11	11	the Committee on Energy and Commerce, and in addition to the Com-
12	12	mittee on the Judiciary, for a period to be subsequently determined by
13	13	the Speaker, in each case for consideration of such provisions as fall with-
14	14	in the jurisdiction of the committee concerned
15	15	RESOLUTION
16	16	Reaffirming the freedom to decide and expressing continued
17	17	support for medication abortion access.
18	18	Whereas antiabortion extremists are desperate to ban abor-
19	19	tion nationwide and are trying to misuse a centuries-old
20	20	zombie law to achieve their goals;
21	21	Whereas there is a settled understanding of the Comstock
22	22	Act for nearly a century, and the Department of Justice,
23	23	the courts, and Congress have made clear that the Com-
24	24	stock laws do not apply to lawful abortions;
25	25	Whereas the majority of the public supports abortion access,
26	26	and an overwhelming majority of Americans (80 percent)
27	27	oppose a Federal law banning abortion nationwide;

31	31	Whereas antiabortion extremists are waging a war on repro-
32	32	ductive rights, including the ability to make personal, pri-
33	33	vate health care decisions;
34	34	Whereas misusing, misapplying, and misinterpreting the
35	35	Comstock Act would be yet another attempt to attack ac-
36	36	cess to medication abortion, a safe and effective health
37	37	care option;
38	38	Whereas misusing, misapplying, and misinterpreting the
39	39	Comstock Act could threaten certain shipping and trans-
40	40	portation of basic medical materials; and
41	41	Whereas misusing, misapplying, and misinterpreting the
42	42	Comstock Act could further threaten and endanger sex-
43	43	ual and reproductive health: Now, therefore, be it
44	44	Resolved, That the House of Representatives— 1
45	45	(1) affirms the existing authority to distribute 2
46	46	medication abortion under Federal law, as confirmed 3
47	47	by the December 23, 2022, Department of Justice’s 4
48	48	Office of Legal Counsel Memorandum Opinion for 5
49	49	the General Counsel of the United States Postal 6
50	50	Service which states in part that ‘‘Section 1461 of 7
51	51	title 18 of the U.S. Code does not prohibit the mail-8
52	52	ing of certain drugs that can be used to perform 9
53	53	abortions where the sender lacks the intent that the 10
54	54	recipient of the drugs will use them unlawfully.’’; 11
