18	18	lowing resolution; which was referred to the Committee on the Judiciary
19	19	RESOLUTION
20	20	Recognizing that members and affiliates of Tren de Aragua
21	21	are alien enemies perpetrating an invasion of the United
22	22	States and affirming that the President is exercising
23	23	his constitutional authority to repel that invasion.
24	24	Whereas article II of the United States Constitution vests
25	25	Executive power to the President of the United States,
26	26	and establishes the President as Commander in Chief of
27	27	the Armed Forces;
28	28	Whereas the Alien Enemies Act of 1798 was enacted by Con-
29	29	gress and signed into law to give the President of the
30	30	United States the authority to repel an alien invasion of
31	31	the United States;

35	35	Whereas invocation of the Alien Enemies Act of 1798 is an
36	36	exercise of the President’s authorities as Commander in
37	37	Chief;
38	38	Whereas the Alien Enemies Act of 1798 states: ‘‘Whenever
39	39	there shall be a declared war between the United States
40	40	and any foreign nation or government, or any invasion or
41	41	predatory incursion shall be perpetrated, attempted, or
42	42	threatened against the territory of the United States, by
43	43	any foreign nation or government, and the President of
44	44	the United States shall make public proclamation of the
45	45	event, all natives, citizens, denizens, or subjects of the
46	46	hostile nation or government, being males of the age of
47	47	fourteen years and upwards, who shall be within the
48	48	United States, and not actually naturalized, shall be lia-
49	49	ble to be apprehended, restrained, secured and removed,
50	50	as alien enemies’’;
51	51	Whereas, at the time the Alien Enemies Act was enacted, the
52	52	term ‘‘invasion’’ was understood to include actions by
53	53	non-state actors, as confirmed by James Madison’s com-
54	54	ments at the Virginia Ratifying Convention for the
55	55	United States Constitution and definitions in Webster’s
56	56	1806 and 1828 dictionaries, and the term ‘‘government’’
57	57	was understood to include the institutions for governing
58	58	non-state organizations, the Alien Enemies Act can be in-
59	59	voked in response to invasions by non-state actors;
60	60	Whereas, on 20 January 2025, President Donald J. Trump
61	61	issued ‘‘Designating Cartels And Other Organizations As
62	62	Foreign Terrorist Organizations And Specially Des-
63	63	ignated Global Terrorists,’’ designating Tren De Aragua
64	64	as a foreign terrorist organization;
65	65	Whereas the Executive order further details Tren De
66	66	Aragua’s ‘‘campaigns of violence and terror in the United

70	70	States and internationally are extraordinarily violent, vi-
71	71	cious, and similarly threaten the stability of the inter-
72	72	national order in the Western Hemisphere;’’
73	73	Whereas 20-year-old nursing student Laken Hope Riley’s as-
74	74	sailant, who was convicted of murdering and attempting
75	75	to sexually assault her, was a confirmed Tren de Aragua
76	76	member;
77	77	Whereas the 2 Venezuelan illegal aliens charged with mur-
78	78	dering and sexually assaulting 12-year-old Jocelyn
79	79	Nungaray on June 16, 2024, are believed to have ties to
80	80	Tren de Aragua;
81	81	Whereas law enforcement has confirmed Tren de Aragua tak-
82	82	ing over apartment complexes at gunpoint across the
83	83	United States, including Aurora, Colorado and San Anto-
84	84	nio, Texas;
85	85	Whereas, in March 2024, more than 100 suspected Tren de
86	86	Aragua members were arrested for their involvement in
87	87	charging at National Guardsmen and Department of
88	88	Public Safety troopers at the El Paso border;
89	89	Whereas, in June 2024, a Tren de Aragua member was
90	90	charged with shooting and injuring New York City Police
91	91	Department officers Cristopher Abreu and Richard
92	92	Yarusso after they tried to lawfully detain him;
93	93	Whereas, on July 30, 2024, United States Border Patrol
94	94	issued a bulletin warning that Tren de Aragua gave the
95	95	‘‘green light’’ to its over 1,000 members to fire on and
96	96	attack law enforcement;
97	97	Whereas, as of March 2025, Tren de Aragua is present in
98	98	at least 19 States;
99	99	Whereas, on March 15, 2025, President Donald J. Trump
100	100	issued ‘‘Invocation of the Alien Enemies Act Regarding

104	104	the Invasion of The United States by Tren de Aragua’’,
105	105	a proclamation that finds and declares that Tren de
106	106	Aragua is ‘‘perpetrating, attempting, and threatening an
107	107	invasion or predatory incursion against the territory of
108	108	the United States’’;
109	109	Whereas the proclamation further details and declares that
110	110	Tren de Aragua is ‘‘undertaking hostile actions and con-
111	111	ducting irregular warfare against the territory of the
112	112	United States both directly and at the direction, clandes-
113	113	tine or otherwise, of the Maduro regime in Venezuela’’;
114	114	Whereas, in the 118th Congress, more than 80 Members of
115	115	Congress sponsored or cosponsored legislation stating
116	116	that the mass illegal immigration brought on by the
117	117	open-border policies of the Biden administration con-
118	118	stituted an invasion of the United States; and
119	119	Whereas the removal of alien enemies engaged in an invasion
120	120	of the United States is necessary for the safety of the
121	121	American people, and is a proper exercise of the Execu-
122	122	tive power of the President of the United States: Now,
123	123	therefore, be it
124	124	Resolved, That the House of Representatives— 1
125	125	(1) recognizes that Tren de Aragua is a ter-2
126	126	rorist organization perpetrating an invasion of the 3
127	127	United States directly and at the direction of a for-4
128	128	eign government; 5
129	129	(2) recognizes that members and affiliates of 6
130	130	Tren de Aragua are alien enemies; and 7
131	131	(3) recognizes and affirms that the President is 8
132	132	exercising his Constitutional and legal authority to 9
