REVIEW BY COMMITTEE ON FOREIGN INVESTMENT 1 IN THE UNITED STATES OF CERTAIN AGRI-2 CULTURAL REAL ESTATE TRANSACTIONS. 3 Section 721(a)(4) of the Defense Production Act of 4 1950 (50 U.S.C. 4565(a)(4)) is amended— 5 (1) in subparagraph (A)— 6 (A) in clause (i), by striking ‘‘; and’’ and 7 inserting a semicolon; 8 (B) in clause (ii), by striking the period at 9 the end and inserting ‘‘; and’’; and 10 (C) by adding at the end the following: 11 ‘‘(iii) any transaction described in 12 clause (vi) or (vii) of subparagraph (B) 13 proposed or pending on or after the date of 14 the enactment of this clause.’’; and 15 (2) in subparagraph (B), by adding at the end 16 the following: 17 ‘‘(vi) Any acquisition or transfer of an 18 interest, other than a security, in agricul-19 tural land held by a person that is a na-20 tional of, or is organized under the laws or 21 otherwise subject to the jurisdiction of, a 22 country— 23 ‘‘(I) designated as a nonmarket 24 economy country pursuant to section 25 VerDate Sep 11 2014 03:48 Mar 26, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1012.IS S1012 ssavage on LAPJG3WLY3PROD with BILLS 3 •S 1012 IS 771(18) of the Tariff Act of 1930 (19 1 U.S.C. 1677(18)); or 2 ‘‘(II) identified as a country that 3 poses as risk to the national security 4 of the United States in the most re-5 cent annual report on worldwide 6 threats issued by the Director of Na-7 tional Intelligence pursuant to section 8 108B of the National Security Act of 9 1947 (50 U.S.C. 3043b)(commonly 10 known as the ‘Annual Threat Assess-11 ment’).’’. 12 SEC. 3. PROHIBITION ON USE OF FUNDS FOR CERTAIN AG-19 RICULTURAL REAL ESTATE HOLDINGS. 20 No assistance, including subsidies, may be provided 21 by any Federal agency to a person for an agricultural real 22 estate holding wholly or partly owned by a person that 23 is a national of, or is organized under the laws or other-24 wise subject to the jurisdiction of, a country— 25 VerDate Sep 11 2014 03:48 Mar 26, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S1012.IS S1012 ssavage on LAPJG3WLY3PROD with BILLS 5 •S 1012 IS (1) designated as a nonmarket economy country 1 pursuant to section 771(18) of the Tariff Act of 2 1930 (19 U.S.C. 1677(18)); or 3 (2) identified as a country that poses as risk to 4 the national security of the United States in the 5 most recent annual report on worldwide threats 6 issued by the Director of National Intelligence pur-7 suant to section 108B of the National Security Act 8 of 1947 (50 U.S.C. 3043b)(commonly known as the 9 ‘‘Annual Threat Assessment’’). 10 SEC. 5. DISCLOSURE REQUIREMENTS FOR FOREIGN AGRI-11 CULTURAL REAL ESTATE HOLDINGS. 12 (a) R EPORTINGREQUIREMENTS.—Section 2(a) of 13 the Agricultural Foreign Investment Disclosure Act of 14 1978 (7 U.S.C. 3501(a)) is amended— 15 (1) in the first sentence of the matter preceding 16 paragraph (1)— 17 (A) by inserting ‘‘, or enters into a leasing 18 agreement the period of which is longer than 5 19 years with respect to agricultural land,’’ after 20 ‘‘agricultural land’’; and 21 (B) by striking ‘‘acquisition or transfer’’ 22 and inserting ‘‘acquisition, transfer, or lease’’; 23 and 24 VerDate Sep 11 2014 03:48 Mar 26, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S1012.IS S1012 ssavage on LAPJG3WLY3PROD with BILLS 6 •S 1012 IS (2) in paragraph (4), by striking ‘‘acquired or 1 transferred’’ and inserting ‘‘acquired, transferred, or 2 leased’’. 3 (b) R EVOCATION OFMINIMUMACREAGEREQUIRE-4 MENT.—Section 9(1) of the Agricultural Foreign Invest-5 ment Disclosure Act of 1978 (7 U.S.C. 3508(1)) is 6 amended by inserting ‘‘, subject to the condition that the 7 Secretary may not exclude land from this definition based 8 on the acreage of the land’’ before the semicolon at the 9 end. 10 SEC. 6. REPORTS OF HOLDINGS OF AGRICULTURAL LAND 11 IN THE UNITED STATES BY FOREIGN PER-12 SONS. 13 Section 6 of the Agricultural Foreign Investment Dis-14 closure Act of 1978 (7 U.S.C. 3505) is amended— 15 (1) by striking the section designation and 16 heading and all that follows through ‘‘Not later 17 than’’ and inserting the following: 18 ‘‘SEC. 6.
