Whereas, at the time the Alien Enemies Act was enacted, the
5252 term ‘‘invasion’’ was understood to include actions by
5353 non-state actors, as confirmed by James Madison’s com-
5454 ments at the Virginia Ratifying Convention for the
5555 United States Constitution and definitions in Webster’s
5656 1806 and 1828 dictionaries, and the term ‘‘government’’
5757 was understood to include the institutions for governing
5858 non-state organizations, the Alien Enemies Act can be in-
5959 voked in response to invasions by non-state actors;
6060 Whereas, on 20 January 2025, President Donald J. Trump
6161 issued ‘‘Designating Cartels And Other Organizations As
6262 Foreign Terrorist Organizations And Specially Des-
6363 ignated Global Terrorists,’’ designating Tren De Aragua
6464 as a foreign terrorist organization;
6565 Whereas the Executive order further details Tren De
6666 Aragua’s ‘‘campaigns of violence and terror in the United

7070 States and internationally are extraordinarily violent, vi-
7171 cious, and similarly threaten the stability of the inter-
7272 national order in the Western Hemisphere;’’
7373 Whereas 20-year-old nursing student Laken Hope Riley’s as-
7474 sailant, who was convicted of murdering and attempting
7575 to sexually assault her, was a confirmed Tren de Aragua
7676 member;
7777 Whereas the 2 Venezuelan illegal aliens charged with mur-
7878 dering and sexually assaulting 12-year-old Jocelyn
7979 Nungaray on June 16, 2024, are believed to have ties to
8080 Tren de Aragua;
8181 Whereas law enforcement has confirmed Tren de Aragua tak-
8282 ing over apartment complexes at gunpoint across the
8383 United States, including Aurora, Colorado and San Anto-
8484 nio, Texas;
8585 Whereas, in March 2024, more than 100 suspected Tren de
8686 Aragua members were arrested for their involvement in
8787 charging at National Guardsmen and Department of
8888 Public Safety troopers at the El Paso border;
8989 Whereas, in June 2024, a Tren de Aragua member was
9090 charged with shooting and injuring New York City Police
9191 Department officers Cristopher Abreu and Richard
9292 Yarusso after they tried to lawfully detain him;
9393 Whereas, on July 30, 2024, United States Border Patrol
9494 issued a bulletin warning that Tren de Aragua gave the
9595 ‘‘green light’’ to its over 1,000 members to fire on and
9696 attack law enforcement;
9797 Whereas, as of March 2025, Tren de Aragua is present in
9898 at least 19 States;
9999 Whereas, on March 15, 2025, President Donald J. Trump
100100 issued ‘‘Invocation of the Alien Enemies Act Regarding

105105 a proclamation that finds and declares that Tren de
106106 Aragua is ‘‘perpetrating, attempting, and threatening an
107107 invasion or predatory incursion against the territory of
108108 the United States’’;
109109 Whereas the proclamation further details and declares that
110110 Tren de Aragua is ‘‘undertaking hostile actions and con-
111111 ducting irregular warfare against the territory of the
112112 United States both directly and at the direction, clandes-
113113 tine or otherwise, of the Maduro regime in Venezuela’’;
114114 Whereas, in the 118th Congress, more than 80 Members of
115115 Congress sponsored or cosponsored legislation stating
116116 that the mass illegal immigration brought on by the
117117 open-border policies of the Biden administration con-
118118 stituted an invasion of the United States; and
119119 Whereas the removal of alien enemies engaged in an invasion
120120 of the United States is necessary for the safety of the
121121 American people, and is a proper exercise of the Execu-
122122 tive power of the President of the United States: Now,
123123 therefore, be it
124124 Resolved, That the House of Representatives— 1
125125 (1) recognizes that Tren de Aragua is a ter-2
126126 rorist organization perpetrating an invasion of the 3
127127 United States directly and at the direction of a for-4
128128 eign government; 5
129129 (2) recognizes that members and affiliates of 6
130130 Tren de Aragua are alien enemies; and 7
131131 (3) recognizes and affirms that the President is 8
132132 exercising his Constitutional and legal authority to 9
