2424 Recognizing that article I, section 10 of the United States
2525 Constitution explicitly reserves to the States the sov-
2626 ereign power to repel an invasion and defend their citi-
2727 zenry from the overwhelming and ‘‘imminent danger’’
2828 posed by paramilitary, narco-terrorist cartels, terrorists
2929 and criminal actors who seized control of our southern
3030 border.
3131 Whereas the Preamble to the United States Constitution out-
3232 lines the chief responsibility of the Federal Government
3333 is to ‘‘insure domestic tranquility’’ and ‘‘provide for the
3434 common defense’’;

3838 Whereas article IV, section 4 of the United States Constitu-
3939 tion clearly states ‘‘The United States shall guarantee to
4040 every State in this Union a Republican Form of Govern-
4141 ment, and shall protect each of them against Invasion’’;
4242 Whereas President Biden failed to uphold his oath and fulfill
4343 his constitutional duty to ‘‘faithfully execute’’ the laws of
4444 the land;
4545 Whereas, during the Biden administration there were record-
4646 breaking apprehensions at the southern border;
4747 Whereas from 2021 through 2024, monthly apprehensions
4848 exceeded 200,000 for numerous months and continue to
4949 increase month over month, eclipsing all-time records for
5050 apprehensions at the southern border;
5151 Whereas from 2021 through 2024, border States spent bil-
5252 lions of dollars annually on the provision of healthcare,
5353 housing, education, and other services for illegal aliens;
5454 Whereas those apprehended came from over 160 nations, in-
5555 cluding many individuals on the terrorist watch list and
5656 Special Interest Aliens;
5757 Whereas thousands of criminal offenses have been committed
5858 by illegal immigrants, including assault, homicide, illegal
5959 drug and contraband possession, trafficking, and sexual
6060 offenses;
6161 Whereas from 2021 through 2024, criminal offenses com-
6262 mitted by illegal immigrants increased one hundred plus
6363 percent year over year;
6464 Whereas from 2021 through 2024, arrests of illegal immi-
6565 grants convicted of sex offenses increased one thousand
6666 plus percent year over year according to Customs and
6767 Border Protection;

7171 Whereas from 2021 through 2024, authorities seized thou-
7272 sands of pounds of fentanyl—enough to kill every Amer-
7373 ican multiple times over;
7474 Whereas the United States has a drug epidemic whereby tens
7575 of thousands of Americans die every year and almost 100
7676 percent of drugs, including heroin, methamphetamine,
7777 fentanyl, and cocaine, are smuggled across the southern
7878 border;
7979 Whereas migrant women and children, were abused, raped,
8080 tortured, enslaved, and trafficked as a result of the Biden
8181 administration’s failure to secure our southern border;
8282 Whereas from 2021 through 2024, attempted crossings by,
8383 and apprehensions of, illegal immigrant criminals on the
8484 FBI’s terror watchlist increased exponentially, and even
8585 more illegal immigrant criminals and terrorists may have
8686 slipped across the border without detection as
8787 ‘‘gotaways’’;
8888 Whereas cartels act as paramilitary, narco-terrorist organiza-
8989 tions that profit from trafficking people and drugs across
9090 the southern border into the United States;
9191 Whereas Customs and Border Protection agents have con-
9292 firmed that cartels facilitate and profit from virtually
9393 every illegal border crossing;
9494 Whereas the Biden administration removed effective meas-
9595 ures that reduced illegal immigration and secured the
9696 border, including the Migrant Protection Protocols and
9797 border wall construction;
9898 Whereas the Biden administration implemented measures
9999 that increased illegal immigration including reinstating
100100 ‘‘catch and release’’ policies, weakening asylum require-
101101 ments, and countless other policy decisions that encour-

105105 age a disregard for our laws and sovereignty and em-
106106 bolden cartels;
107107 Whereas States along our southern border—Texas, New Mex-
108108 ico, Arizona, and California—are forced to spend billions
109109 of their own taxpayer dollars to address and combat the
110110 devastation resulting from an unsecured southern border;
111111 Whereas from 2021 through 2024, State and local law en-
112112 forcement entities were overwhelmed by criminal activity
113113 associated with illegal border crossings, putting officers
114114 and communities in danger while draining local re-
115115 sources; and
116116 Whereas from 2021 through 2024, the quality of life and se-
117117 curity of communities in border States, along with every
118118 other State in the United States, were threatened, includ-
119119 ing ranchers suffering from stolen and damaged prop-
120120 erty, healthcare providers with strained capacity, and
121121 educators struggling to absorb the high volume of mi-
122122 grant children in classrooms: Now, therefore, be it
123123 Resolved, That the House of Representatives— 1
124124 (1) declares and finds as a matter of fact any 2
125125 State within the United States has the sovereign 3
126126 right to exclude from the sovereign’s territory any 4
127127 person who does not have the right to be there; 5
128128 (2) declares and finds as a matter of fact that 6
129129 from 2021 through 2024, the States at our southern 7
130130 border, including Texas, New Mexico, Arizona, and 8
131131 California, were invaded or were in such imminent 9
132132 danger from paramilitary, narco-terrorist cartels, 10
133133 terrorists, and criminal actors as will not admit 11

137137 delay as stated in article I, section 10 of the United 1
138138 States Constitution and those States have the sov-2
139139 ereign and unilateral authority pursuant to article I, 3
140140 section 10 of the United States Constitution to de-4
141141 fend themselves against the invasion or imminent 5
142142 danger by paramilitary, narco-terrorist cartels, ter-6
143143 rorists and criminal actors; 7
144144 (3) declares and finds as a matter of fact that 8
145145 from 2021 through 2024, the United States failed to 9
146146 protect the aforementioned States at our southern 10
147147 border against invasion pursuant to article IV, sec-11
148148 tion 4 of the United States Constitution or to ‘‘en-12
149149 sure domestic tranquility’’, ‘‘provide for the common 13
150150 defense’’, and ‘‘execute the laws’’ of the United 14
151151 States; and 15
152152 (4) declares and finds as a matter of fact the 16
153153 Biden administration failed to faithfully execute the 17
154154 laws of the United States and to defend and protect 18
155155 the aforementioned States on the southern border 19
156156 against invasion or imminent danger. 20
