23	23	RESOLUTION
24	24	Recognizing that article I, section 10 of the United States
25	25	Constitution explicitly reserves to the States the sov-
26	26	ereign power to repel an invasion and defend their citi-
27	27	zenry from the overwhelming and ‘‘imminent danger’’
28	28	posed by paramilitary, narco-terrorist cartels, terrorists
29	29	and criminal actors who seized control of our southern
30	30	border.
31	31	Whereas the Preamble to the United States Constitution out-
32	32	lines the chief responsibility of the Federal Government
33	33	is to ‘‘insure domestic tranquility’’ and ‘‘provide for the
34	34	common defense’’;

38	38	Whereas article IV, section 4 of the United States Constitu-
39	39	tion clearly states ‘‘The United States shall guarantee to
40	40	every State in this Union a Republican Form of Govern-
41	41	ment, and shall protect each of them against Invasion’’;
42	42	Whereas President Biden failed to uphold his oath and fulfill
43	43	his constitutional duty to ‘‘faithfully execute’’ the laws of
44	44	the land;
45	45	Whereas, during the Biden administration there were record-
46	46	breaking apprehensions at the southern border;
47	47	Whereas from 2021 through 2024, monthly apprehensions
48	48	exceeded 200,000 for numerous months and continue to
49	49	increase month over month, eclipsing all-time records for
50	50	apprehensions at the southern border;
51	51	Whereas from 2021 through 2024, border States spent bil-
52	52	lions of dollars annually on the provision of healthcare,
53	53	housing, education, and other services for illegal aliens;
54	54	Whereas those apprehended came from over 160 nations, in-
55	55	cluding many individuals on the terrorist watch list and
56	56	Special Interest Aliens;
57	57	Whereas thousands of criminal offenses have been committed
58	58	by illegal immigrants, including assault, homicide, illegal
59	59	drug and contraband possession, trafficking, and sexual
60	60	offenses;
61	61	Whereas from 2021 through 2024, criminal offenses com-
62	62	mitted by illegal immigrants increased one hundred plus
63	63	percent year over year;
64	64	Whereas from 2021 through 2024, arrests of illegal immi-
65	65	grants convicted of sex offenses increased one thousand
66	66	plus percent year over year according to Customs and
67	67	Border Protection;

71	71	Whereas from 2021 through 2024, authorities seized thou-
72	72	sands of pounds of fentanyl—enough to kill every Amer-
73	73	ican multiple times over;
74	74	Whereas the United States has a drug epidemic whereby tens
75	75	of thousands of Americans die every year and almost 100
76	76	percent of drugs, including heroin, methamphetamine,
77	77	fentanyl, and cocaine, are smuggled across the southern
78	78	border;
79	79	Whereas migrant women and children, were abused, raped,
80	80	tortured, enslaved, and trafficked as a result of the Biden
81	81	administration’s failure to secure our southern border;
82	82	Whereas from 2021 through 2024, attempted crossings by,
83	83	and apprehensions of, illegal immigrant criminals on the
84	84	FBI’s terror watchlist increased exponentially, and even
85	85	more illegal immigrant criminals and terrorists may have
86	86	slipped across the border without detection as
87	87	‘‘gotaways’’;
88	88	Whereas cartels act as paramilitary, narco-terrorist organiza-
89	89	tions that profit from trafficking people and drugs across
90	90	the southern border into the United States;
91	91	Whereas Customs and Border Protection agents have con-
92	92	firmed that cartels facilitate and profit from virtually
93	93	every illegal border crossing;
94	94	Whereas the Biden administration removed effective meas-
95	95	ures that reduced illegal immigration and secured the
96	96	border, including the Migrant Protection Protocols and
97	97	border wall construction;
98	98	Whereas the Biden administration implemented measures
99	99	that increased illegal immigration including reinstating
100	100	‘‘catch and release’’ policies, weakening asylum require-
101	101	ments, and countless other policy decisions that encour-

105	105	age a disregard for our laws and sovereignty and em-
106	106	bolden cartels;
107	107	Whereas States along our southern border—Texas, New Mex-
108	108	ico, Arizona, and California—are forced to spend billions
109	109	of their own taxpayer dollars to address and combat the
110	110	devastation resulting from an unsecured southern border;
111	111	Whereas from 2021 through 2024, State and local law en-
112	112	forcement entities were overwhelmed by criminal activity
113	113	associated with illegal border crossings, putting officers
114	114	and communities in danger while draining local re-
115	115	sources; and
116	116	Whereas from 2021 through 2024, the quality of life and se-
117	117	curity of communities in border States, along with every
118	118	other State in the United States, were threatened, includ-
119	119	ing ranchers suffering from stolen and damaged prop-
120	120	erty, healthcare providers with strained capacity, and
121	121	educators struggling to absorb the high volume of mi-
122	122	grant children in classrooms: Now, therefore, be it
123	123	Resolved, That the House of Representatives— 1
124	124	(1) declares and finds as a matter of fact any 2
125	125	State within the United States has the sovereign 3
126	126	right to exclude from the sovereign’s territory any 4
127	127	person who does not have the right to be there; 5
128	128	(2) declares and finds as a matter of fact that 6
129	129	from 2021 through 2024, the States at our southern 7
130	130	border, including Texas, New Mexico, Arizona, and 8
131	131	California, were invaded or were in such imminent 9
132	132	danger from paramilitary, narco-terrorist cartels, 10
133	133	terrorists, and criminal actors as will not admit 11

137	137	delay as stated in article I, section 10 of the United 1
138	138	States Constitution and those States have the sov-2
139	139	ereign and unilateral authority pursuant to article I, 3
140	140	section 10 of the United States Constitution to de-4
141	141	fend themselves against the invasion or imminent 5
142	142	danger by paramilitary, narco-terrorist cartels, ter-6
143	143	rorists and criminal actors; 7
144	144	(3) declares and finds as a matter of fact that 8
145	145	from 2021 through 2024, the United States failed to 9
146	146	protect the aforementioned States at our southern 10
147	147	border against invasion pursuant to article IV, sec-11
148	148	tion 4 of the United States Constitution or to ‘‘en-12
149	149	sure domestic tranquility’’, ‘‘provide for the common 13
150	150	defense’’, and ‘‘execute the laws’’ of the United 14
151	151	States; and 15
152	152	(4) declares and finds as a matter of fact the 16
153	153	Biden administration failed to faithfully execute the 17
154	154	laws of the United States and to defend and protect 18
155	155	the aforementioned States on the southern border 19
156	156	against invasion or imminent danger. 20
