1414 in the jurisdiction of the committee concerned
1515 RESOLUTION
1616 Reaffirming the freedom to decide and expressing continued
1717 support for medication abortion access.
1818 Whereas antiabortion extremists are desperate to ban abor-
1919 tion nationwide and are trying to misuse a centuries-old
2020 zombie law to achieve their goals;
2121 Whereas there is a settled understanding of the Comstock
2222 Act for nearly a century, and the Department of Justice,
2323 the courts, and Congress have made clear that the Com-
2424 stock laws do not apply to lawful abortions;
2525 Whereas the majority of the public supports abortion access,
2626 and an overwhelming majority of Americans (80 percent)
2727 oppose a Federal law banning abortion nationwide;

3131 Whereas antiabortion extremists are waging a war on repro-
3232 ductive rights, including the ability to make personal, pri-
3333 vate health care decisions;
3434 Whereas misusing, misapplying, and misinterpreting the
3535 Comstock Act would be yet another attempt to attack ac-
3636 cess to medication abortion, a safe and effective health
3737 care option;
3838 Whereas misusing, misapplying, and misinterpreting the
3939 Comstock Act could threaten certain shipping and trans-
4040 portation of basic medical materials; and
4141 Whereas misusing, misapplying, and misinterpreting the
4242 Comstock Act could further threaten and endanger sex-
4343 ual and reproductive health: Now, therefore, be it
4444 Resolved, That the House of Representatives— 1
4545 (1) affirms the existing authority to distribute 2
4646 medication abortion under Federal law, as confirmed 3
4747 by the December 23, 2022, Department of Justice’s 4
4848 Office of Legal Counsel Memorandum Opinion for 5
4949 the General Counsel of the United States Postal 6
5050 Service which states in part that ‘‘Section 1461 of 7
5151 title 18 of the U.S. Code does not prohibit the mail-8
5252 ing of certain drugs that can be used to perform 9
5353 abortions where the sender lacks the intent that the 10
5454 recipient of the drugs will use them unlawfully.’’; 11
