1919 Concerning the National Collegiate Athletic Association
2020 policy for eligibility in women’s sports.
2121 Whereas athletic participation has an important positive im-
2222 pact on young girls, improving their physical, emotional,
2323 and psychological health, self-confidence, and discipline;
2424 Whereas women have been responsible for some of the great-
2525 est athletic feats in the history of sports in the United
2626 States, from the Olympic games to professional competi-
2727 tion, through opportunities to compete in collegiate
2828 sports;
2929 Whereas the enactment of title IX of the Education Amend-
3030 ments of 1972 (20 U.S.C. 1681 et seq.) (referred to in
3131 this preamble as ‘‘title IX’’) marked a pivotal moment in

3535 the Federal support of women in sports and applied to
3636 virtually all postsecondary institutions as recipients of
3737 Federal financial assistance;
3838 Whereas there are fundamental and enduring biological dif-
3939 ferences between males and females that put females at
4040 a competitive disadvantage in sports and jeopardize their
4141 safety during competition against males;
4242 Whereas, in 2010, the National Collegiate Athletic Associa-
4343 tion unilaterally adopted a policy that enables biological
4444 males to participate on women’s rosters and compete in
4545 the women’s sports category, a policy that continues
4646 today;
4747 Whereas the policy described in the previous proviso dis-
4848 proportionately negatively impacts female athletes;
4949 Whereas the National Association of Intercollegiate Athletics
5050 (referred to in this preamble as the ‘‘NAIA’’) has insti-
5151 tuted new policies to protect biological women in sports
5252 and ensure that only student athletes whose biological sex
5353 is female will be allowed to compete on NAIA-sponsored
5454 women’s sports teams;
5555 Whereas it is imperative that opportunities for collegiate
5656 women to compete athletically are protected on the basis
5757 of sex; and
5858 Whereas member institutions of the National Collegiate Ath-
5959 letic Association have an obligation under title IX to en-
6060 sure equality of benefits and opportunities in athletic pro-
6161 grams on the basis of sex: Now, therefore be it
6262 Resolved, That the House of Representatives— 1
6363 (1) calls on the National Collegiate Athletic As-2
6464 sociation (referred to in this resolution as ‘‘NCAA’’) 3

6969 policy that directly discriminates against female stu-2
7070 dent athletes; 3
7171 (2) implores the NCAA immediately to protect 4
7272 the integrity of collegiate women’s sports by forbid-5
7373 ding transgender-identifying males to compete on 6
7474 any women’s sports roster or in any collegiate com-7
7575 petition; 8
7676 (3) urges the NCAA to require its member con-9
7777 ferences to conform to a biological sex-based policy 10
7878 across all sports and all divisions; and 11
7979 (4) calls on all sports-governing bodies in the 12
8080 United States to protect the category of women’s 13
8181 sport for biological women and girls. 14
